DefinitionsandInterpretation

Definitions

1.1IntheContract（ashereinafterdefined）thefollowingwordsandexpressionsshallhavethemeaningsherebyassignedtothem,exceptwherethecontextotherwiserequires:

（a）（i）“Employer”meansthepersonnamedassuchinPartIIoftheseConditionsandthelegalsuccessorsintitletosuchperson,butnot（exceptwiththeconsentoftheContractor）anyassigneeofsuchperson.

（ii）“Contractor”meansthepersonwhosetenderhasbeenacceptedbytheEmployerandthelegalsuccessorsintitletosuchperson,butnot（exceptwiththeconsentoftheEmployer）anyassigneeofsuchperson.

（iii）“Subcontractor”meansanypersonnamedintheContractasaSubcontractorforapartoftheWorksoranypersontowhomapartoftheWorkshasbeensubcontractedwiththeconsentoftheEngineerandthelegalsuccessorsintitletosuchperson,butnotanyassigneeofanysuchperson.

（iv）“Engineer”meansthepersonappointedbytheEmployertoactasEngineerforthepurposesoftheContractandnamedassuchinPartIIoftheseConditions.

（v）“Engineer’sRepresentative”meansapersonappointedfromtimetotimebytheEngineerunderSubClause2.2.

（b）（i）“Contract”meanstheseConditions（PartsIandII）,theSpecification,theDrawings,theBillofQuantities,theTender,theLetterofAcceptance,theContractAgreement（ifcompleted）andsuchfurtherdocumentsa
