农产品进口配额暂行管理办法

TheInterimMeasuresfortheAdministrationofImportTariffQuotasofAgriculturalProducts，whichhavebeenformulatedinaccordancewiththeForeignTradeLawofthePeople’sRepublicofChina，theCustomsLawofthePeople’sRepublicofChina，theRegulationsofthePeople’sRepublicofChinaontheAdministrationofImportandExportofGoodsandtheRegulationsofthePeople’sRepublicofChinaonImportandExportDutiesandinconsultationwiththeCustomsGeneralAdministration，areherebypromulgated.

   ThelistofagenciesauthorizedbytheMinistryofCommerceandtheStateDevelopmentandReformCommissionfortheadministrationofimporttariffquotasofagriculturalproductswillbepromulgatedseparately.

   ChapterIGeneralProvisions

   Article1Withaviewtoeffectivelyimplementingtheadministrationofimporttariffquotasofagriculturalproductsandtoestablishingthesystemforadministeringtheimporttariffquotasofagriculturalproductsthatisuniform，fair，just，transparent，predicableandnondiscriminatory，thepresentMeasureshavebeenformulatedinaccordancewiththeForeignTradeLawofthePeople’sRepublicofChina，theCustomsLawofthePeople’sRepublicofChina，theRegulationsofthePeople’sRepublicofChinaontheAdministrationofImportandExportofGoodsandtheRegulationsofthePeople’sRepublicofChinaonImportandExportDuties.

   Article2WithintheyearoftheGregoriancalendar，theStatewill，pursuanttothequotaquantitiesaspromisedinChina’sscheduleofconcessionandcommitmentsforthetradeofgoodsafterentryintotheWTO，determinetheannualquantitiesoftheagriculturalproductssubjecttotheadministrationofimporttariffquotaspermittedtoenterthemarket.

   Theimportofagriculturalproductswithinthequotaquantitieswillapplythein-quotataxrate，andtheimportofagriculturalproductsoutsidethequotaquantitieswillbeimplementedundertherelevantprovisionsoftheRegulationsofthePeople’sRepublicofChinaonImportandExportDuties.

   TheexcesspartofbulkcargosshallbeimplementedpursuanttoParagraph2ofArticle19inthepresentMeasures.

   Article3Thecategoriesofagriculturalgoodssubjecttotheadministrationofimporttariffquotasare：

wheat（includingpowderandgrainsthereof；hereinafterreferredtoaswheat），corn（includingpowderandgrainsthereof；hereinafterreferredtoascorn），rice（includingpowderandgrainsthereof；hereinafterreferredtoasrice），beanoil，colzaoil，palmoil，sugar，cotton，woolandwooltops.

   Thecorrespondingimporttaxitems，tariffserialnumbersandapplicabletaxratesforagriculturalgoodssubjecttotheadministrationofimporttariffquotasshallbepromulgatedseparately.

   Article4Wheat，corn，rice，beanoil，colzaoil，palmoil，sugarandcottonshallbesubjecttostate-runtradequotasornon-state-runtradequotas.Thosesubjecttostate-runtradequotasshallbeimportedbystate-runtradeenterprises；thosesubjecttonon-state-runtradequotasmaybeimportedbyenterpriseswiththerightoftrade，andmayalsobeimporteddirectlybythefinaluserswiththerightoftrade.

   Woolandwooltopsshallbesubjecttothemanagementofdesignatedimportenterprises，whichshallbecarriedoutinaccordancewiththeMeasuresfortheAdministrationofDesignatedManagementofGoodsImport（No.21oftheMinistryofForeignTradeandEconomicCooperation）promulgatedbytheformerMinistryofForeignTradeandEconomicCooperation.

   Article5Importtariffquotasofagriculturalproductsshallbeglobalquotas.

   Article6ImportofagriculturalgoodsinalltradeformsthatconformtoArticle3shallbeincludedintherangeoftariffquotaadministration.

   Article7Theimporttariffquotasofbeanoil，colzaoil，palmoil，sugar，woolandwooltopsshallbesubjecttothedistributionoftheMinistryofCommerce.

   Theimporttariffquotasofwheat，corn，riceandcottonshallbesubjecttothedistributionoftheStateDevelopmentandReformCommission（SDRC）inconjunctionwiththeMinistryofCommerce（MOFCOM）。

   Article8TheMOFCOMandtheSDRCwillentrusttheirrespectivelyauthorizedagenciestohandlethefollowingmatters：

   1）AcceptingtheapplicationsandtransferringthemtotheMOFCOMandtheSDRC；

   2）AcceptingtheconsultationsandtransferringthemtotheMOFCOMandtheSDRC；

   3）Notifyingtheapplicantsofanyinsufficiencyintheirapplications，andofferingchancesfortheapplicantstoeliminatesuchinsufficiency；

   4）IssuingtheCertificatesofImportTariffQuotasofAgriculturalProductstotheapplicantsapproved.

