CHAPTERONEGENERALPROVISIONS
Article1ThelawhasbeenformulatedaccordingtotheConstitutionwithaviewtoprotectingthelegitimaterightsandinterestsofworkers,regulatinglabourrelations,establishingandsafeguardingalaboursystemthatisadaptabletoasocialistmarketeconomyandpromotingeconomicdevelopmentandsocialprogress.
Article2Thelawappliestoallenterprises,individualeconomicorganizations(hereinafterreferredtoas"employers")andworkersboundupbycontractuallabourrelationship.
Thelawisalsoapplicabletogovernmentorgans,institutions,socialorganizationsandworkersboundupbylabourcontracts.
Article3Workersenjoytherightstoequalopportunitiesofemploymentandchoiceofjobs,therighttolabourremuneration,therighttorestandvacation,therighttolaboursafetyandhealthprotection,therighttovocationaltraining,therighttosocialinsuranceprotectionandwelfare,therighttosettlementoflabourdisputesandotherrightsasprovidedbylaw.
Workersshouldfulfiljobassignments,improvetheirskills,followlaboursafetyandhealthregulations,observelabourdisciplineandprofessionalethics.
Article4Employersshallestablishandimprovetheirrulesandregulationsaccordingtolawandensurethattheworkersenjoytheirrightsandperformtheirobligations.
Article5TheStateshalladoptallpossiblemeasurestopromoteemployment,developvocationaleducation,formulatelabourstandards,regulatesocialincome,improvesocialinsurance,coordinatelabourrelationsandgraduallyimprovethelivingstandardsoftheworkers.
Article6TheStateencouragestheworkerstoparticipateinsocialvoluntarylabour,engageinlabouremulationandputforwardrationalizationproposals,encouragesandprotectsworkersintheirscientificresearch,technicalinnovationandinventionandcommandsandrewardsmodelworkersandadvancedworkers.
Article7Workershavetherighttojoininandorganizetradeunionsaccordingtolaw.
Thetradeunionsrepresentandprotectthelegitimaterightsandinterestsoftheworkersandcarryouttheiractivitiesindependentlyaccordingtolaw.
Article8Workersshall,accordingtolegalprovisionsandthroughworkers'congresses,workers'representativesorotherchannels,participateindemocraticmanagementorcarryoutconsultationonanequalfootingwiththeiremployersconcerningtheprotectionoftheirownlegitimaterightsandinterests.
Article9ThelabouradministrativedepartmentoftheStateCouncilisresponsibleforlabourworkinthewholecountry.
Thelabouradministrativedepartmentsofthelocalpeople'sgovernmentsabovethecountylevelareresponsibleforlabourworkwithintheiradministrativeregions.
CHAPTERTWOPROMOTIONOFEMPLOYMENT
Article10TheStateshallcreateemploymentconditionsandexpandemploymentopportunitiesbywayofpromotingeconomicandsocialdevelopment.
TheStateencouragesenterprises,institutionalorganizationsandpeople'sorganizationstorunindustriesoropenupmoreavenuesforoperationtoincreaseemploymentopportunitieswithintheframeworkofthelawsandadministrativedecrees.
TheStatesupportstheworkerstoorganizethemselves,voluntarilyforbusinessoperationsorgoinforindividualbusinessestoincreaseemployment.
Article11Thepeople'sgovernmentsatalllevelsshouldadoptmeasurestodevelopallkindsoflabourexchangestoprovideemploymentservices.
Article12Withregardtoemployment,theworkersshallnotbediscriminatedinaspectsofnationality,race,sexandreligiousbeliefs.
Article13Womenenjoytheequalrightsofemploymentasmen.Inprovidingemployment,itisnotallowedtorefuseemploymentofwomenonsexgroundsorraisetheemploymentstandardsforwomen,exceptwhenthejobsorworkpostsarenotsuitableforwomenasprovidedforbytheState.
Article14Iftherearespecialprovisionsinotherlawsorregulationsconcerningtheemploymentofhandicappedpeople,peopleofminoritynationalitiesandsoldiersquittingactiveservice,thoseprovisionsshallapply.
Article15Itisforbiddenforemployerstoemploypersonsundertheageofsixteen.
Wheneveranunitincultureandarts,sportsandspecialartsandcraftsneedstoemployyoungpersonsundertheageofsixteen,examinationandapprovalprocedures-shallbeundertakenaccordingtorelevantregulationsoftheStateandtheemployeesthereofshouldbeensuredtherightofreceivingcompulsoryeducation.
