2、ance with Sub-Clause 5.5As-Built Documents and Sub-Clause 5.6Operation and Maintenance Manuals.The Contractor shall give Notice to the Employers Representative not less than 21 days prior to the date after which the Contractor will be ready to carry out each of the Tests on Completion of Design-Buil

Unless otherwise agreed, Tests on Completion of Design-Build shall be carried out within 14 days after this date, on such day or days as the Employers Representative shall instruct.Unless otherwise stated in the Particular Conditions, the Tests on Completion of Design-Build shall be carried out i

7、nce with the Contract.试运营,以证明工程和单位工程能可靠地并使用并符合合同规定。The Employer shall be the sole beneficiary of any revenue or benefit resulting from the Tests on Completion of Design-Build.During trial operation, when the Works are operating under stable conditions, the Contractor shall give Notice to the Employe
8、rs Representative that the Works are ready for any other Tests on Completion of Design-Build, including performance tests to demonstrate whether the Works conform with criteria specified in the Employers Requirements and with the Schedules of Guarantees.Trial operation shall not constitute a commenc
9、ement of the Operation Service under Sub-Clause 10.2 Commencement of Operation Service.In considering the results of the Tests on Completion of Design-Build, the Employers Representative shall make allowances for the effect of ant use of the Works by the Employer on the performance or other characte
10、ristics of the Works. As soon as the Works, or a Section, have passed each of the Tests on Completion of Design-Build described in Sub-paragraph (a), (b) or (c) above, the Contractor shall submit a report certified by the Contractor of the results of these Tests to the Employers Representative.除非专用条

12、ests on Completion of Design-Build设计建造竣工试验的延误If the Tests on Completion of Design-Build are being unduly delayed by the Employer, Sub-Clause 7.4 Testing(fifth paragraph) shall be applicable.If the Tests on Completion of Design-Build are being unduly delayed by the Contractor, the Employers Represent
13、ative may by Notice require the Contractor to carry out such Tests within 21 days after receiving the Notice. The Contractor shall carry out such Tests on the day or days within that period as the Contractor may fix and of which he shall give Notice to the Employers Represnetative.If the Contractor
14、fails to carry out the Tests on Completion of Design-Build within the period of 21 days, the Employers Personnel may proceed with the Tests at the risk and cost of the Contractor. The Tests on Completion shall then be deemed to have been carried out in the presence of the Contractor and the results

16、he Works, or a Section, fail to pass the Tests on Completion of Design-Build, Sub-Clause 7.5 Rejection shall apply, and the Employers Representative or the Contractor may require the failed Tests, and Tests on Completion of Design-Build on any related work, to be repeated under the same terms and co
17、nditions.如果工程或某一单位工程未能通过设计建造竣工试验,则FIDIC金皮书7.5(拒收)将适用,且业主代表或承包商可要求按相同条款或条件,重新进行此类未通过的试验以及对任何相关工作的设计建造竣工试验。11.4Failure to Pass Tests on Completion of Design-Build未能通过设计建造竣工试验If the Works, or a Section, fail to pass the Tests on Completion of Design-Build repeated under Sub-Clause 11.3Rejection of the
18、Works, the Employers Representative shall be entitled to:(a)Order further repetition of Tests on Completion of Design-Build under Sub-Clause 11.3 Retesting of the Works; or(b)Issue a Notice under Sub-Clause 15.1Notice to Correct.如果工程或某一单位工程未能通过根据FIDIC金皮书11.3(工程重新试验)所进行的重复设计建造竣工试验时,则业主代表应有权:(a)指示根据FI
19、DIC金皮书11.3(工程重新试验)再进行一次重复的设计建造竣工试验;(b)根据FIDIC金皮书15.1(通知改正)签发通知。11.5 Completion of the Works and Section工程和单位工程的竣工Except as stated in Sub-Clause 11.11failure to Pass Tests Prior to Contract Completion, the Works shall be deemed by the Employer to be completed when:除了FIDIC金皮书11.11(未能通过合同完成前试验)情况外,当下列情

24、, except for any minor outstanding work and defects which will not substantially affect the use of the Works or Section for their intended purposes (listing such outstanding work and defects which are to be remedied); or(ii)Reject the application, giving reasons and specifying the work required to b
25、e done by the Contractor to enable the Commissioning Certificate to be issued.The Contractor shall then complete the work referred to in sub-paragraph (ii) above before issuing a further Notice under this Sub-Clause.If the Employers Representative either fails to issue the Commissioning Certificate
26、or reject theContractors application within the period of 28 days, and if the Works or Section (as the case may be) are substantially in accordance with the Contract, the Commissioning Certificate shall be deemed to have been issued on the last day of that period.(i)向承包商颁发试运行证书,说明根据合同工程或单位工程完工的日期,但某

28、st of the Contractor, issue a Section Commissioning Certificate for any part of the Permanent Works.If a Section Commissioning Certificate has been issued for a part of the Works, the delay damages thereafter for completion of the remainder of the Works shall be reduced. Similarly, the delay damages
29、 for the remainder of the Section (if any) in which this part is included shall also be reduced. For any period of delay after the date stated in this Section Commissioning Certificate, the proportional reduction in these delay damages shall be calculated as the proportion which the value of the par
30、t so certified bears to the value of the Works or Section (as the case may be) as a whole. The Employers Representative shall proceed in accordance with Sub-Clause 3.5Determinations to agree or determine these proportions. The provisions of this paragraph shall only apply to the daily rate of delay
