11Testing试验

11.1TestingoftheWorks工程试验

TheContractorshallcarryouttheTestsonCompletionofDesign-BuildinaccordancewiththisClauseandSub-Clause7.4[Testing],afterprovidingthedocumentsinaccordancewithSub-Clause5.5[As-BuiltDocuments]andSub-Clause5.6[OperationandMaintenanceManuals].

TheContractorshallgiveNoticetotheEmployer’sRepresentativenotlessthan21dayspriortothedateafterwhichtheContractorwillbereadytocarryouteachoftheTestsonCompletionofDesign-Build.Unlessotherwiseagreed,TestsonCompletionofDesign-Buildshallbecarriedoutwithin14daysafterthisdate,onsuchdayordaysastheEmployer’sRepresentativeshallinstruct.

UnlessotherwisestatedintheParticularConditions,theTestsonCompletionofDesign-BuildshallbecarriedoutinthefollowingsequenceandarefurtherdetailedintheEmployer’sRequirements:

承包商在根据FIDIC金皮书5.5（竣工文件）和FIDIC金皮书5.6（操作和维修手册）所述提交文件后，应根据本款和FIDIC金皮书7.4（试验）进行设计建造竣工试验。

承包商应提前21天将某一确定日期通知业主代表，说明在该日期后他将准备好进行每一项设计建造竣工试验。

除非另有商定，此类试验应在该日期后14天内于业主代表指示的某日或数日内进行。

除非专用条件中另有规定，竣工试验应按下述程序以及业主要求中规定的详细细节进行：

（a）   pre-commissiopningtests,whichshallincludetheappropriateinspectionsand（“dry”or“cold”）functionalteststodemonstratethateachitemofPlantcansafelyundertakethenextstage,（b）;

预试运行检验，其中包括适当的检查和（干或冷）功能性检验，以证明每一项生产设备都能安全地进入下一阶段（b）;

（b）   Commissioningtests,whichshallincludethespecifiedoperationalteststodemonstratethattheWorksorSectioncanbeoperatedsafelyandasspecified,underallavailableoperatingconditions;and

试运行试验，其中包括规定的操作检验，以证明工程和单位工程能安全运行，并能根据规定在一切可获得的运行条件下运行；以及

（c）   Trialoperation,whichshalldemonstratethattheWorksorSectionperformreliablyandinaccordancewiththeContract.

TheEmployershallbethesolebeneficiaryofanyrevenueorbenefitresultingfromtheTestsonCompletionofDesign-Build.

Duringtrialoperation,whentheWorksareoperatingunderstableconditions,theContractorshallgiveNoticetotheEmployer’sRepresentativethattheWorksarereadyforanyotherTestsonCompletionofDesign-Build,includingperformanceteststodemonstratewhethertheWorksconformwithcriteriaspecifiedintheEmployer’sRequirementsandwiththeSchedulesofGuarantees.

TrialoperationshallnotconstituteacommencementoftheOperationServiceunderSub-Clause10.2[CommencementofOperationService].

InconsideringtheresultsoftheTestsonCompletionofDesign-Build,theEmployer’sRepresentativeshallmakeallowancesfortheeffectofantuseoftheWorksbytheEmployerontheperformanceorothercharacteristicsoftheWorks.AssoonastheWorks,oraSection,havepassedeachoftheTestsonCompletionofDesign-BuilddescribedinSub-paragraph（a）,（b）or（c）above,theContractorshallsubmitareportcertifiedbytheContractoroftheresultsoftheseTeststotheEmployer’sRepresentative.

除非专用条件中另有规定，试运营期间，工程生产的任何产品应归业主所有。

在试运营过程中，当工程是在稳定条件下运行时，承包商应通知业主代表，工程已经准备就绪，可以进行任何其它的设计建造竣工试验，包括性能测试?

，以证明工程是否符合业主要求中规定的标准，并符合保证资料表。

试运营并不构成FIDIC金皮书10.2（运营服务的开始）中规定的运营服务开始。

在考虑设计建造竣工试验结果时，业主代表应考虑到因业主对工程的任何使用而对工程的性能或其他特性所产生的影响。

一旦工程或某一单位工程通过了（a）,（b）或（c）段中所述的每一设计建造竣工试验，承包商应向业主代表提交一份有关此类试验结果的证明报告。

11.2DelayedTestsonCompletionofDesign-Build      设计建造竣工试验的延误

IftheTestsonCompletionofDesign-BuildarebeingundulydelayedbytheEmployer,Sub-Clause7.4[Testing]（fifthparagraph）shallbeapplicable.

