LEGALISSUES,MANAGINGDIVERSITY,ANDCAREERCHALLENGES

 

Thischapterfocusesonhowtrainingcontributestoacompany’ssocialresponsibilitythroughpartnershipswithunions,communitycolleges,andothereducationalinstitutions.Also,sociallyresponsiblecompaniestakestepstomanagediversityandhelpemployeesworkeffectivelyindifferentcultures,aswellaspreparingemployeestocopewithcareerchallengeslikebalancingwork-life,copingwithcareerbreaks,recyclingtheircareers,dealingwithjobloss,andpreparingforretirement.

Thechapterhighlightssomecurrentissuesinthetraininganddevelopmentarena.Thisisanimportantbodyofinformationforthestudenttakinganoverviewcourseintraininganddevelopment.Firstthechaptercoverssectorpartnerships,school-to-workprograms,andjointunion-managementprograms.Italsoincludeslegalissues,whereitiscriticaltoknowthemajorpiecesoflegislation,includingtheCivilRightsAct(1964,1991),theAgeDiscriminationinEmploymentAct(ADEA),andtheAmericanswithDisabilitiesAct(ADA),andthemajorrequirementstheydefineforemployers.Further,thecategoriesoflegallydangeroussituations,e.g.,anemployeebeinginjuredduringatrainingactivity,aredescribed.Next,thechapteraddressesthemanagementofadiverseworkforceandthecharacteristicsofsuccessfuldiversityinitiatives.Thisisinvaluableinformationintoday’sglobalculture.Thereafter,cross-culturalpreparationisaddressed,bringingtolightthevarioustypesofexpatriates;dimensionsofculturaldifferences;stepsinthepreparation,includingthepredeparturephase,theon-sitephase,andtherepatriationphase.Thechapteralsotalksaboutwork-lifebalancepractices,dualcareerpathsystem,andfinallyconcludeswithearlyretirementprograms.

I.Introduction

A.Traininganddevelopmentshouldhelpcompaniesachievetheirbusinessgoals,resultinginprofitsandpositivereturnstostockholders.

B.Companieshaveasocialresponsibilitytohelpimprovethecommunitieswheretheyarelocatedbyprotectingtheenvironment,supportingculturalactivities,andhelpingtoreducepovertyandunemployment.

C.TheWorkforceInvestmentActof1998createdacomprehensiveworkforceinvestmentsystem.Thereformedsystemisintendedtobecustomer-focused,helpAmericansmanagetheircareersthroughinformationandhigh-qualityservices,andhelpU.S.companiesfindskilledworkers.ThecornerstoneofthesystemisOne-Stopservicedelivery,whichunifiesnumeroustraining,education,andemploymentprogramsintoasingle,customerfriendlysystemineachcommunity.

ALifelongLearningAccount(LiLA)referstoanaccountforadulteducationintowhichboththeemployeeandthecompanycontributeandtheemployeekeeps—evenifheorsheleavesthecompany.ThemoneyintheLiLAcanbeusedtopayforarangeofeducationalexpenses,includingtuition,books,fees,supplies,andnon-job-specificcertificationcourses.
