§

1303.1Scopeandapplication.

（a）Inthispart1303,theConsumerProductSafetyCommissiondeclaresthatpaintandsimilarsurface-coatingmaterialsforconsumerusethatcontainleadorleadcompoundsandinwhichtheleadcontent（calculatedasleadmetal）isinexcessof0.06percent（0.06percentisreducedto0.009percenteffectiveAugust14,2009asmandatedbyCongressinsection101（f）oftheConsumerProductSafetyImprovementActof2008,Pub.L.110–314）oftheweightofthetotalnonvolatilecontentofthepaintortheweightofthedriedpaintfilm（whichpaintandsimilarsurface-coatingmaterialsarereferredtohereafteras“lead-containingpaint”）arebannedhazardousproductsundersections8and9oftheConsumerProductSafetyAct（CPSA）,15U.S.C.2057,2058.（Seeparts1145.1and1145.2fortheCommission'

sfindingundersection30（d）oftheConsumerProductSafetyAct（CPSA）thatitisinthepublicinteresttoregulatelead-containingpaintandcertainconsumerproductsbearingsuchpaintundertheCPSA.）Thefollowingconsumerproductsarealsodeclaredtobebannedhazardousproducts:

（1）Toysandotherarticlesintendedforusebychildrenthatbear“lead-containingpaint”.

（2）Furniturearticlesforconsumerusethatbear“lead-containingpaint”.

（b）Thisbanappliestotheproductsinthecategoriesdescribedinparagraph（a）ofthissectionthataremanufacturedafterFebruary27,1978,andwhichare“consumerproducts”asthattermisdefinedinsection3（a）

（1）oftheConsumerProductSafetyAct.Accordingly,thoseoftheproductsdescribedabovethatarecustomarilyproducedordistributedforsaletoorforuse,consumption,orenjoymentofconsumersinoraroundahousehold,inschools,inrecreation,orotherwisearecoveredbytheregulation.Paintsandcoatingsformotorvehiclesandboatsarenotincludedwithinthescopeofthebanbecausetheyareoutsidethestatutorydefinitionof“consumerproduct”.Inadditiontothoseproductswhicharesolddirectlytoconsumers,thebanappliestoproductswhichareusedorenjoyedbyconsumersaftersale,suchaspaintsusedinresidences,schools,hospitals,parks,playgrounds,andpublicbuildingsorotherareaswhereconsumerswillhavedirectaccesstothepaintedsurface.

（c）TheCommissionhasissuedthebanbecauseithasfound

（1）thatthereisanunreasonableriskofleadpoisoninginchildrenassociatedwithleadcontentofover0.06percentinpaintsandcoatingstowhichchildrenhaveaccessand

（2）thatnofeasibleconsumerproductsafetystandardundertheCPSAwouldadequatelyprotectthepublicfromthisrisk.

[AMENDMENT:

（c）TheCommissionhasissuedthebanbecauseithasfoundthatthereisanunreasonableriskofleadpoisoninginchildrenassociatedwithleadcontentofover0.06percentinpaintsandcoatingstowhichchildrenhaveaccessandthatnofeasibleconsumerproductsafetystandardundertheCPSAwouldadequatelyprotectthepublicfromthisrisk.The0.06percentisreducedto0.009percenteffectiveAugust14,2009asmandatedbyCongressinsection101（f）oftheConsumerProductSafetyImprovementActof2008,PublicLaw110–314.

（d）Anybanorrulepromulgatedunder16CFR1303.1shallbeconsideredaregulationoftheCommissionpromulgatedunderorfortheenforcementofsection2（q）oftheFederalHazardousSubstancesAct（15U.S.C.1261（q））.]

1303.2Definitions.

（a）Thedefinitionsinsection3oftheConsumerProductSafetyAct（15U.S.C.2052）shallapplytothispart1303.

（b）Forpurposesofthispart:

（1）Paintandothersimilarsurface-coatingmaterialsmeansafluid,semi-fluid,orothermaterial,withorwithoutasuspensionoffinelydividedcoloringmatter,whichchangestoasolidfilmwhenathinlayerisappliedtoametal,wood,stone,paper,leather,cloth,plastic,orothersurface.Thistermdoesnotincludeprintinginksorthosematerialswhichactuallybecomeapartofthesubstrate,suchasthepigmentinaplasticarticle,orthosematerialswhichareactuallybondedtothesubstrate,suchasbyelectroplatingorceramicglazing.

（2）Lead-containingpaintmeanspaintorothersimilarsurfacecoatingmaterialscontainingleadorleadcompoundsandinwhichtheleadcontent（calculatedasleadmetal）isinexcessof0.06percent（0.06percentisreducedto0.009percenteffectiveAugust14,2009）byweightofthetotalnonvolatilecontentofthepaintortheweightofthedriedpaintfilm.

