Article1ThepresentLawisformulatedaccordingtotheConstitutionforthepurposeofregulatingtheadministrationofcivilservants,ensuringthelegitimaterightsandinterestsofcivilservants,strengtheningthesupervisionofcivilservants,formahigh-qualitytroopofcivilservantssoastopromoteadiligentandhonestgovernmentandenhancetheworkingefficiency.

Article2Theterm"

civilservants"

asmentionedinthepresentLawreferstothosepersonnelwhoperformpublicdutiesaccordingtolawandhavebeenincludedintothestateadministrativestaffingandwhosewagesandwelfarearebornebythestatepublicfinance.

Article3Theobligations,rightsandadministrationofcivilservantsshallbegovernedbythepresentLaw.

Wheretherearedifferentprovisionsontheappointment,dismissalandsupervisionofleadingmembersofcivilservantsandontheobligations,rightsandadministrationofjudgesandprosecutingattorneys,suchprovisionsshallbeobserved.

Article4TheguidanceofMarxism,Leninism,MaoZedongThoughtandDengXiaopingTheoryandtheimportantthoughtof"

ThreeRepresents"

shallbepersistedinthecivilservantsystem.ThebasicrouteofthepreliminarystageofsocialismandthecadreroutesaswellastheguidelinesoftheChineseCommunistParty（CPC）shallbecarriedoutinthecivilservantsystem.TheprinciplethattheCPCassumestheadministrationofcadresshallbeinsisted.

Article5Theprincipleofopenness,equality,competitionandselectingthesuperioronesshallbeheldintheadministrationofcivilservants,whichshallbecarryoutaccordingtothelegalpowerlimits,qualifications,standardsandprocedures.

Article6Theprincipleofpayingequalattentiontosupervisoryrestrictionandincentiveguarantyshallbeheldintheadministrationofcivilservants.

Article7Theprincipleofmakingappointmentonmeritandhavingbothpoliticalintegrityandprofessionalcompetenceshallbeheldintheappointmentofcivilservantswhereimportanceshallbeattachedtopracticalachievementsofwork.

Article8Thestateadoptsaclassifiedadministrationoncivilservantssoastoenhancetheadministrativeefficiencyandlevelofscientificadministration.

Article9Anyactofacivilservanttoperformhisdutyaccordingtolawshallbeprotectedbylaw.

Article10Thecentraladministrativedepartmentofcivilservantsshalltakechargeofthecomprehensiveadministrationofcivilservants.Thelocaladministrativedepartmentsofcivilservantsabovethecountylevelshalltakechargeofthecomprehensiveadministrationofcivilservantswithinthejurisdictionaldivisionsthereof.Theadministrativedepartmentofcivilservantsatahigherlevelshallguidetheadministrationofcivilservantsascarriedoutbyitscounterpartatalowerlevel.Theadministrativedepartmentofcivilservantsatalllevelsshallguidetheadministrationofcivilservantsofallorgansatthesamelevel.

ChapterIIQualifications,ObligationsandRightsofACivilServant

Article11Acivilservantshallmeetthefollowingrequirements:

（1）Havingthenationalityofthepeople'

sRepublicofChina;

（2）Reachingthefullageof18;

（3）UpholdingtheConstitutionofthepeople'

（4）Havinggoodethics;

（5）Beinginaproperhealthstatetoperformhisfunctionsanddutiesnormally;

（6）Havingtheeducationallevelandworkingcapacityasrequiredbythepost;

and

（7）Anyotherrequirementasprescribedbylaw.

Article12Acivilservantshallperformthefollowingobligations:

（1）PlayinganexemplaryroleinobservingtheConstitutionandthelaw;

（2）Earnestlyperforminghisfunctionsanddutiesaccording
