船舶技术规格书常用条款描述汇总

一、总则General

1.GeneralArrangementPlan,MidshipSectionandMakers’ListtoaccompanyandformanintegralpartoftheSpecification.TheSpecificationandattachedplanstobecomplementarytoeachother.

2.Thetermsoftheshipbuildingcontracttoprevailandgovernintheeventofdisagreement,contradictionoranyinconsistencybetweentheshipbuildingcontractandtheSpecification.

Inaddition,intheeventofdisagreement,contradictionoranyinconsistencybetweentheSpecificationandthedrawings,theSpecificationtoprevailunlessspecificallyagreedmutuallybytheOwnerandtheBuilder.

IntheeventofconflictorinconsistencybetweenthetermsofthepartsoftheSpecifications,thehullpartshallprevailinrespectofhullitems,themachinerypartinrespectofmachineryitems,andtheelectricpartinrespectofelectricitems.

3.ThedescriptioninPartIGeneralProvisiontobeappliedtoallpartsoftheSpecification,whereasthedescriptionsintheotherpartstobeappliedtotherespectiveparts,ifnotdescribedotherwise.

4.TheBuildertofurnishallitemsrequiredforthecompletionofthevesselinaccordancewiththespecificationexceptitemsspecificallystatedhereinastobefurnishedandsuppliedbytheOwner.

5.AnythingnotmentionedinorcoveredbytheSpecificationandtheattachedplansbutrequiredfornormaloperationofthistypeofvesseltobeprovidedbyBuilderaccordingtotheshipbuildingpractice..

ItshouldbeunderstoodthatanythingnotmentionedintheseSpecificationsbutrequiredbytheClassificationSocietyorRegulatoryBodieslistedhereinshallbesuppliedandequippedbythebuilderwithoutanychargetotheOwner.

6.AnythingtwiceormorementionedintheSpecificationstobeonlyoncesuppliedorexecutedunlessotherwisespecificallyindicated..

7.AnyrequirementoftheOwner,whichisinexcessoftherequirementsoftheRulesandRegulationslistedhereinand/orthecontentofthisspecification,tobesubjecttoagreementandpossibleadjustmenttothecontractprice,deadweight,servicespeed,constructionscheduleetc.whichmaybeaffected.

8.AmendmentsandchangestotheSpecification,plansorotherwrittendocumentstobesignedbyanauthorizedrepresentativeoftheBuilderandOwner.Thesedocumentstobethesupplementtothecontract.

10.TheVesselshallbebuiltinaccordancewiththeSpecificationsandanymodificationsand/orchangestotheSpecificationsshallbeagreedmutuallybytheOwnerandtheBuilder,subjecttoadjustmentofprice,delivery,guaranteedfiguresandanyothertermsintheContractandintheSpecificationsandthoseshallbeconfirmedbymemorandumofdiscussions,letters,plans,E-mail,faxand/oravailabledocumentsbybothparties.

11.TheVesselshallbebuiltinaccordancewiththeBuilder’spracticeandtheclassificationsocietyrule'srequirementswithregardtoworkotherthanspecifiedbytheSpecifications.WhereeverBuilder'spracticeisreferredtointhisspecification,thestandardachievedshallbeequaltoorexceedthestandardsetoutinIACSrequirementofshipbuildingandrepairqualitystandard.

12.AnyamendmentsorchangesinRulesandRegulationsasdescribedinArticle“SECTION2CLASS,RULES,REGULATIONSANDCERTIFICATES”,andcomingintoeffectaftersigningtheContract,istobetreatedasamodificationtotheContractandtobesubjecttoseparatenegotiationsbetweentheOwnerandtheBuilder.

13.Duringapprovalofplans,bothpartiesagreetoadesignwhichdiffersfromthespecifications,itisunderstoodthattermsinthespecificationsconcerningthesealterationswouldbenolongerapplicable.Consequentlyinthesescases,thedrawingsshallbeapprovedbytheownerandtheapproveddrawingsshallsupplementtothespecifications.

14.SparepartsshallbesuppliedbytheBuilderaccordingtotheSpecificationstomeettherequirementsofthespecifiedClassificationSociety,theregulatorybodiesandmanufacturer’sstandard.

15.Partsandcomponentsofequipmentmadeunderlicensetobeinterchangeablewithparts/componentsproduced/installedasperoriginalmaker’sstandard.

16.Builder’spracticeshallbesubmittedtoBuyerforreference.

17.Whenwordssuchas“or”,“and/or”,“ifnecessary”,“ifany”,“similar”,“may”areusedintheSpecifications,theyshallbetoindicatethattheuseofalternativesispermittedattheBuilder’soption.

18.Duringthetestsandtrials,theBuildermayusesomeofthesuppliedspareparts,tools,andaccessoriestothevesselifnecessary,andtheBuildershallfurnishthemfromtheoriginalmanufacturebeforedelivery.

19.AllnecessarydocumentsanddrawingsforconstructionofthevesselshallbepreparedinEnglishorinEnglishandotherlanguageforapprovalbytheBuyer,classificationsocietyandauthorities.

