　　PARTONE　GENERALPROVISIONS

　　Article1　TheseRegulationsareformulatedinordertoguaranteeavailabilityofmedicaltreatmentandeconomiccompensationtostaffandworkersthatsufferfromwork-relatedaccidentalinjuryoroccupationaldisease，topromotepreventionofwork-relatedinjuryandvocationalrehabilitation，andtodistributework-relatedinjuryrisksofemployers.

　　Article2　Alltypesofenterprisesandsoletradersthathireworkers（Employer（s））shallparticipateinwork-relatedinjuryinsuranceandpaywork-relatedinjuryinsurancepremiumsforallofthestaffandworkersorhiredworkersintheirworkunit（Employee（s））inaccordancewiththeprovisionshereof.

　　TheEmployeesofalltypesofenterprisesandthehiredworkersofsoletradersinthePeople'sRepublicofChinashallhavetherighttoenjoythebenefitsofwork-relatedinjuryinsuranceinaccordancewiththeprovisionshereof.

　　Thespecificstepsandimplementingproceduresforparticipationofsoletradersthathireworkersinwork-relatedinjuryinsuranceshallbestipulatedbythepeople'sgovernmentsofprovinces，autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment.

　　Article3　Collectionandpaymentofwork-relatedinjuryinsurancepremiumsshallbecarriedoutinaccordancewiththeprovisionsintheCollectionandPaymentofSocialInsurancePremiumsTentativeRegulationsregardingcollectionandpaymentofbasicoldageinsurancepremiums，basicmedicalinsurancepremiumsandunemploymentinsurancepremiums.

　　Article4　AnEmployershallannouncewithintheworkunittherelevantdetailsofitsparticipationinwork-relatedinjuryinsurance.

　　AnEmployeranditsEmployeesshallabidebythelawsandregulationsregardingsafeproductionandpreventionandtreatmentofoccupationaldiseases，implementsafetyandhealthregulationsandstandards，preventoccurrenceofwork-relatedinjuryaccidentsandavoidandmitigatetheharmsofoccupationaldiseases.

　　IfanEmployeesuffersfromwork-relatedinjury，theEmployershalladoptmeasurestoensurethatsuchEmployeereceivestimelyrescueandtreatment.

　　Article5　TheadministrativedepartmentoflaboursecurityoftheStateCouncilshallbeinchargeoftheworkofwork-relatedinjuryinsurancethroughoutthecountry.

　　Theadministrativedepartmentsoflaboursecurityofalllevelsoflocalpeople'sgovernmentsatthecountylevelandaboveshallbeinchargeofwork-relatedinjuryinsuranceworkwithintheirrespectiveadministrativeareas.

　　ThesocialinsuranceagenciesestablishedbytheadministrativedepartmentsoflaboursecurityinaccordancewithrelevantprovisionsoftheStateCouncil（Agency/Agencies）shallundertakethepracticalaffairsofwork-relatedinjuryinsurance.

　　Article6　AdministrativedepartmentsoflaboursecurityandotherdepartmentsshallseektheopinionoftradeunionsandrepresentativesofEmployerswhenformulatingpoliciesandstandardsforwork-relatedinjuryinsurance.

　　PARTTWO　WORK-RELATEDINJURYINSURANCEFUNDS

　　Article7　Work-relatedinjuryinsurancefundsshallbecomposedofwork-relatedinjuryinsurancepremiumspaidbyEmployers，interestonwork-relatedinjuryinsurancefundsandotherfundspaidintothework-relatedinjuryinsurancefundsinaccordancewithlaw.

　　Article8　Thepremiumrateforwork-relatedinjuryinsuranceshallbedeterminedontheprinciplesthatreceiptbedeterminedonthebasisofpaymentandthatreceiptandpaymentbebalanced.

　　TheStateshalldeterminepremiumratedifferentialsbetweenindustriesaccordingtothedegreeofrisksofwork-relat

edinjuriesindifferentindustries，andshalldetermineseveraltiersofpremiumrateswithineachindustryaccordingtocircumstancessuchastheuseofwork-relatedinjuryinsurancepremiumsandthefrequencyofoccurrenceofwork-relatedinjuries.Inter-industrypremiumratedifferentialsandintra-industrypremiumratetiersshallbeformulatedbytheadministrativedepartmentoflaboursecurityoftheStateCouncilinconjunctionwiththefinancedepartment，healthadministrativedepartmentandsafeproductionregulatorydepartmentoftheStateCouncil，andshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

　　TheAgencyforapoolingregionshalldeterminetheworkunitpayablepremiumrateforanEmployeronthebasisofsuchcircumstancessuchasuseofwork-relatedinjuryinsurancepremiumsandfrequencyofoccurrenceofwork-relatedinjuriesoftheEmployer，andthecorrespondingpremiumratetierapplicabletotheindustrytowhichtheEmployerbelongs.

