ChapterIGeneralProvisions

Article1ThisLawisformulatedforthepurposesofmaintainingthelitigationrights,ensuringtheascertainingoffactsbythepeople’scourts,distinguishingrightfromwrong,applyingthelawcorrectly,tryingmaritimecasespromptly.

Article2WhoeverengagesinmaritimelitigationwithintheterritoryofthePeople’sRepublicofChinashallapplytheCivilProcedureLawofthePeople’sRepublicofChinaandthisLaw.WhereotherwiseprovidedforbythisLaw,suchprovisionsshallprevail.

Article3IfaninternationaltreatyconcludedoraccededtobythePeople’sRepublicofChinacontainsprovisionsthatdifferfromprovisionsoftheCivilProcedureLawofthePeople’sRepublicofChinaandthisLawinrespectofforeign-relatedmaritimeprocedures,theprovisionsoftheinternationaltreatyshallapply,exceptthoseonwhichChinahasmadereservations.

Article4Themaritimecourtshallentertainthelawsuitsfiledinrespectofamaritimetortiousdispute,maritimecontractdisputeandothermaritimedisputesbroughtbythepartiesasprovidedforbylaws.

Article5Indealingwithmaritimelitigation,themaritimecourts,thehigherpeople’scourtswheresuchcourtsarelocatedandtheSupremePeople’sCourtshallapplytheprovisionsofthisLaw.

ChapterIIJurisdiction

Article6MaritimeterritorialjurisdictionshallbeconductedinaccordancewiththerelevantprovisionsoftheCivilProcedureLawofthePeople’sRepublicofChina.

Themaritimeterritorialjurisdictionbelowshallbeconductedinaccordancewiththefollowingprovisions:

（1）Alawsuitbroughtonmaritimetortiousmaybe,inadditiontotheprovisionsofArticles19to31oftheCivilProcedureLawofthePeople’sRepublicofChina,underjurisdictionofthemaritimecourtoftheplaceofitsportofregistry;

（2）Alawsuitbroughtonmaritimetransportationcontractmaybe,inadditiontotheprovisionsofArticles82oftheCivilProcedureLawofthePeople’sRepublicofChina,underjurisdictionofthemaritimecourtoftheplaceofitsportofre-transportation;

（3）Alawsuitbroughtonmaritimecharterpartiesmaybeunderjurisdictionofthemaritimecourtoftheplaceofitsportofshipdelivery,portofshipreturn,portofshipregistry,portwherethedefendanthasitsdomicile;

（4）Alawsuitbroughtonamaritimeprotectionandindemitycontractmaybeunderjurisdictionofthemaritimecourtoftheplacewheretheobjectoftheactionislocated,theplacewheretheaccidentoccurredortheplacewherethedefendanthasitsdomicile;

（5）Alawsuitbroughtonamaritimecontractofemploymentofcrewmaybeunderjurisdictionofthemaritimecourtoftheplacewheretheplaintiffhasitsdomicile,theplacewherethecontractissigned,theplaceoftheportwherethecrewisabroadortheportwherethecrewleavestheshiportheplacewherethedefendanthasitsdomicile;

（6）Alawsuitbroughtonamaritimeguarantymaybeunderjurisdictionofthemaritimecourtoftheplacewherethepropertymortgagedislocatedortheplacewherethedefendanthasitsdomicile;alawsuitbroughtonashipmortgagemayalsobeunderjurisdictionofthemaritimecourtintheplaceofregistryport;

（7）alawsuitbroughtonownership,procession,anduse,maritimeliensofaship,maybeunderjurisdictionofthemaritimecourtoftheplacewheretheshipislocated,theplaceofshipregistryortheplacewherethedefendanthasitsdomicile.

Article7ThefollowingmaritimelitigationshallbeundertheexclusivejurisdictionofthemaritimecourtsspecifiedinthisArticle:

（1）Alawsuitbroughtonadisputeoverharbouroperationsshallbeunderthejurisdictionofthemaritimecourtoftheplacewheretheharbourislocated;

（2）Alawsuitbroughtonadisputeoverpollutiondamageforaship’sdischarge,omissionordumpingofoilorotherharmfulsubstances,ormaritimeproduction,operations,shipscrapping,repairingoperationsshallbeunderthejurisdictionofthemaritimecourtoftheplacewhereoilpollutionoccurred,whereinjuryresultoccurredorwherepreventivemeasuresweretaken;

（3）AlawsuitbroughtonadisputeoveraperformanceofamaritimeexplorationanddevelopmentcontractwithintheterritoryofthePeople’sRepublicofChinaandtheseaareasunderitsjurisdictionshallbeunderthejurisdictionofthemaritimecourtoftheplacewherethecontractisperformed.

