　　ChapterlGeneralProvisions

　　Article1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadministrationofemploymentofforeignersinChina

　　Article2Theterm"

foreigners"

intheseRulesreferstothepersons，whoundertheNationalityLawofthePeople'

sRepublicofChina,donothaveChinesenationality.Theterm"

employmentofforeignersinChina"

intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewiththelaws.

　　Article3TheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplytoforeignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates，ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.

　　Article4Thelabouradministrativeauthoritiesofthepeople'

sgovernmentoftheprovinces，autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersinChina.

　　ChapterIIEmploymentLicense

　　Article5TheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople'

sRepublicofChinaEmploymentLicenseforForeigners（hereinafterreferredtoasthe"

EmploymentLicense"

）.

　　Article6Theposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed，apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulations.Noemployershallemployforeignerstoengageincommercializedentertainingperformance，exceptforthepersonsqualifiedunderArticle9（3）oftheseRules.

　　Article7AnyforeignersseekingemploymentinChinashallmeetthefollowingconditions：

（1）18yearsofageorolderandingoodhealth

（2）withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;

　　（3）withnocriminalrecord;

　　（4）aclearly-definedemployer;

　　（5）withvalidpassportorotherinternationaltraveldocumentinlieuofthepassport（hereinafterreferredtoasthe"

TravelDocument"

）.

　　Article8ForeignersseekingemploymentinChinashallholdtheEmploymentVisasfortheirentry（Incaseofagreementformutualexemptionofvisas，theagreementshallprevail.）,andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner（hereinafterreferredtoasthe"

EmploymentPermit"

）andtheforeignerresidencecertificate.

　　Foreignerswhohavenotbeenissuedresidencecertificate（i.e.holdersofF，L，CorG-typesvisas），andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases，employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceproceduresundertheseRules.ForeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentPermitandresidencecertificate.

　　TheemploymentinChinaofthespousesofthePersonnelofforeignembassies,consulates，representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationsinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople'

sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies，ConsulatesandtheRepresentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.

　　TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandpreparedexclusivelybytheMinistryofLabour.

　　Article9ForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentPermitwhentheymeetanyofthefollowingconditions：

（1）foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina'

sBureauofForeignExpertAffairs;

（2）foreignworkerswithspecialskillswhowokinoffshorepetroleumoperationswithouttheneedtogoashoreforemploymentandhold"

WorkPermitforForeignPersonnelEngagedintheOffshorepetroleumOperationsinthePeople'

sRepublicofChina"

　　（3）foreignerswhoconductcommercializedentertainingperformancewiththeapprovaloftheMinistryofCultureandhold"

PermitforTemporaryCommercializedPerformance"

.

　　Article10ForeignersmaybeexemptedfromtheEmploymentLicenseandmayapplydirectlyfortheEmploymentPermitbypresentingtheirEmploymentVisasandrelevantpapersaftertheirentrywhentheymeetanyofthefollowingconditions:

（1）foreignersemployedinChinaunderagreementsoraccordsenteredintobytheChinesegovernmentwithforeigngovernmentsorinternationalorganizationsfortheimplementationofSino-foreignprojectsofcooperationandexchange;

（2）chiefrepresentativesandrepresentativesofthepermanentofficesofforeignenterprisesinChina.

　　ChapterIIIApplicationandApproval

　　Article11Theemployerwhenintendingtoemployaforeigner，shallfillouttheApplicationFormfortheEmploymentofForeigners（hereinafterreferredtoasthe"

ApplicationForm"

）andsubmitittoitscompetenttradeauthoritiesatthesamelevelasthelabouradministrativeauthoritiestogetherwiththefollowingdocumentations：

（1）thecurriculumvitaeoftheforeignertobeemployed;

（2）theletterofintentionforemployment;

　　（3）thereportofreasonsforemployment;

　　（4）thecredentialsoftheforeignerrequiredfortheperformanceofthejob;

　　（5）thehealthcertificateoftheforeignertobeemployed;

　　（6）otherdocumentsrequiredbyregulations.ThecompetenttradeauthoritiesshallexamineandapprovetheapplicationinaccordancewithArticles6and7oftheseRulesandrelevantlawsanddecrees.

　　Article12Aftertheapprovalbythecompetenttradeauthorities，theemployershalltaketheApplicationFormtothelabouradministrativeauthoritiesoftheprovince，autonomousregionormunicipalitydirectlyundertheCentralGovernmentorthelabouradministrativeauthoritiesattheprefectureandcitylevelwherethesaidemployerislocatedforexaminationandclearance.

　　Thelabouradministrativeauthoritiesdescribedaboveshalldesignateaspecialbody（hereinafterreferredtoasthe"

CertificateOffice"

）totakeuptheresponsibilityofissuingtheEmploymentLicense.TheCertificateOfficeshouldtakeintoconsiderationoftheopinionsofthecompetenttradeauthoritiesandthedemandandsupplyoflabourmarket，andissuetheEmploymentLicensetotheemployerafterexaminationandclearance.

　　Article13EmployersattheCentrallevelorthosewithoutthecompetenttradeauthoritiesmaysubmittheirapplicationdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense.

　　Theexaminationandapprovalbythecompetenttradeauthoritiesisnotrequiredforforeign-fundedenterprisestoemployforeigners，andsuchenterprisesmaysubmittheirapplicationsdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense，bringingwiththemthecontract,articlesofassociation,certificateofapproval,businesslicenseandthedocumentsreferredtoinArticle11oftheseRules.

　　Article14EmployerswithpermissiontoemployforeignersshallnotsendtheEmploymentLicensenortheletterofvisanotificationdirectlytotheforeignerstobeemployedandtheymustbesentbytheauthorizedunit.

　　Article15ForeignerswithpermissiontoworkinChinashouldapplyforEmploymentVisasattheChineseembassies，consulatesandvisaoffices,bringingwiththemtheEmploymentLicenseissuedbytheMinistryofLabour，theletterortelexofvisanotificationsentbytheauthorizedunitandthevalidpassportorTravelDocument.

　　PersonnelreferredtoinArticle9

（1）oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunit;

personnelreferredtoinArticle9

（2）shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheChinaNationalOffshoreOilCorporation;

　　personnelreferredtoinArticle9（3）shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheforeignaffairs,officeunderthepeople'

sgovernmentofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentandtherelevantdocumentsofapprovaloftheMinistryofCulture（addressedtotheChineseembassies，consulatesorvisaoffices）.

　　PersonnelreferredtoinArticle10

（1）oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunitandthedocumentationonprojectsofcooperationandexchange;
