发包方：

承包方：

（以下简称乙方）Contractor（hereinafterreferredtoaspartyB）

鉴于甲方厂区内电气安装施工的需要，经过对乙方资质的审查和双方协商，决定将电气工程交由乙方组织施工。

根据《中华人民共和国合同法》和《中华人民共和国建筑法》及其它有关法律、法规，在遵循平等、自愿、公平和诚实信用的原则基础上，双方就本工程施工事宜协商一致，订立本合同，供双方共同遵守。

WHEREASthenecessityofelectricalfacilitiesengineeringintheWorkzone,partyA,throughexaminingthequalificationofandconsultationwithpartyB,herebyawardthiselectricalengineeringtopartyBforexecutionandcompletion.

InaccordancewithLAWOFCONTRACTandLAWOFCONSTRUCTIONandotherrelevantlawsandregulations,onthebasisofprinciplesofequality,voluntary,fairandhonesty,partiesheretoherebymakemutualnegotiationonthisprojectexecutionandconcludeandenterintothiscontractforpartiestoabideby.

一、工程概况ProjectOverview

1、工程名称：

3、工程内容：

电气施工图纸所列全部分项工程，包括配管、穿线、照明器具安装、配电箱安装、避雷接地，以及施工现场电气设备的维护及临时线路架设和维护。

ProjectContents:

Allsub-projectslistedinthedrawingsofelectricalengineeringincludingpiping,threading,lightinginstallation,distributionbox,lighteningprotection,maintenanceofelectricalequipmentsonthesiteandtheinstallation/maintenanceoftemporarycircuit.

二、承包范围及方式ContractedScopeandMeans

1、承包内容：

（一）配电箱：

乙方负责安装建筑物内配电柜/箱、公共照明配电箱、水泵房双电源切换箱、消防及监控中心双电源切换箱、电信机房配电箱、电梯机房双电源切换箱，消防风机电源箱、防火卷帘电源箱、潜污泵控制箱、发电电源配电箱、中央空调设备等电源箱、弱电箱。

Distributionbox:

PartyBshallberesponsiblefortheinstallation,withinbuildings,ofpowerdistributioncabinet/box,publiclightingdistributionbox,dualpowerswitchboxinwaterpumproom,dualpowerswitchboxinthefireprotectionandmonitoringcenter,distributionboxintelecommunicationsroom,dualpowerswitchboxintheelevatormachineroom,firefanpowerbox,fireshutterpowerbox,submersiblesewagepumpcontrolbox,powergenerationthepowerdistributionbox,centralair-conditioningequipmentandpowersupplybox,weakcurrentbox.

（二）用电器具：

建筑物内（宽带网络机房、发电机房、饮水设备房除外）需安装的灯具、开关插座排风扇等。

thelamps,switch,socketsandexhaustfanetc.withinbuildingsprovidedexceptbroadbandnetworkroom,generatorroom,drinkingwaterequipmentroom）.

（三）配管（槽）：

（强电）负责室内全部低压动力和公共照明系统的线管、线槽、桥架、线盒。

Piping（groove）:

strongcurrency;installationofline-pipe,line-groove,pipebridgeandline-boxfortheindoorlow-voltagepowerandpubliclightingsystem.

弱电：

以室内第一个弱电检查井为界。

乙方负责由室外第一个弱电检查井至室内的消防系统、弱电系统的暗敷线管、线槽、桥架、线盒，其中暗敷线管管内穿一根16#镀锌铁丝。

Weakcurrency:

indoorfirstweakinspectionwellisbounded.PartyBshouldberesponsiblefortheinstallationof,infiresystemandweakcurrencysystem,hiddensleeve,line-groove,bridgeandline-box,fromthefirstweakwellinoutdoortoindoor,throughthehiddensleevealineofa16#galvanizedironwireispenetrated.

（四）配线：

（公共照明系统）集中电表箱下桩的全部电线、电缆敷设及集中电表箱下桩的电线接线；

Distribution:

（publiclightingsystem）allwiresofunderthecentralizedmeterbox,layingofpipeline,connectionofwiresunderthecentralmeterbox.

动力系统：

自预留低压配电箱（柜）下桩至相关用电配电箱的全部电线电缆（含市电和发电）敷设和线缆上下桩接线（除另有约定外）。

其中水泵房动力系统线缆敷设至水泵房电源箱，电梯电源接自预留低压配电柜。

Powersystem:

Allwiresandcablesfromunderthereservedlow-voltagedistributionbox（cabinet）tothepowerdistributionincludingpowersuppliedandgenerated;layingandconnectionofwireson/underpipeexcepttheanotheragreement,amongwhichthepowercableofwaterpumproomtobelaidtotheboxthereofandthepowerofelevatorconnectedfromthereservedlow-voltagedistributioncabinet.

（五）乙方负责全部防雷、接地、等电位工程和承包范围内的电气工程系统的全部调试。

PartyBisresponsibleforallengineeringoflightningprotection,groundingandotherelectricalworksinadditiontoalldebuggingofelectricalengineeringsystemwithinthescopeofcontractedworks.

2、承包方式：

包工、包料、包安全文明施工。

ContractedMeans:

Contractedlaborsandmaterialsinadditiontothework’ssafetyandorderlyexecution.

三、合同工期Work’sPeriod

四、质量标准QualityStandard

工程质量标准：

一次验收合格率100%。

五、合同价款ProjectCostandPrice

1、本合同价款采用固定总价的方式，总价款为元（大写：

元整），不含税金。

经双方确认的总价款不作调整；各种包干措施费用，结算时一律不作调整。

2、任何一方不得擅自改变合同价款，但有下列情况之一时可以协商调整：

（1）因施工图相对于招标图纸有改变，经甲乙双方共同协商认可时；

（2）甲方代表确认的设计变更或工程联系单造成的工程量发生变更；

（1）Duetothealterationofthedrawingsforexecutioncomparingtothebiddingdrawingsandsubjecttotheconfirmationbypartieshereto‘smutualnegotiation.

