§ 423.1 Definitions.

（a）Carelabelmeansapermanentlabelortag,containingregularcareinformationandinstructions,thatisattachedoraffixedinsuchamannerthatitwillnotbecomeseparatedfromtheproductandwillremainlegibleduringtheusefullifeoftheproduct.
（b）CertainPieceGoodsmeanstextileproductssoldbythepiecefromboltsorrollsforthepurposeofmakinghomesewntextilewearingapparel.Thisincludesremnants,thefibercontentofwhichisknown,thatarecutbyorforaretailerbutdoesnotincludemanufacturers'remnants,uptotenyardslong,thatareclearlyandconspicuouslymarkedpoundgoodsorfabricsofundeterminedorigin（i.e.,fibercontentisnotknownandcannotbeeasilyascertained）andtrim,uptofiveincheswide.
（c）Drycleanmeansacommercialprocessbywhichsoilisremovedfromproductsorspecimensinamachinewhichusesanycommonorganicsolvent（e.g.petroleum,perchlorethylene,fluorocarbon）.Theprocessmayalsoincludeaddingmoisturetothesolvent,upto75%relativehumidity,hottumbledryingupto160degreesF（71degreesC）andrestorationbysteampressorsteam-airfinishing.
（d）MachineWashmeansaprocessbywhichsoilisremovedfromproductsinaspeciallydesignedmachineusingwater,detergentorsoapandagitation.Whennotemperatureisgiven,e.g.,warmorcold,hotwaterupto145degreesF（63degreesC）canberegularlyused.
（e）RegularCaremeanscustomaryandroutinecare,notspotcare.
（f）TextileProductmeansanycommodity,woven,knitorotherwisemadeprimarilyoffiber,yarnorfabricandintendedforsaleorresale,requiringcareandmaintenancetoeffectuateordinaryuseandenjoyment.
（g）TextileWearingApparelmeansanyfinishedgarmentorarticleofclothingmadefromatextileproductthatiscustomarilyusedtocoverorprotectanypartofthebody,includinghosiery,excludingfootwear,gloves,hatsorotherarticlesusedexclusivelytocoverorprotecttheheadorhands.

Thisregulationrequiresmanufacturersandimportersoftextilewearingapparelandcertainpiecegoods,inoraffectingcommerce,as“commerce”isdefinedintheFederalTradeCommissionAct,toprovideregularcareinstructionsatthetimesuchproductsaresoldtopurchasersthroughtheuseofcarelabelsorothermethodsdescribedinthisrule.

Manufacturersandimportersoftextilewearingapparelandcertainpiecegoodsarecoveredbythisregulation.Thisincludesanypersonororganizationthatdirectsorcontrolsthemanufactureorimportationofcoveredproducts.
§ 423.5 Unfairordeceptiveactsorpractices.

（a）Textilewearingapparelandcertainpiecegoods.Inconnectionwiththesale,inoraffectingcommerce,oftextilewearingapparelandcertainpiecegoods,itisanunfairordeceptiveactorpracticeforamanufacturerorimporter:
（1）Tofailtodisclosetoapurchaser,priortosale,instructionswhichprescribearegularcareprocedurenecessaryfortheordinaryuseandenjoymentoftheproduct;
（2）Tofailtowarnapurchaser,priortosale,whentheproductcannotbecleanedbyanycleaningprocedure,withoutbeingharmed;
（3）Tofailtowarnapurchaser,priortosale,whenanypartoftheprescribedregularcareprocedure,whichaconsumerorprofessionalcleanercouldreasonablybeexpectedtouse,wouldharmtheproductorothersbeingcleanedwithit;
（4）Tofailtoprovideregularcareinstructionsandwarnings,exceptastopiecegoods,inaformthatcanbereferredtobytheconsumerthroughouttheusefullifeoftheproduct;
（5）Tofailtopossess,priortosale,areasonablebasisforallregularcareinformationdisclosedtothepurchaser.
（b）Violationsofthisregulation.TheCommissionhasadoptedthisregulationtopreventtheunfairordeceptiveactsorpractices,definedinparagraph（a）ofthissection.Eachmanufacturerorimportercoveredbythisregulationmustcomplywiththerequirementsin§§423.2and423.6through423.8ofthisregulation.Anymanufacturerorimporterwhocomplieswiththerequirementsof§§423.2and423.6through423.8doesnotviolatethisregulation.

