1.Whatcompositewoodproductsfallundertheairbornetoxiccontrolmeasure（ATCM）?

TheATCMappliestoallhardwoodplywood（HWPW）,particleboard（PB）,andmediumdensityfiberboard（MDF）,includingthinMDF（≤8mm）,andfinishedgoodsthatcontaintheseproducts,thataresold,offeredforsale,supplied,used,ormanufacturedforsaleinCalifornia.

2.WhatspecificproductsarenotcoveredbytheATCM?

MaterialsthatarenotcoveredbytheATCMinclude,butarenotlimitedtohardboard,naturalwood,andcertifiedstructuralplywood,certifiedstructuralpanels,structuralcompositelumber,orientedstrandboard,gluelaminatedtimber,prefabricatedwoodI-joist,fingerjointedlumber,or“compositewoodproducts”usedinsideofnewvehicles,railcars,boats,aerospacecraftoraircraft（pleasealsorefertoquestion#23）. 

3.Whatareexamplesoffinishedgoods?

Finishedgoodsmeananygoodorproductotherthanapanel,containingHWPW,PB,andMDF. 

Finishedgoodsinclude,butarenotlimitedtofurniture,cabinets,shelving,countertops,flooring,moldings,caskets,baseboards,rosettes,corbels,etc.

4.WhodoestheATCMapplyto?

TheATCMappliestomanufacturers,distributors,importers,fabricators,andretailersoftheproductsdescribedinquestion1,aswellasthirdpartycertifiersofmanufacturers.

5.DoestheATCMapplytoblockboard?

No,blockboardisnotcoveredbytheATCMsinceitisnotincludedinthedefinitionofHWPW.

6.DoestheATCMapplytomoldedpalletblocks?

MoldedpalletblocksthataremadeinindividualmoldsandmadespecificallyasmoldedpalletcomponentsareexemptfortheATCM. 

Ifinagivenmanufacturingprocessnoflatpanelsaremadeorused,andiftheresultingmoldedpalletblockproductshaveaveryspecificpurpose,thenmoldedpalletblockproductswouldnotbesubjecttotheATCM.

Wouldtoiletseatsbesubjecttotheregulation?

Iftheproducts（toiletseats）arecompressionmolded,meaningthatflatpanelproducts（suchasmediumdensityfiberboard,particleboard,orhardwoodplywood）arenotusedmanufacturingtheseproducts,thentheproductisexemptfromtheregulation. 

Sometoiletseatsaremadebyacut-outorrouteredmethod;

theseparticularproductsderivefromaflatcompositewoodproductpanel,whichissubjecttotheregulation. 

Ifproductsaremadebybendingaflatpanel,thenthefabricatedtoiletseatwouldbesubjecttotheregulationandwouldneedtobemadewithcompliantmaterials.

IfacompanythatproducesmoldedtoiletseatswantstohavetheirproducttestedbyaCARB-approvedthirdpartycertifier（TPC）forformaldehydeemissions,shouldtheseproductsbelabeledtoletconsumersknowthattheproductiscompliant?

ForcompaniesthathavetheirproductstestedbyaCARB-approvedTPC,thephrase“lowformaldehydemoldedproduct”canbeusedonthelabel. 

Thisindicatesthattestingbyacertifiedentitywasperformedtodemonstratethattheproductislow-emittingandthatitisamoldedproductwhichisnotsubjecttotheregulation.TheseproductsshouldnotbelabeledasCARBcompliantandtheyshouldnotincludeastatementofCARBcomplianceontheirlabelbecausetheyarenotsubjecttotheregulation.

8.Arechairbacksandseatsmadebymoldingwoodflourandresinintothedesiredshapeconsideredparticleboardanddotheyrequireemissiontesting?

No,suchproductswouldnotbeconsideredtobeacompositewoodproductundertheATCM. 

Ifproductsaremadetobecomponentpartsorfinishedproducts,andarenotmadeintheformofflatpanel,theyarenotsubjecttotheregulation.

9.DoestheATCMapplytolowdensityfiberboard（LDF）orhighdensityfiberboard（HDF）?

TheATCMappliestoLDF,MDF,andHDF. 

TheANSIstandardforMDF,A208.2-2002,isbasedonperformanceandisindependentofdensity. 

10.Theregulationisapplicabletohardwoodplywood. 

However,whatiftheplywoodisnothardwoodbutasoftwoodlikespruce?

Isitthenexempt?

IfsoftwoodisusedinmakingHWPWthatmeetsthedefinitionofHWPW（ANSI/HPVAHP-1-2004）,thenitissubjecttotheATCM.