　　Article9　TheadministrativedepartmentoflaboursecurityoftheStateCouncilshallperiodicallyobtainthedetailsofreceiptandpaymentofwork-relatedinjuryinsurancefundsofallpoolingregionsthroughoutthecountry，andshallproposeadjustmenttotheinter-industrypremiumratedifferentialsandtheintra-industrypremiumratetiersinatimelymannerandinconjunctionwiththefinancedepartment，healthadministrativedepartmentandsafeproductionregulatorydepartmentoftheStateCouncil.SuchadjustmentshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

　　Article10　Employersshallpaywork-relatedinjuryinsurancepremiumsontime.Employeesshallnotpaywork-relatedinjuryinsurancepremiumsthemselves.

　　Theamountofwork-relatedinjuryinsurancepremiumpayablebyanEmployershallbetheproductofthetotalpayrolloftheEmployeesoftheworkunitandtheworkunitpayablepremiumrate.

　　Article11　Work-relatedinjuryinsurancefundsinmunicipalitiesdirectlyunderthecentralgovernmentandmunicipalitieshavingdistrictsshallbepooledonamunicipality-widebasis.Thelevelofpoolinginotherregionsshallbedeterminedbythepeople'sgovernmentoftheprovinceorautonomousregion.

　　Aninter-regionindustryoranindustrywitharelativelyhighlevelofproductionmobilitymayparticipatefromanotherregioninwork-relatedinjuryinsuranceinapoolingregionbyadoptingamethodofrelativeconcentration.ThespecificproceduresshallbeformulatedbytheadministrativedepartmentoflaboursecurityoftheStateCouncilinconjunctionwiththedepartmentinchargeoftherelevantindustry.

　　Article12　Work-relatedinjuryinsurancefundsshallbedepositedintoadedicatedfinanceaccountforsocialsecurityfundsforbenefitsofwork-relatedinjuryinsurance，assessmentofworkcapabilityandpaymentofotherexpensesforwork-relatedinjuryinsurancestipulatedherein.Noworkunitorindividualmayusethework-relatedinjuryinsurancefundsforinvestmentandoperation，constructionorrenovationofofficesite，distributionofbonuses，ordivertsuchfundstootheruses.

　　Article13　Acertainratioofwork-relatedinjuryinsurancefundsshallbemaintainedasreservesforpaymentofwork-relatedinjuryinsurancebenefitsintheeventofmajoraccidentsinthepoolingregion.Incaseofashortageofreserves，thepeople'sgovernmentofthepoolingregionshalladvancethepayment.Thespecificratioofreservestothetotalamountoffundsandtheproceduresfortheuseofreservesshallbestipulatedbythepeople'sgovernmentsofprovinces，autonomousregionsormunicipalitiesdirectlyunderthecentralgovernment.

　　PARTTHREE　DETERMINATIONOFWORK-RELATEDINJURY

　　Article14　AnEmployeeshallbedeterminedashavingawork-relatedinjuryif：

　　1.heisinjuredinanaccidentatworkduri

ngworkinghoursintheworkplace；

　　2.heisinjuredinanaccidentwhileengaginginpreparatoryorfinishing-upworkrelatedtoworkbeforeorafterworkinghoursintheworkplace；

　　3.heisinjuredbyviolenceorinotheraccidentinhisperformanceofjobdutiesduringworkinghoursintheworkplace；

　　4.hesuffersfromanoccupationaldisease；

　　5.heisinjuredatworkorhiswhereaboutsbecameunknowninanaccident，duringwork-relatedtravel；

　　6.heisinjuredinamotorvehicleaccidentwhilegoingtoorreturningfromwork；or

　　7.heisinothercircumstancesthatshallbedeterminedaswork-relatedinjuryaccordingtotheprovisionsoflawsandadministrativeregulations.

　　Article15　AnEmployeeshallbedeemedashavingawork-relatedinjuryif：

　　1.hediesimmediatelyorwithin48hoursafteremergencytreatmentforadiseasesuddenlyarisingduringworkinghoursintheworkplace；

　　2.heisinjuredinanacttoprotectnationalinterestsorpublicinterestssuchasemergencyrescueanddisasterrelief；or

　　3.heisinjuredanddisabledinwarorondutywhileinmilitaryserviceandhasobtainedarevolutionaryinjuredanddisabledsoldiercertificate，andsuffersfromarelapseoftheoldinjurywhilebeingemployedbytheEmployer.

　　WhereanEmployeeisinthecircumstanceofItem

（1）or

（2）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsinaccordancewiththerelevantprovisionshereof.WhereanEmployeeisinthecircumstanceofItem（3）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsotherthanthelumpsumdisabilityallowanceinaccordancewiththerelevantprovisionshereof.

　　Article16　Anemployeeshallnotbedeterminedordeemedashavingwork-relatedinjuryif：

　　1.heisinjuredorhediesasaresultofcommissionofcrimeorviolationofpublicsecurityadministration；

　　2.heisinjuredorhediesasaresultofintoxication；or

　　3.heinflictsharmonhimselforcommitssuicide.

　　Article17　IfanEmployeeisinjuredinanaccidentordiagnosedorcertifiedashavingoccupationaldiseasepursuanttotheprovisionsofth
