meansthecostoftreatmentandservices,asprovidedinthepolicyapprovedbythecommissioner,byalicensedandaccreditedacutecarefacilitywhichengagesprimarilyinprovidingdiagnosis,treatmentandcareofsickandinjuredpersonsonaninpatientoroutpatientbasis;
thecostofcoveredtreatmentandservicesprovidedbyanextendedcarefacilitywhichprovidesroomandboardandskillednursingcare24hoursadayandwhichisrecognizedbytheadministratorsofthefederalMedicareprogramasanextendedcarefacility;
andthecostofcoveredservicesatanambulatorysurgicalfacilitysupervisedbyaphysicianlicensedinthisStateorinanotherjurisdictionandrecognizedbytheCommissionerofHealthandSeniorServices,oranyotherfacilitylicensed,certifiedorrecognizedbytheCommissionerofHealthandSeniorServicesortheCommissionerofHumanServicesoranationallyrecognizedsystemsuchastheCommissiononAccreditationofRehabilitationFacilities,orbyanotherjurisdictioninwhichitislocated.

meansreasonableandnecessaryexpensesfortreatmentorservicesasprovidedbythepolicy,includingmedical,surgical,rehabilitativeanddiagnosticservicesandhospitalexpenses,providedbyahealthcareproviderlicensedorcertifiedbytheStateorbyanotherstateornation,andreasonableandnecessaryexpensesforambulanceservicesorothertransportation,medicationandotherservicesasmaybeprovidedfor,andsubjecttosuchlimitationsasprovidedfor,inthepolicy,asapprovedbytheCommissioner."

(2)isthemostappropriatestandardorlevelofservicewhichisinaccordancewithstandardsofgoodpracticeandstandardprofessionaltreatmentprotocols,assuchprotocolsmayberecognizedordesignatedbytheCommissionerofBankingandInsurance,inconsultationwiththeCommissionerofHealthandSeniorServicesorwithaprofessionallicensingorcertifyingboardintheDivisionofConsumerAffairsintheDepartmentofLawandPublicSafety,orbyanationallyrecognizedprofessionalorganization,and
(3)doesnotinvolveunnecessarydiagnostictesting.

COMMENT
Thissectionissubstantiallyidenticaltotheoriginal,butthedefinedtermshavebeenlistedinalphabeticalorder.
I-2.Compulsoryinsurancecoveragelimits
a.Exceptasprovidedby39:
6A-3.1,everyownerofanautomobileregisteredorprincipallygaragedinthisStateshallmaintainautomobileliabilityinsurancecoverage,underprovisionsapprovedbytheCommissionerofBankingandInsurance,insuringagainstlossresultingfromliabilityimposedbylawforbodilyinjury,deathandpropertydamagesustainedbyanypersonarisingoutoftheownership,maintenance,operationoruseofanautomobile.Suchcoverageshallbeatleastinanamountorlimit:
(1)Of$15,000,exclusiveofinterestandcosts,onaccountofinjuryto,ordeathof,oneperson,inanyoneaccident;
(2)Subjecttosuchlimitforanyonepersonsoinjuredorkilled,of$30,000,exclusiveofinterestandcosts,onaccountofinjurytoordeathof,morethanoneperson,inanyoneaccident;
and
(3)Of$5,000,exclusiveofinterestandcosts,fordamagetopropertyinanyoneaccident.
b.Allautomobileinsurancepoliciesissuedorrenewedshallincludeatleastthecoveragerequiredpursuantto39:
6A-4unlessthenamedinsuredelectsabasicautomobileinsurancepolicypursuantto39:
6A-3.1oraspecialautomobileinsurancepolicypursuantto39:
6A-3.3.Electionofabasicorspecialautomobileinsurancepolicyshallbeinwritingandsignedbythenamedinsuredonthecoverageselectionformrequiredby39:
6A-23.Thecoverageselectionformshallcontainastatement,clearlyreadableandin12-pointboldtype,inaformapprovedbytheCommissioner,that:
(1)Electionofabasicautomobileinsurancepolicywillresultinlesscoveragethanthe$250,000medicalexpensebenefitscoveragemandatedpriorto39:
6A-1.1etal.orthatelectionofaspecialautomobileinsurancepolicywillresultincoverageonlyforemergencycare;
and
(2)Electionofaspecialautomobileinsurancepolicy,orabasicautomobileinsurancepolicywithouttheoptional$10,000liabilitycoverageprovidedforin39:
6A-3.1maysubjectthenamedinsuredtoaclaimorjudgmentfornoneconomiclosswhichisnotcoveredbytheinsurancepolicy,andwhichmayplacetheinsured’sassetsatrisk,andintheeventtheinsuredissued,theinsurershallnotprovidelegalcounsel.
c.Theinsurancecoverageprovidedforin39:
6A-3.1shallbeofferedbyeveryinsurerwhichwritesinsurancecoveragepursuantto39:
6A-4foraperiodoffiveyearsbeginningMay19,1998.TheCommissionershallrequireeverycompanywritingsuchinsurancecoveragetoreportannuallyduringthatfive-yearperiodastothenumberofpolicieswrittenpursuanttothissubsectioninthepreviousyear,thenumberofpolicieswiththecoverageofferedpursuantto39:
6A-4convertedtopolicieswiththecoverageofferedpursuantto39:
6A-3.1andanyotherinformationtheCommissionermayrequireincludingtheageofthepolicyholdersandtheterritoriesinwhichthepolicyholdersreside.TheCommissionershallreporttotheGovernorandtheLegislatureregardingtheacceptanceofthebasicautomobileinsurancepolicybytheautomobileinsuranceconsumersofthisStateannuallyforthefirstfouryearsthebasicpolicyissold.Onorbef
