3、)承包方：（以下简称乙方）Contractor ( hereinafter referred to as party B )鉴于甲方厂区内电气安装施工的需要，经过对乙方资质的审查和双方协商，决定将电气工程交由乙方组织施工。根据中华人民共和国合同法和中华人民共和国建筑法及其它有关法律、法规，在遵循平等、自愿、公平和诚实信用的原则基础上，双方就本工程施工事宜协商一致，订立本合同，供双方共同遵守。WHEREAS the necessity of electrical facilities engineering in the Work zone, party A, through examining

5、y, parties hereto hereby make mutual negotiation on this project execution and conclude and enter into this contract for parties to abide by.一、工程概况 Project Overview1、工程名称：电气安装 Project Name: Electrical Facilities Engineering 2、工程地点：厂区内 Project Place : Work s Zone 3、工程内容：电气施工图纸所列全部分项工程，包括配管、穿线、照明器具安装、

6、配电箱安装、避雷接地，以及施工现场电气设备的维护及临时线路架设和维护。Project Contents: All sub-projects listed in the drawings of electrical engineering including piping, threading, lighting installation, distribution box, lightening protection, maintenance of electrical equipments on the site and the installation / maintenance of t

7、emporary circuit.二、承包范围及方式 Contracted Scope and Means1、承包内容：contracted items（一）配电箱：乙方负责安装建筑物内配电柜/箱、公共照明配电箱、水泵房双电源切换箱、消防及监控中心双电源切换箱、电信机房配电箱、电梯机房双电源切换箱，消防风机电源箱、防火卷帘电源箱、潜污泵控制箱、发电电源配电箱、中央空调设备等电源箱、弱电箱。Distribution box: Party B shall be responsible for the installation, within buildings, of power distribu

15、on, grounding and other electrical works in addition to all debugging of electrical engineering system within the scope of contracted works.2、承包方式：包工、包料、包安全文明施工。Contracted Means: Contracted labors and materials in addition to the works safety and orderly execution.三、合同工期 Works Period开工日期：Commencemen

16、t of 竣工日期：Completion of 以实际开、竣工日期为准。Subject to the actual date of commencement and completion of Work.四、质量标准 Quality Standard工程质量标准：一次验收合格率100%。Project quality standard: 100% of qualified rate for once acceptance五、合同价款 Project Cost and Price1、本合同价款采用固定总价的方式，总价款为 元（大写： 元整），不含税金。经双方确认的总价款不作调整；各种包干措施费用

17、，结算时一律不作调整。The cost hereof is fixed price, the total cost is Yuan ( Say: Only) excluding taxes, the total cost agreed and confirmed by parties hereto shall not be adjusted, to-wit: the settlement shall be not made any adjustment for various contracted expenses.2、任何一方不得擅自改变合同价款，但有下列情况之一时可以协商调整：（1）因施工

18、图相对于招标图纸有改变，经甲乙双方共同协商认可时；（2）甲方代表确认的设计变更或工程联系单造成的工程量发生变更；The contract cost shall not be altered by any party arbitrarily provided that if one of following circumstances occurred may be by consultation for adjustment of price.(1) Due to the alteration of the drawings for execution comparing to the bid

19、ding drawings and subject to the confirmation by parties hereto s mutual negotiation.(2) The alteration of quantity which confirmed by party As representative or Works Notice.六、工程变更 Project Alteration（1）甲方为使工程合理施工，有权随时向乙方发出工程变更指示，乙方须予以执行。For the purpose of reasonable construction party A is entitle

20、at any time to give direction of Alteration by which party B should implement.（2）乙方投标资料中已包括适用于变更工程的价格，如果乙方投标资料中没有有适用于变更工程的价格，由甲乙双方共同协商。如果因工程变更或甲方原因影响工期的，按双方协商的时间顺延。The price of project alteration have been included in party Bs bidding documents, where no price which suitable to the alteration in suc

21、h documents, may be on the negotiation by parties hereto, provided that the work period is delayed or effected due to alteration or party As reason, the work period can be postponed by the time agreed upon the agreement of parties.（3）为了保证工程进度，乙方不得以变更签证价款未定为理由，拒绝承担变更工作内容，否则造成的工期延误等一切损失（包括甲方另行委派其他工程公司

22、完成该工作内容发生的费用）均由乙方承担。For assurance of project progress party B can not, by the reason of without Alteration Certification, refuse to assume the altered works, otherwise all loss and damages arising out thereof or connection therewith shall be undertaken by party B including the expenses for which par

23、ty A has to assign other contractor for complete such work.七、付款方式 Payment1、所有合同内的电气工程完工，经验收合格后，一个月内支付总价款的90%；工程竣工验收，并办理完结算后，一个月内支付结算价款的95%。90% payment of total cost shall be effected within one month upon completion of all electrical engineering works hereof and through acceptance; 95% payment of to

24、tal cost shall be effected within one month upon the completion acceptance and process settlement.2、剩余5%的工程款为质保金。质保期为竣工验收后两年，质保期达到一年后支付质保金的50%，在质保期满后的10天内全部付清余款。Remaining 5% payment of project cost is taken as the retention money. The warranty period is two years after completion acceptance. 50% pay

25、ment of the retention money shall be effected after one year of warranty period and the balance of retention money shall be paid off within ten days upon the expiration of warranty period.八、甲方职责 Party As Responsibilities1、负责使施工场具备施工条件，提供一套施工图纸给乙方。Make contracting site to be provided with execution c

26、onditions and make available to party B with a set of construction drawings.2、定期对工程进度、质量、安全文明施工情况进行检查，提出整改意见；及时将设计变更等技术资料交乙方。Make the regular inspection of project progress, quality and safety execution, provide the correct and rectification opinion and make available to party B with the technical d

27、ata of design alteration and so on.九、乙方职责 Party Bs Responsibilities1、严格按照施工图纸和规范要求进行施工。接受工程师监理，以及业主的管理。及时提交进场材料报验、隐蔽工程验收报告、竣工验收报告、检测记录等技术资料。Carry out the execution in strict accordance with construction drawings and specifications, accept engineers supervision and employers management, submit in tim

29、llation engineering.3、乙方负责所承包工程的预决算和工程档案资料，按照工程进度及时提交进度款结算和工程竣工结算等，档案资料及时整理达到归档要求。Archives / data concerned the budget / final and engineering, which are for the project contracted by party B, should pursuant to the progress, be submitted in time for the settlement of progress payment and final paym

Preparation of archives / data should be timely satisfy to the filing requirements.4、如果因乙方未按合同约定完成上述工作，引起的索赔和罚款，应由乙方承担。上述各项工作的费用，均已包含在合同总价款内。Provided that party B fails to complete the works aforementioned in accordance with the contract, party B should undertake the claim and penalt

All various costs of works above have been included in the total price of contract.5、在工程施工的整个过程中，乙方负责施工现场全部人员的安全。除因甲方、工程师的过失而造成伤亡外，甲方不承担乙方或其它人员的伤亡赔偿、补偿。Party B should, during the progress of project, be liable for all personnels safety on the site. None of indemnific

32、ation and compensation for the personnels casualties of party B or others will be undertaken by party A, except due to the fault of party A or engineer.十、质量与验收 Quality and Acceptance1、工程质量应符合国家或专业质量评定标准的合格条件。因乙方原因使工程质量达不到约定的质量标准，乙方必须自费整改，使工程质量达到验收标准为止。Project quality should conform to the qualification standards of States or industry s quality assess, where projec