   Article9TheCertificatesofImportTariffQuotasofAgriculturalProductsareapplicabletotheimportsinthetradeformsofgeneraltrade，processingtrade，bartertrade，small-scalebordertrade，assistance，donationandotherforms.

   Theproductsenteringthebondedwarehouses，bondedzonesandexportprocessingzonesareexemptedfortheCertificatesofImportTariffQuotasofAgriculturalProducts.

   ChapterIIApplication

   Article10TheperiodforapplyingfortheimporttariffquotasofagriculturalgoodsshallbebetweenOct.15thandOct.30thofeachyear（withtheexceptionofthedistributionformofdrawingthequotasbycomingorderonthebasisofcontract）。

TheMOFCOMandtheSDRCwillpromulgatethenextyear’stotalquantityofimporttariffquotasofeachagriculturalgoodsandthespecificconditionsfortheapplicationthereforeaswellasthetariffserialnumbersandapplicabletaxratesdeterminedbytheCustomsTariffCommitteeoftheStateCouncilontheInternationalBusinessDaily，theChinaEconomicHerald，theMOFCOMwebsite（）andtheSDRCwebsite（）onemonthbeforetheapplicationperiod.

   Beanoil，colzaoil，palmoil，sugar，woolandwooltopsshallbesubjecttothepromulgationofMOFCOM；andwheat，corn，riceandcottonshallbesubjecttothepromulgationofSDRC.

   Article11TheagenciesauthorizedbyMOFCOMareinchargeoftheapplicationsfortheimporttariffquotasofbeanoil，colzaoil，palmoil，sugar，woolandwooltopswithintheirrespectiveareas.

   TheagenciesauthorizedbySDRCareinchargeoftheapplicationsfortheimporttariffquotasofwheat，corn，riceandcottonwithintheirrespectiveareas.

   Article12TheagenciesauthorizedbyMOFCOMshall，inlightofthespecificconditionspromulgated，accepttheapplicationsonbeanoil，colzaoil，palmoil，sugar，wool，wooltopsandtherelevantdocumentssubmitted，andtransferthequalifiedapplicationstotheMOFCOMbeforeNov.30th（withtheexceptionofthedistributionformofdrawingthequotasbycomingorderonthebasisofcontract），withthecopiesthereofsentsimultaneouslytotheSDRC.

   TheagenciesauthorizedbySDRCshall，inlightofthespecificconditionspromulgated，accepttheapplicationsonwheat，corn，rice，cottonandtherelevantdocumentssubmitted，andtransferthequalifiedapplicationstotheSDRCbeforeNov.30th，withthecopiesthereofsentsimultaneouslytotheMOFCOM.

   ChapterIIIDistribution

   Article13Importtariffquotasshallbedistributedonthebasisofthequantityappliedforbytheapplicants，theirpreviousimportperformance，productioncapacityandotherrelevantcommercialstandardsoronthebasisoftheformofdrawingbycomingorder.Theminimumquantityofdistributionshallbedeterminedonthebasisofthecommerciallyfeasibleshippingquantityofeachcategoryofagriculturalproducts.

   Article14TheMOFCOMandtheSDRCwill，beforeJan.1stofeachyear，issuetothefinaluserstheCertificatesofImportTariffQuotasofAgriculturalProductsviatheirrespectivelyauthorizedagencies，towhichthe“SpecialSealoftheMOFCOMforCertificateofImportTariffQuotasofAgriculturalProducts”andthe“SpecialSealoftheSDRCforCertificateofImportTariffQuotasofAgriculturalProducts”shallbeaffixed.

   Thequotasforstate-runtradeshallbeindicatedontheCertificateofImportTariffQuotasofAgriculturalProducts.

   ChapterIVValidTerm

   Article15TheannualimporttariffquotasofagriculturalgoodsshallbeimplementedfromJan.1stofeachyear，andshallbevalidwithintheyearoftheGregoriancalendar.TheCertificatesofImportTariffQuotasforAgriculturalProductsshallbevalidfromJan.1sttoDec.31stofitscurrentyear.

   ThevalidtermoftheCertificatesofImportTariffQuotasforAgriculturalProductssubjecttothedistributionformofdrawingbycomingorderonthebasisofcontractshallbecarriedoutinaccordancewiththedetailedimplementationrulespromulgated.

   Article16FortheagriculturalproductssubjecttoimporttariffquotasthatareshippedoutfromthedepartingportbeforeDec.31stoftheyearandshallarriveatthedestinationinthenextyear，thefinalusershall，bypresentingtheCertificateofImportTariffQuotasofAgriculturalProductsandtherelevantcertifications，applyfortermextensiontotheoriginalagencythathasissuedthecertificate.Thesaidagencymayextendthetermafterhavingexaminedthecase，butthetermmaynotbeextendedtoatimelaterthantheendofFebruaryofthenextyear.

   ChapterVImplementation

   Article17Thefinalusersshall，pursuanttotherelevantprovisionsoftheStateonimportofthecommoditiesconcerned，signtheimportcontractsbythemselvesorentrustotherstosignthecontracts.