IftheTestsonCompletionofDesign-BuildarebeingundulydelayedbytheContractor,theEmployer’sRepresentativemaybyNoticerequiretheContractortocarryoutsuchTestswithin21daysafterreceivingtheNotice.TheContractorshallcarryoutsuchTestsonthedayordayswithinthatperiodastheContractormayfixandofwhichheshallgiveNoticetotheEmployer’sRepresnetative.

IftheContractorfailstocarryouttheTestsonCompletionofDesign-Buildwithintheperiodof21days,theEmployer’sPersonnelmayproceedwiththeTestsattheriskandcostoftheContractor.TheTestsonCompletionshallthenbedeemedtohavebeencarriedoutinthepresenceoftheContractorandtheresultsoftheTestsshallbeacceptedasaccurate.

如果业主无故延误设计建造竣工试验时，则FIDIC金皮书7.4（试验）（第五段）将适用。

如果承包商无故延误设计建造竣工试验，业主代表可通知承包商，要求他在收到该通知后21天内进行此类试验。

承包商应在该期限内他可能确定的某日或数日内进行检验，并将此日期通知业主代表。

若承包商未能在21天的期限内进行竣工检验，业主的人员可着手进行此类检验，其风险和费用均由承包商承担。

此类竣工试验应被视为是在承包商在场的情况下进行的，且试验结果应被认为是准确的。

11.3RetestingoftheWorks   工程重新试验

IftheWorks,oraSection,failtopasstheTestsonCompletionofDesign-Build,Sub-Clause7.5[Rejection]shallapply,andtheEmployer’sRepresentativeortheContractormayrequirethefailedTests,andTestsonCompletionofDesign-Buildonanyrelatedwork,toberepeatedunderthesametermsandconditions.

如果工程或某一单位工程未能通过设计建造竣工试验，则FIDIC金皮书7.5（拒收）将适用，且业主代表或承包商可要求按相同条款或条件，重新进行此类未通过的试验以及对任何相关工作的设计建造竣工试验。

11.4FailuretoPassTestsonCompletionofDesign-Build    未能通过设计建造竣工试验

IftheWorks,oraSection,failtopasstheTestsonCompletionofDesign-BuildrepeatedunderSub-Clause11.3[RejectionoftheWorks],theEmployer’sRepresentativeshallbeentitledto:

（a）   OrderfurtherrepetitionofTestsonCompletionofDesign-BuildunderSub-Clause11.3[RetestingoftheWorks];or

（b）   IssueaNoticeunderSub-Clause15.1[NoticetoCorrect].

如果工程或某一单位工程未能通过根据FIDIC金皮书11.3（工程重新试验）所进行的重复设计建造竣工试验时，则业主代表应有权：

（a）指示根据FIDIC金皮书11.3（工程重新试验）再进行一次重复的设计建造竣工试验；

（b）根据FIDIC金皮书15.1（通知改正）签发通知。

11.5CompletionoftheWorksandSection工程和单位工程的竣工

ExceptasstatedinSub-Clause11.11[failuretoPassTestsPriortoContractCompletion],theWorksshallbedeemedbytheEmployertobecompletedwhen:

除了FIDIC金皮书11.11（未能通过合同完成前试验）情况外，当下列情况时工程被视同完成：

（a）   TheworkshavebeencompletedinaccordancewiththeContract,includingthemannersdescribedinSub-Clause9.2[TimeforCompletionofDesign-Build]andSub-Clause5.6[OperationandMaintenanceManuals]andexceptasallowedinsub-paragraph（i）below;and

工程根据合同已竣工，包括FIDIC金皮书9.2（设计建造的竣工时间）和FIDIC金皮书5.6（操作和维修手册）中所述事宜，但下面（i）段所述情况除外，以及

（b）   ACommissioningCertificatehasbeenissued,orisdeemedtohavebeenissued,inaccordancewiththisSub-Clause.

TheContractormayapplybyNoticetotheEmployer’sRepresentativeforaCommissioningCertificatenotearlierthan14daysbeforetheWorkswill,intheContractor’sopinion,becompleteandreadyforcommencementoftheOperationServicePeriod.IftheWorksaredividedintosections,theContractormaysimilarlyapplyforaCommissioningCertificateforeachSection.