Article8Wherethepartiestoamaritimedisputeareforeignnationals,statelesspersons,foreignenterprisesororganizationsandtheparties,throughwrittenagreement,choosethemaritimecourtofthePeople’sRepublicofChinatoexercisejurisdiction,eveniftheplacewhichhaspracticalconnectionswiththedisputeisnotwithintheterritoryofthePeople’sRepublicofChina,themaritimecourtofthePeople’sRepublicofChinashallalsohavejurisdictionoverthedispute.

Article9Anapplicationfordeterminingamaritimepropertyasownerlessshallbefiledbythepartieswiththemaritimecourtoftheplacewherethepropertyislocated;anapplicationfordeclaringapersonasdeadduetoamaritimeaccidentshallbefiledwiththemaritimecourtoftheplacewherethecompetentorganresponsibleforhandlingwiththeaccidentorthemaritimecourtthatacceptstherelevantmaritimecases.

Article10Intheeventofajurisdictionaldisputebetweenamaritimecourtandapeople’scourt,itshallberesolvedbythedisputingpartiesthroughconsultation;ifthedisputecannotbesoresolved,itshallbereportedtotheircommonsuperiorpeople’scourtforthedesignationofjurisdiction.

Article11Whenthepartiesapplyforenforcementofmaritimearbitralaward,applyforrecognitionandenforcementofajudgementorwrittenorderofaforeigncourtandforeignmaritimearbitralaward,anapplicationshallbefiledwiththemaritimecourtoftheplacewherethepropertysubjectedtoexecutionoroftheplacewherethepersonsubjectedtoexecutionhasitsdomicile.Incaseofnomaritimecourtintheplacewherethepropertysubjectedtoexecutionorintheplacewherethepersonsubjectedtoexecutionhasitsdomicile,anapplicationshallbefiledwiththeintermediatepeople’scourtoftheplacewherethepropertysubjectedtoexecutionoroftheplacewherethepersonsubjectedtoexecutionhasitsdomicile.

ChapterIIIMaritimeClaimsPreservation

Section1GeneralPrinciples

Article12Maritimeclaimsmeanmaritimecourts,accordingtoapplicationsof　maritimeclaimants,takecompulsorypreservationmeasuresagainstpropertyofpersonsagainstwhomtheclaimsarebroughtupinordertoensuretherealizationofsuchrights.

Article13Anapplicationformaritimeclaimsbythepartiesshall,beforebringalawsuit,befiledwiththemaritimecourtoftheplacewherethepropertysubjectedtopreservation.

Article14Maritimeclaimsshallnotbeboundbyprocedurejurisdictionagreementsorarbitrationagreementsrelatingtothesaidmaritimeclaimsbetweentheparties.

Article15Wheremaritimeclaimantsapplyformaritimeclaims,writtenapplicationsshallbefiledwithmaritimecourts.Maritimeclaims,applicationreasons,objectssubjectedtopreservationandamountsforguarantyshallbestatedinapplications.

Article16Amaritimecourtmay,inacceptingamaritimepreservationapplication,ordertheclaimanttoprovideaguaranty.Wheretheclaimantfailstoprovideguaranty,hisapplicationshallberejected.

Article17Afterreceivinganapplication,themaritimecourtmustmakeanorderwithin48hours;ifthecourtorderstheadoptionofmaritimepreservationmeasures,theexecutionthereofshallbeginimmediately.Wherenotconformingtotheconditionsforamaritimepreservation,theapplicationshallberejected.

Ifthepartyconcernedisnotsatisfiedwiththeorder,hemay,withinfivedaysfromthedateofthereceiptoftheorder,applyforreconsiderationwhichcouldbegrantedonlyonce.Themaritimecourtshallmakeareconsiderationdecisionwithinfivedaysfromthedateofthereceiptofthereconsiderationapplication.Executionoftheordershallnotbesuspendedduringthetimeofreconsideration.

Wheretheinterestedpartyraisesobjectiontothemaritimepreservation,themaritimecourt,uponexaminationanddeemingitreasonable,shallcancelthepropertypreservation.

Article18Ifthepersonagainstwhomtheapplicationformaritimepreservationismadeprovidesguaranty,orthepartyhasjustifiedreasonsforapplyingcancellationofmaritimereservation,thepeople’scourtshallcancelthepropertyreservationpromptly.

IfthemaritimeclaimantfailstobringanactionorapplyforarbitrationaccordingtothearbitrationagreementwithinthetimelimitspecifiedbythisLaw,thepeople’scourtshallcancelthepropertyreservationorreturntheguarantypromptly.