§ 423.6 Textilewearingapparel.

Thissectionappliestotextilewearingapparel.
（a）Manufacturersandimportersmustattachcarelabelssothattheycanbeseenoreasilyfoundwhentheproductisofferedforsaletoconsumers.Iftheproductispackaged,displayed,orfoldedsothatcustomerscannotseeoreasilyfindthelabel,thecareinformationmustalsoappearontheoutsideofthepackageoronahangtagfastenedtotheproduct.
（b）Carelabelsmuststatewhatregularcareisneededfortheordinaryuseoftheproduct.Ingeneral,labelsfortextilewearingapparelmusthaveeitherawashinginstructionoradrycleaninginstruction.Ifawashinginstructionisincluded,itmustcomplywiththerequirementssetforthinparagraph（b）
（1）ofthissection.Ifadrycleaninginstructionisincluded,itmustcomplywiththerequirementssetforthinparagraph（b）
（2）ofthissection.Ifeitherwashingordrycleaningcanbeusedontheproduct,thelabelneedhaveonlyoneoftheseinstructions.Iftheproductcannotbecleanedbyanyavailablecleaningmethodwithoutbeingharmed,thelabelmustsostate.[Forexample,ifaproductwouldbeharmedbothbywashingandbydrycleaning,thelabelmightsay“Donotwash—donotdryclean,”or“Cannotbesuccessfullycleaned.”]Theinstructionsforwashinganddrycleaningareasfollows:
（1）Washing,drying,ironing,bleachingandwarninginstructionsmustfollowtheserequirements:
（i）Washing.Thelabelmuststatewhethertheproductshouldbewashedbyhandormachine.Thelabelmustalsostateawatertemperature—intermssuchascold,warm,orhot—thatmaybeused.However,iftheregularuseofhotwaterupto145degreesF（63degreesC）willnotharmtheproduct,thelabelneednotmentionanywatertemperature.[Forexample,Machinewashmeanshot,warmorcoldwatercanbeused.]
（ii）Drying.Thelabelmuststatewhethertheproductshouldbedriedbymachineorbysomeothermethod.Ifmachinedryingiscalledfor,thelabelmustalsostateadryingtemperaturethatmaybeused.However,iftheregularuseofahightemperaturewillnotharmtheproduct,thelabelneednotmentionanydryingtemperature.[Forexample,Tumbledrymeansthatahigh,medium,orlowtemperaturesettingcanbeused.]
（iii）Ironing.Ironingmustbementionedonalabelonlyifitwillbeneededonaregularbasistopreservetheappearanceoftheproduct,orifitisrequiredunderparagraph（b）
（1）（v）ofthissection,Warnings.Ifironingismentioned,thelabelmustalsostateanironingtemperaturethatmaybeused.However,iftheregularuseofahotironwillnotharmtheproduct,thelabelneednotmentionanyironingtemperature.
（iv）Bleaching.（A）Ifallcommerciallyavailablebleachescansafelybeusedonaregularbasis,thelabelneednotmentionbleaching.
（B）Ifallcommerciallyavailablebleacheswouldharmtheproductwhenusedonaregularbasis,thelabelmustsay“Nobleach”or“Donotbleach.”
（C）Ifregularuseofchlorinebleachwouldharmtheproduct,butregularuseofanon-chlorinebleachwouldnot,thelabelmustsay“Onlynon-chlorinebleach,whenneeded.”
（v）Warnings.（A）Ifthereisanypartoftheprescribedwashingprocedurewhichconsumerscanreasonablybeexpectedtousethatwouldharmtheproductorothersbeingwashedwithitinoneormorewashings,thelabelmustcontainawarningtothiseffect.Thewarningmustusewords“Donot,”“No,”“Only,”orsomeotherclearwording.[Forexample,ifashirtisnotcolorfast,itslabelshouldstate“Washwithlikecolors”or“Washseparately.”Ifapairofpantswillbeharmedbyironing,itslabelshouldstate“Donotiron.”]
（B）Warningsarenotnecessaryforanyprocedurethatisanalternativetotheprocedureprescribedonthelabel.[Forexample,ifaninstructionstates“Dryflat,”itisnotnecessarytogivethewarning“Donottumbledry.”]