CHAPTERTHREELABOURCONTRACTANDCOLLECTIVECONTRACT
Article16Alabourcontractisanagreementthatdefinesthelabourrelationsbetweenworkersandemployersaswellastherightsandobligationsofthetwoparties.
Inestablishinglabourrelations,labourcontractsshallbeconcluded.
Article17Theconclusionandrevisionoflabourcontractsshallobservetheprincipleofequality,voluntarinessandunanimitythroughconsultation.Itshallnotviolatetheprovisionsofthelawsoradministrativedecrees.
Alabourcontractconcludedaccordingtolawislegallybindingandpartiestothecontractareobligedtoperformtheirobligationsprovidedforinthelabourcontract.
Article18Thefollowinglabourcontractsareinvalid:
1.Contractsthathaveviolatedtheprovisionsofthelaworadministrativedecrees;
2.Contractsthathavebeenconcludedbydeceptionorcoercion.
Invalidlabourcontractsarenotlegallybindingfromthemomenttheyareconcluded.Wheneverapartofalabourcontracthasbeenaffirmedinvalid,theremainingpartsofitshallstillbevalidiftheinvalidpartdoesnotaffecttheeffectofthem.
Theinvalidityofalabourcontractshallbedeterminedbythelabourdisputearbitrationcommitteeorthepeople'scourt.
Article19Alabourcontractshallbeconcludedinawrittenformandshallcontainthefollowingprovisions:
1.Termofthelabourcontract;
2.Specificjobrequirements;
3.Labourprotectionandworkingconditions;
4.Remuneration;
5.Labourdiscipline;
6.Conditionsforterminatingthelabourcontract;
7.Responsibilitiesforviolatingthelabourcontract.
Apartfromtheseprovisionsthatmustbeincludedinalabourcontractasprovidedforintheprecedingparagraph,thepartiesconcernedmayaddotherprovisionsuponagreementthroughconsultation.
Article20Thetermofacontractmaybefixedornon-fixedorfixedintermsofacertainamountofworkdone.
Whenextensionofalabourcontractunderagreementofbothpartiesafteraworkerhasworkedforanuninterruptedtermoftenyearsoroverforasameemployer,alabourcontractwithoutafixedtermmaybeconcludediftheworkersodesires.
Article21Alabourcontractmaysetupatermoftrialexecutionbutthemaximumlengthshallnotexceedsixmonths.
Article22Provisionsmaybelaiddownuponagreementofbothpartiesinalabourcontractintermsofkeepingcommercialsecretsoftheemployer.
Article23Alabourcontractshallbeterminatedwheneverthetermprovidedforinthecontractexpiresorconditionsforterminatingthecontractagreeduponhaveappeared.
Article24Alabourcontractmaybedissolveduponagreementofpartiesconcernedthroughconsultation.
Article25Anemployermaydissolvealabourcontractifoneofthefollowingcasesoccurs:
1.Aworkerisprovedtobenotuptotheemploymentstandardswithintheperiodoftrialuse[probation];
2.Aworkerhasseriouslyviolatedlabourdisciplineortherulesandregulationshavingbeenlaiddownbytheemployer.
3.Aworkerhascommittedseriousderelictionofdutyorresortedtodeceptionforpersonalgainsandcausedseriouslossestotheinterestsoftheemployer.
4.Aworkerhasbeenaffixedwithcriminalresponsibility.
Article26Inoneofthefollowingcases,anemployermaydissolvealabourcontractbutshallserveawrittennoticetotheworkerinperson30daysinadvance:
1.Aworker,afteratreatmentofdiseaseornon-jobinjuries,isunabletodothejobarrangedbytheemployer.
2.Aworkerisnotcompetentforthejobassignedtohimandstillfallsshortofthestandardsevenafterbeingtrainedorgivenotherjobs.
3.Alabourcontractcannolongerbeexecutedduetomajorchangesintheobjectiveconditionsandarevisioncannotbereachedthroughconsultationbybothparties.
Article27Whenanemployerneedstocutemploymentduetotheconditionsofnearbankruptcyandinaperiodoflegalrectificationorduetodifficultiesinitsproductionorbusinessoperation,thetradeunionoralltheworkersshouldbeinformedofthetruesituationwiththeiropinionsheardandconveyedbytheemployertothelabouradministrationdepartment.
Ifanemployerthathascuttheemploymentaccordingtotheprovisionsofthisarticlerecruitsworkersagainwithinsixmonths,priorityshallbegiventotheemployeesbeingformerlycut.
Article28WheneveraterminationoflabourcontractsaccordingtotheprovisionsofArticle24,Article26,andArticle27ofthislaw,theemployershouldgivenacertaineconomiccompensationtothe
