1、某公司向香港客户报水果罐头200箱，每箱132.6港元CIF香港，客户要求改报CFR香港含5％佣金价。

假定保险费相当于CIF价的2％，在保持原报价不变的情况下，试求：

（1）CFRC5％香港报价应报多少？

（2）出口200箱应给客户多少佣金？

（3）某公司出口200箱可收回多少外汇？

2、东方公司出口水泥9000公吨，租船合同对装卸条件的规定如下：

（1）连续24小时好天气工作日，节假日除外，如果用了则计算（周六、日为公休日）；

（2）每一工作日装货1500骨朵那，6天装卸完毕，滞期一天罚款6000美元，速遣一天减半；（3）节假日前一天18小时后和节假日后8时前不算入应允许的装卸时间，用了则算；（4）船长递交装货通知书后24小时开始生效。

三、案例分析题。

1、2005年TW进出口公司向PU有限公司出口一批大麻籽。

对方开来信用证有关条款：

“…creditavailablebythebeneficiary’sdraft（s）atsight,paytoTheStandardBank,Ltd.only…”（……由受益人开具的即期汇票，只限付给标准银行……），于9月13日将信用证所要求的单据向议付行交单议付。

9月29日开证行却提出如下单证不符：

我信用证规定：

“…Thebeneficiary’sdraft（s）atsight,paytoTheStandardBank,Ltd.only…”（只限付给标准银行），你方提交的汇票却只是表示：

“paytoTheStandardBank,Ltd.”（付给标准银行），漏“only”,违背了信用证规定。

TW进出口公司对开证行说提的不符点，经研究认为对方是无理挑剔。

于10月4日即做出如下反驳意见：

汇票收款人名称有三种惯例填法，即记名抬头、指示式抬头和来人式抬头。

记名式抬头即直接指定某某人为收款人。

你信用证所规定和我提交的汇票均属于记名式标准银行，有无“only”，其作用没有很大的区别，均以标准银行为该汇票的收款人。

我们认为我汇票的收款人缮制方法已符合你信用证要求，应认为单证一致。

你认为哪方有理？

为什么？

2、我某轻工业进出口公司向某外国客户出口商品一批，合同规定以即期不可撤销信用证为付款方式，信用证的到期地点规定在我国。

为了保证款项的收回，应议付行的要求，我方商请香港某银行对中东某银行（开证行）开立的信用证加以保兑。

在合同规定的开证时间内，我方收到通知银行（即议付行）转来的一张即期不可撤销保兑信用证。

我出口公司在货物装运后，将有关单据交议付行议付。

不久接保兑行通知：

“由于开证行已破产，我行将不承担该信用证的付款责任。

”问：

（1）保兑行的做法是否正确？

为什么？

（2）对此情况，我方应如何处理？

3、东华公司按照CFR条件、即期不可撤销信用证以集装箱装运出口成衣350件，装运条件是CYTOCY。

货物交运后，东华公司取得“清洁已装船提单”，提单上表明：

“Shipper’sloadandcount.”在信用证规定的有效期内，东华公司及时办理了议付结汇手续。

20天后，接对方来函称：

经有关船方、海关、保险公司、公证行会同对到货开箱检验，发现其中有20箱包装严重破损，每箱均有短少，共缺成衣512件。

各有关方均证明集装箱外表完好无损，为此，对方要求东华公司赔偿其货物短缺的损失，并承担全部检验费共2500美元。