根据本款规定试运行证书已经签发或者被视为签发。

承包商可在他认为工程将完工并准备运营服务开始前14天内，向业主代表发出申请试运行证书的通知。

如果工程分为单位工程，则承包商应同样为每一单位工程申请试运行证书。

业主代表在收到承包商的申请后28天内，应

TheEmployer’sRepresentativeshall,within28daysafterreceivingtheContractor’sapplication:

（i）    IssuetheCommissioningCertificatetotheContractor,statingthedateonwhichtheWorksorSectionwerecompletedinaccordancewiththeContract,exceptforanyminoroutstandingworkanddefectswhichwillnotsubstantiallyaffecttheuseoftheWorksorSectionfortheirintendedpurposes（listingsuchoutstandingworkanddefectswhicharetoberemedied）;or

（ii）   Rejecttheapplication,givingreasonsandspecifyingtheworkrequiredtobedonebytheContractortoenabletheCommissioningCertificatetobeissued.

TheContractorshallthencompletetheworkreferredtoinsub-paragraph（ii）abovebeforeissuingafurtherNoticeunderthisSub-Clause.

IftheEmployer’sRepresentativeeitherfailstoissuetheCommissioningCertificateorrejectthe  Contractor’sapplicationwithintheperiodof28days,andiftheWorksorSection（asthecasemaybe）aresubstantiallyinaccordancewiththeContract,theCommissioningCertificateshallbedeemedtohavebeenissuedonthelastdayofthatperiod.

（i）向承包商颁发试运行证书，说明根据合同工程或单位工程完工的日期，但某些不会实质影响工程或单位工程按其预定目的使用的少量扫尾工作以及缺陷除外（列明此类扫尾工作及应修复的缺陷）；或

（ii）驳回申请，说明理由及为使试运行证书得以颁发承包商尚需完成的工作。

随后承包商应在根据上述（ii）段发出进一步通知前，完成此类工作。

若在28天期限内业主代表既未颁发试运行证书也未驳回承包商的申请，而当工程或单位工程（视情况而定）实质性符合合同要求时，应认为在上述期限内的最后一天已经颁发了试运行证书。

11.6CommissioningofPartsoftheWorks部分工程的试运行

TheEmployer’sRepresentativemay,attherequestoftheContractor,issueaSectionCommissioningCertificateforanypartofthePermanentWorks.

IfaSectionCommissioningCertificatehasbeenissuedforapartoftheWorks,thedelaydamagesthereafterforcompletionoftheremainderoftheWorksshallbereduced.Similarly,thedelaydamagesfortheremainderoftheSection（ifany）inwhichthispartisincludedshallalsobereduced.ForanyperiodofdelayafterthedatestatedinthisSectionCommissioningCertificate,theproportionalreductioninthesedelaydamagesshallbecalculatedastheproportionwhichthevalueofthepartsocertifiedbearstothevalueoftheWorksorSection（asthecasemaybe）asawhole.TheEmployer’sRepresentativeshallproceedinaccordancewithSub-Clause3.5[Determinations]toagreeordeterminetheseproportions.TheprovisionsofthisparagraphshallonlyapplytothedailyrateofdelaydamagesunderSub-Clause9.6[DelayDamagesrelatingtoDesign-Build],andshallnotaffectthemaximumamountofthesedamages（ifany）.

业主代表可以在承包商的要求下签发永久工程任何部分的单位工程试运行证书。

若对工程的某一部分颁发了单位工程试运行证书，则对于完成工程的剩余部分的误期损害赔偿费应减少。

同样，包含该部分的单位工程（如有时）的剩余部分的误期损害赔偿费也应减少。

对于该单位工程试运行证书注明的日期之后的任何拖延期间，误期损害赔偿费减少的比例应按已签发部分的价值相对于整个工程或单位工程（视情况而定）的总价值的比例计算。

业主代表应根据FIDIC金皮书3.5（确定），对此比例商定或做出决定。

本段规定仅适用于FIDIC金皮书9.6（设计建造的误期损害赔偿费）规定的误期损害赔偿费的日费率，但并不对其最大限额构成影响。

11.7CommissioningCertificate      试运行证书

PerformanceoftheContractor’sDesign-Buildobligations,includingcareoftheWorks,shallnotbeconsideredtohavebeencompleteduntiltheCommissioningCertificatehasbeensignedbytheEmployer’sReprese