（2）ThealterationofquantitywhichconfirmedbypartyA’srepresentativeorWork’sNotice.

六、工程变更ProjectAlteration

（1）甲方为使工程合理施工，有权随时向乙方发出工程变更指示，乙方须予以执行。

ForthepurposeofreasonableconstructionpartyAisentitleatanytimetogivedirectionofAlterationbywhichpartyBshouldimplement.

（2）乙方投标资料中已包括适用于变更工程的价格，如果乙方投标资料中没有有适用于变更工程的价格，由甲乙双方共同协商。

如果因工程变更或甲方原因影响工期的，按双方协商的时间顺延。

ThepriceofprojectalterationhavebeenincludedinpartyB’sbiddingdocuments,wherenopricewhichsuitabletothealterationinsuchdocuments,maybeonthenegotiationbypartieshereto,providedthattheworkperiodisdelayedoreffectedduetoalterationorpartyA’sreason,theworkperiodcanbepostponedbythetimeagreedupontheagreementofparties.

（3）为了保证工程进度，乙方不得以变更签证价款未定为理由，拒绝承担变更工作内容，否则造成的工期延误等一切损失（包括甲方另行委派其他工程公司完成该工作内容发生的费用）均由乙方承担。

ForassuranceofprojectprogresspartyBcannot,bythereasonofwithoutAlterationCertification,refusetoassumethealteredworks,otherwisealllossanddamagesarisingoutthereoforconnectiontherewithshallbeundertakenbypartyBincludingtheexpensesforwhichpartyAhastoassignothercontractorforcompletesuchwork.

七、付款方式Payment

1、所有合同内的电气工程完工，经验收合格后，一个月内支付总价款的90%；工程竣工验收，并办理完结算后，一个月内支付结算价款的95%。

90%paymentoftotalcostshallbeeffectedwithinonemonthuponcompletionofallelectricalengineeringworkshereofandthroughacceptance;95%paymentoftotalcostshallbeeffectedwithinonemonthuponthecompletionacceptanceandprocesssettlement.

2、剩余5%的工程款为质保金。

质保期为竣工验收后两年，质保期达到一年后支付质保金的50%，在质保期满后的10天内全部付清余款。

Remaining5%paymentofprojectcostistakenastheretentionmoney.Thewarrantyperiodistwoyearsaftercompletionacceptance.50%paymentoftheretentionmoneyshallbeeffectedafteroneyearofwarrantyperiodandthebalanceofretentionmoneyshallbepaidoffwithintendaysupontheexpirationofwarrantyperiod.

八、甲方职责PartyA’sResponsibilities

1、负责使施工场具备施工条件，提供一套施工图纸给乙方。

MakecontractingsitetobeprovidedwithexecutionconditionsandmakeavailabletopartyBwithasetofconstructiondrawings.

2、定期对工程进度、质量、安全文明施工情况进行检查，提出整改意见；及时将设计变更等技术资料交乙方。

Maketheregularinspectionofprojectprogress,qualityandsafetyexecution,providethecorrectandrectificationopinionandmakeavailabletopartyBwiththetechnicaldataofdesignalterationandsoon.

九、乙方职责PartyB’sResponsibilities

1、严格按照施工图纸和规范要求进行施工。

接受工程师监理，以及业主的管理。

及时提交进场材料报验、隐蔽工程验收报告、竣工验收报告、检测记录等技术资料。

Carryouttheexecutioninstrictaccordancewithconstructiondrawingsandspecifications,acceptengineer’ssupervisionandemployer’smanagement,submitintimethetechnicaldataincludingreportsofmaterialonsite,acceptanceofconcealedwork,completionacceptanceandinspectionrecord,etc.

2、负责在建和己完工程的成品保护。

与土建和设备安装工程的配合施工。

Beliableforprotectionofworkswhicharebuildingandhavebeenfinished,takecooperationwithearthworkandequipmentinstallationengineering.

3、乙方负责所承包工程的预决算和工程档案资料，按照工程进度及时提交进度款结算和工程竣工结算等，档案资料及时整理达到归档要求。

Archives/dataconcernedthebudget/finalandengineering,whicharefortheprojectcontractedbypartyB,shouldpursuanttotheprogress,besubmittedintimeforthesettlementofprogresspaymentandfinalpayment,andsoon.Preparationofarchives/datashouldbetimelysatisfytothefilingrequirements.

4、如果因乙方未按合同约定完成上述工作，引起的索赔和罚款，应由乙方承担。

上述各项工作的费用，均已包含在合同总价款内。

ProvidedthatpartyBfailstocompletetheworksaforementionedinaccordancewiththecontract,partyBshouldundertaketheclaimandpenaltythereonorincidentalthereto.Allvariouscostsofworksabovehavebeenincludedinthetotalpriceofcontract.

5、在工程施工的整个过程中，乙方负责施工现场全部人员的安全。

除因甲方、工程师的过失而造成伤亡外，甲方不承担乙方或其它人员的伤亡赔偿、补偿。

PartyBshould,duringtheprogressofproject,beliableforallpersonnel’ssafetyonthesite.Noneofindemnificationandcompensationforthepersonnel’scasualtiesofpartyBorother’swillbeundertakenbypartyA,exceptduetothefaultofpartyAorengineer.

十、质量与验收QualityandAcceptance

1、工程质量应符合国家或专业质量评定标准的合格条件。

因乙方原因使工程质量达不到约定的质量标准，乙方必须自费整改，使工程质量达到验收标准为止。