20.Themeaningof“theBuyer”intheContractor“theOwner”intheSpecificationshallbeunderstoodtobethesame.

21.AllfiguresgivenintheSpecificationshallbeunderstoodasapproximateonesanddeterminedinaccordancewiththedesigndevelopmentexceptthosewhichareofcountablenature,unlessotherwisespecificallydescribedintheSpecification.

二、材料Materials

1.Ifanyspecifiedarticleormaterialcannotbeobtainedorsupplied,theBuildertohavetherighttoselectsuitablesubstituteswithOwner’sapproval.

2.Materials,machineryandequipment,etc.tobeofChinesemakerunlessspecificallyagreedand/ordescribedintheSpecificationsandtheMakers’List.

3.Allstructuralsteelusedfortheconstructionofthevesselandmachineryincludingforgingsandcastingstobeoftheshipbuildingandmarineengineeringquality,tested,inspectedandcertifiedasandwhenrequiredbytheClassificationSociety.

4.Minimizingtheuseofmaterialsknowntobepotentiallyhazardoustohealthandtheenvironment,especiallyasbestos,refrigerants（R12/R22）,HALON.Lead-basedpaintandTin-basedanti-foulingpainttobenotused.

5.StainlesssteelwithoutgradenotationintheSpecificationshallbeunderstoodasmarinetypeminimumgradeSUS304.

6.IfanyofthespecificdescriptionforthemachineryorequipmentintheSpecificationisnotconsistentwiththefinallyselectedmanufacturer'sstandardSpecification,suchdescriptionshallbereadilycorrectedtofollowthemanufacturer'sstandardSpecificationwithpriornoticetotheOwner;howeverinnocasetheseshallbelessinperformancethandescribedintheSpecification.

7.New,firstclassmaterialsetc.shallbeused,withaqualitysuitableforthistypeandsizeofVessel,adaptedtoworld-wideoperation.

三、工艺及标准Workmanship&Standards

1.AllworkmanshipenteringintotheconstructionofthevesseltobeinaccordancewiththeChineseshipbuildingstandardsand/orBuilder'sstandardpractice,applicabletothiskindofvessel,subjecttotheapprovaloftheClassificationSocietywherenecessary.ThestandardsofBuilder'spracticetobesubmittedtotheOwnerforreference.

2.Thefollowingstandardstobeappliedtotheconstructionofthevessel,asfaraspracticableexceptthefittingsspeciallydescribedhereinafter.

a）ISOstandard

b）Chineseindustrialstandards（GB,CSQS,CB,YB,etc.）

c）Builder'sstandards,andBuilder'sstandardpractice

d）IEC

e）IACS47,partA:

shipbuildingandrepairqualitystandardfornewconstruciton

3.InternationalSystemofUnits（SI）tobeadoptedfordesigningandconstructingofhull,machineryandequipmentunlessspecificallystatedinthisSpecification.

四、船东供品（Owner’ssupply）

1.FollowingitemstobefurnishedandsuppliedbytheOwnerattheirownexpense,andinstalledonthevesselbytheBuilder.TheBuildertoprovideshelteredandsecurestorage,handlinginstorageandhandlingon-board.

-MooringropesinexcessoftheSpecification

-Allairtools,hoses,steelwires,etc.otherthanthosementionedintheSpecification

-Allcharts,nauticalandradiostationbooks,houseflagandnationalflag

-Allconsumablestores

-Allmedicine,medicalequipmentandoxygenbottleforhospitalexceptthoseforlifeboat

-RecreationequipmentsuchasStereophony,VideotaperecorderandTVetcandstationeryotherthanmentionedintheSpecification

-Paintingandpictures

-Boatswain'sandcarpenter'stoolsoverandabovetheBuilder’sstandard

-Allbeddingandlinen（blankets,sheets,covers,etc.）butexcludingmattress.

-Allnapery（serviettes,tableclothes,etc.）

-Allcook'sandsteward'sutensils（crockery,cutlery,silverware,earthenware,glasses,pots,pans,etc.

-SuezCanalsearchlight,butsocketanddavittobesuppliedbybuilder

-Navigationequipmentinexcessofthoserequiredbytheauthoritiesand/orthosespecifiedinthisSpecification

-Allbunkers,lubricants,grease/hydraulicoil,workingoilandotherconsumableliquidexceptthoseconsumedduringconstructionandtest/trialsbeforedelivery.TheOwnertosupplylub.oilforseatrialsandtheBuildertopaythecostforthequantitiesoflub.oilconsumedduringthetrials.

-Allotherspare,storeandequipmentinexcessofRuleandSpecificationrequirementsandmaker'sstandard,unlessmakeragreestosupplyadditionalsparesfreeofchargeafteragreementwithOwner/Builder.

-Gassamplingdeviceandtemperaturemeasuringdeviceforcargohold

-GymnasticandSportapparatus/equipment,exceptspecifiedinotherpartsofthisspecification

-Chemistrydeposit

-Thehazardousgasdetectionequipmentandpersonalprotectionforcarriageofdangerouscargo.