（3）Toysandotherarticlesintendedforusebychildrenmeansthosetoysandotherarticleswhichareintendedtobeentrustedtoorforusebychildren.Thiswouldnotincludeallarticlestowhichchildrenmighthaveaccesssimplybecausetheyarepresentinahousehold.

（4）Furniturearticlemeansthosemovablearticles:

（i）Usedtosupportpeopleorthings;

（ii）otherfunctionalordecorativefurniturearticles,including,butnotlimitedto,productssuchasbeds,bookcases,chairs,chests,tables,dressers,desks,pianos,consoletelevisions,andsofas.Theterm“furniturearticle”doesnotincludeappliances,suchasranges,refrigerators,dishwashers,clotheswashersanddryers,airconditioners,humidifiers,anddehumidifiers;

fixturessuchasbathroomfixtures,built-incabinets,chandeliers,windows,anddoors;

orhouseholditemssuchaswindowshades,venetianblinds,orwallhangingsanddraperies.

1303.3Exemptions.

（a）Thecategoriesofproductslistedinparagraph（b）ofthissectionareexemptedfromthescopeofthebanestablishedbythispart1303,provided:

（1）Thattheseproductsbearonthemainpaneloftheirlabel,inadditiontoanylabelingthatmaybeotherwiserequired,thesignalword“Warning”（unlesssomeothersignalwordisrequired）andthefollowingstatement:

“ContainsLead.DriedFilmofThisPaintMayBeHarmfulIfEatenorChewed.”

（2）（i）Thattheseproductsalsobearontheirlabelthefollowingadditionalstatementoritspracticalequivalent:

Donotapplyontoysandotherchildren'

sarticles,furniture,orinteriorsurfacesofanydwellingorfacilitywhichmaybeoccupiedorusedbychildren.

Donotapplyonexteriorsurfacesofdwellingunits,suchaswindowsills,porches,stairs,orrailings,towhichchildrenmaybecommonlyexposed.

Keepoutofreachofchildren.

（ii）Ifthestatementrequiredbytheprecedingparagraph（a）

（2）（i）isplacedonalabelpanelotherthanthemainpanel,thelabelstatementrequiredtobeonthemainpanelbyparagraph（a）

（1）ofthissectionshallcontainthefollowingadditionalstatement:

“Seeothercautionson_（insert‘side’or‘back’,asappropriate）panel.”

（3）Thattheplacement,conspicuousness,andcontrastofthelabelstatementsrequiredbythissection（a）complywiththerequirementsoftheFederalHazardousSubstancesActat16CFR1500.121.

（b）Thefollowingproductsareexemptfromthescopeofthebanestablishedbythispart1303,providedtheycomplywiththerequirementsofparagraph（a）ofthissection:

（1）Agriculturalandindustrialequipmentrefinishcoatings.

（2）Industrial（andcommercial）buildingandequipmentmaintenancecoatings,includingtrafficandsafetymarkingcoatings.

（3）Graphicartcoatings（i.e.,productsmarketedsolelyforapplicationonbillboards,roadsigns,andsimilarusesandforidentificationmarkinginindustrialbuildings）.

（4）Touchupcoatingsforagriculturalequipment,lawnandgardenequipment,andappliances.

（5）Catalyzedcoatingsmarketedsolelyforuseonradio-controlledmodelpoweredaircraft.

（c）Thefollowingproductsareexemptfromthescopeofthebanestablishedbypart1303（nocautionarylabelingisrequired）:

（1）Mirrorswhicharepartoffurniturearticlestotheextentthattheybearlead-containingbackingpaint.

（2）Artists'

paintsandrelatedmaterials.

（3）Metalfurniturearticles（butnotmetalchildren'

sfurniture）bearingfactory-applied（lead）coatings.

1303.4Bannedhazardousproducts.

Thefollowingconsumerproducts,manufacturedafterFebruary27,1978,unlessexemptedby§

1303.3,arebannedhazardousproducts（seedefinitionsin§

1303.2）:

（a）Paintandothersimilarsurface-coatingmaterialswhichare“lead-containingpaint.”

（b）Toysandotherarticlesintendedforusebychildrenthatbear“lead-containingpaint.”

（c）Furniturearticlesthatbear“lead-containingpaint.”

1303.5Findings.

（a）Thedegreeandnatureoftheriskofinjury.

（1）TheCommissionfindsthattheriskofinjurywhichthisregulationisdesignedtoeliminateorreduceisleadpoisoninginchildren.Theadverseeffectsofthispoisoninginchildrencancausearangeofdisorderssuchashyperactivity,slowedlearningability,withdrawal,blindness,andevendeath.ThefinalEnvironmentalImpactStatementonLeadinPaintwhichisonfilewiththePresident'

sCouncilonEnvironmentalQuality（andavailableforinspectionintheOfficeoftheSecretary）containsinappendixAadetaileddiscussionofthehealtheffectsofleadinpaint.Theseeffectswillonlybesummarizedhere.

（2）Leadisacumulativetoxicheavymetalwhich,inhumans,exerts
