FORTHEIRIMPLEMENTATION
ARTICLE43.Statementofobjective.–ItistheobjectiveofthisTitletodevelophumanresources,establishtraininginstitutions,andformulatesuchplansandprogramsaswillensureefficientallocation,developmentandutilizationofthenationsmanpowerandtherebypromoteemploymentandaccelerateeconomicandsocialgrowth.
ARTICLE44.Definitions.–AsusedinthisTitle:
(a)“Manpower”shallmeanthatportionofthenationspopulationwhichhasactualorpotentialcapabilitytocontributedirectlytotheproductionofgoodsandservices.
(b)“Entrepreneurship”shallmeantrainingforself-employmentorassistingindividualorsmallindustrieswithinthepurviewofthisTitle.
ARTICLE45.NationalManpowerandYouthCouncil;
Composition.–TocarryouttheobjectivesofthisTitle,theNationalManpowerandYouthCouncil,whichisattachedtotheDepartmentofLaborforpolicyandprogramcoordinationandhereinafterreferredtoastheCouncil,shallbecomposedoftheSecretaryofLaborasex-officiochairman,theSecretaryofEducationandCultureasex-officiovice-chairman,andasex-officiomembers,theSecretaryofEconomicPlanning,theSecretaryofNaturalResources,theChairmanoftheCivilServiceCommission,theSecretaryofSocialWelfare,theSecretaryofLocalGovernment,theSecretaryofScienceandTechnology,theSecretaryofTradeandIndustryandtheDirector-GeneraloftheCouncil.TheDirectorGeneralshallhavenovote.
Inaddition,thePresidentshallappointthefollowingmembersfromtheprivatesector:
two
(2)representativesofnationalorganizationsofemployers;
two
(2)representativesofnationalworkersorganizations;
andonerepresentativeofnationalfamilyandyouthorganizations,eachforatermofthree(3)years.
ARTICLE46.NationalManpowerPlan.–TheCouncilshallformulatealong-termnationalmanpowerplanfortheoptimumallocation,developmentandutilizationofmanpowerforemployment,entrepreneurshipandeconomicandsocialgrowth.Thismanpowerplanshall,afteradoptionbytheCouncil,beupdatedannuallyandsubmittedtothePresidentforhisapproval.Thereafter,itshallbethecontrollingplanforthedevelopmentofmanpowerresourcesfortheentirecountryinaccordancewiththenationaldevelopmentplan.TheCouncilshallcalluponanyagencyoftheGovernmentortheprivatesectortoassistinthiseffort.
ARTICLE47.NationalManpowerSkillsCenter.–TheCouncilshallestablishaNationalManpowerSkillsCenterandregionalandlocaltrainingcentersforthepurposeofpromotingthedevelopmentofskills.ThecentersshallbeadministeredandoperatedundersuchrulesandregulationsasmaybeestablishedbytheCouncil.
ARTICLE48.Establishmentandformulationofskillsstandards.–ThereshallbenationalskillsstandardsforindustrytradestobeestablishedbytheCouncilinconsultationwithemployersandworkersorganizationsandappropriategovernmentauthorities.TheCouncilshallthereafteradministerthenationalskillsstandards.
ARTICLE49.Administrationoftrainingprograms.–TheCouncilshallprovide,throughtheSecretariat,instructortraining,entrepreneurshipdevelopment,traininginvocations,tradesandotherfieldsofemployment,andassistanyemployerororganizationintrainingschemesdesignedtoattainitsobjectivesunderrulesandregulationswhichtheCouncilshallestablishforthispurpose.
TheCouncilshallexercise,throughtheSecretariat,authorityandjurisdictionover,andadminister,on-goingtechnicalassistanceprogramsand/orgrants-in-aidformanpowerandyouthdevelopmentincludingthosewhichmaybeenteredintobetweentheGovernmentofthePhilippinesandinternationalandforeignorganizationsandnations,aswellaspersonsandorganizationsinthePhilippines.
Inordertointegratethenationalmanpowerdevelopmentefforts,allmanpowertrainingschemesasprovidedforinthisCodeshallbecoordinatedwiththeCouncil,particularlythosehavingtodowiththesettingofskillsstandards.Forthispurpose,existingmanpowertrainingprogramsinthegovernmentandintheprivatesectorshallbereportedtotheCouncilwhichmayregulatesuchprogramstomakethemconformwithnationaldevelopmentprograms.
ThisArticleshallnotincludeapprentices,learnersandhandicappedworkersasgovernedbyappropriateprovisionsofthisCode.
ARTICLE50.Industryboards.–TheCouncilshallestablishindustryboardstoassistintheestablishmentofmanpowerdevelopmentschemes,tradesandskillsstandardsandsuchotherfunctionsaswillprovidedirectparticipationofemployersandworkersinthefulfillmentoftheCouncilsobjectives,inaccordancewithguidelinestobeestablishedbytheCouncilandinconsultationwiththeNationalEconomicandDevelopmentAuthority.
ThemaintenanceandoperationsoftheindustryboardsshallbefinancedthroughafundingschemeundersuchratesoffeesandmannersofcollectionanddisbursementsasmaybedeterminedbytheCouncil.
ARTICLE51.Employmentservicetrainingfunctions.–TheCouncilshallutilizetheemploymentserviceoftheDepartmentofLaborfortheplacementofitsgraduates.TheBureauofEmploymentServicesshallrenderassistancetotheCouncilinthemeasurementofunemploymentandunderemployment,conductoflocalmanpowerresourcesurveysandoccupationalstudiesincludinganinventoryofthelaborforce,establishmentandmaintenancewithoutchargeofanationalregisteroftechnicianswhohavesuccessfullycompletedatrainingprogramunderthisAct,andskilledmanpowerincludingitspublication,maintenanceofanadequateandup-to-datesystemofemploymentinformation.
ARTICLE52.IncentiveScheme.–Anadditionaldeductionfromtaxableincomeofone-half(1/2)ofthevalueoflabortrainingexpensesincurredfordevelopmentprogramsshallbegrantedtothepersonorenterpriseconcernedprovidedthatsuchdevelopmentprograms,otherthanapprenticeship,areapprovedbytheCouncilandthedeductiondoesnotexceedtenpercent(10%)ofthedirectlaborwage.
Thereshallbeareviewofthesaidschemetwoyearsafteritsimplementation.
ARTICLE.53.CouncilSecretariat.–TheCouncilshallhaveaSecretariatheadedbyaDirector-GeneralwhoshallbeassistedbyaDeputyDirector-General,bothofwhomshallbecareeradministratorsappointedbythePresidentofthePhilippinesonrecommendationoftheSecretaryofLabor.TheSecretariatshallbeundertheadministrativesupervisionoftheSecretaryofLaborandshallhaveanOfficeofManpowerPlanningandDevelopment,anOfficeofVocationalPreparation,aNationalManpowerSkillsCenter,regionalmanpowerdevelopmentofficesandsuchotherofficesasmaybenecessary.
TheDirector-Generalshallhavetherankandemolumentsofanundersecretaryandshallserveforatermoften(10)years.TheExecutive-DirectorsoftheOfficeofManpowerPlanningandDevelopment,theOfficeofVocationalPreparationandtheNationalManpowerSkillsCentershallhavetherankandemolumentsofabureaudirectorandshallbesubjecttoCivilServiceLaw,rulesandregulations.TheDirector-General,DeputyDirector-GeneralandExecutiveDirectorsshallbenatural-borncitizens,betweenthirtyandfiftyyearsofageatthetimeofappointment,withamastersdegreeorits
equivalent,andexperienceinnationalplanninganddevelopmentofhumanresources.TheExecutiveDirectoroftheNationalManpowerSkillsCentershall,inadditiontotheforegoingqualifications,haveundergonetrainingincentermanagement.ExecutiveDirectorsshallbeappointedbythePresidentontherecommendationsoftheSecretaryofLaborandEmployment.
TheDirector-Generalshallappointsuchpersonnelnecessarytocarryouttheobjectives,policiesandfunctionsoftheCouncilsubjecttoCivilServicerules.TheregularprofessionalandtechnicalpersonnelshallbeexemptfromWAPCOrulesandregulations.
TheSecretariatshallhavethefollowingfunctionsandresponsibilities:
(a)ToprepareandrecommendthemanpowerplanforapprovalbytheCouncil;
(b)TorecommendallocationofresourcesfortheimplementationofthemanpowerplanasapprovedbytheCouncil;
(c)TocarryoutthemanpowerplanastheimplementingarmoftheCouncil;
(d)ToeffecttheefficientperformanceofthefunctionsoftheCouncilandtheachievementoftheobjectivesofthisTitle;
(e)Todeterminespecificallocationofresourcesfortheprojectstobeundertakenpursuanttoapprovedmanpowerplans;
(f)TosubmittotheCouncilperiodicreportsonprogressandaccomplishmentofworkprograms;
(g)ToprepareforapprovalbytheCouncilanannualreporttothePresidentonplans,programsandprojectsonmanpowerandout-of-schoolyouthdevelopment;
(h)ToenterintoagreementstoimplementapprovedplansandprogramsandperformanyandallsuchactsaswillfulfilltheobjectivesofthisCodeaswellasensuretheefficientperformanceofthefunctionsoftheCouncil;
and
(i)ToperformsuchotherfunctionsasmaybeauthorizedbytheCouncil.
ARTICLE54.Regionalmanpowerdevelopmentoffices.-TheCouncilshallcreateregionalmanpowerdevelopmentofficeswhichshalldeterminethemanpowerneeds
