根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《上海市劳动合同条例》以及有关法律、法规和政策，甲方和乙方（以下各自称“各方”，共同称“双方”）遵循平等自愿、协商一致的原则，签订本劳动合同，以确立劳动关系，明确双方的权利和义务，并共同遵守。

第一条劳动合同期限

Article1LabourContractTimePeriod

1.1本合同期限类型为期限劳动合同。

第二条工作岗位、工作职责

Article2WorkPositionandDuty

2.1甲方安排乙方到___________部门，担任________职位,乙方必须按甲方确定的职务说明书的工作内容，按时、按质、按量完成甲方分配的工作（生产）任务；

2.2甲方根据生产经营的需要以及依据乙方的能力（专业、技能、健康）和工作表现，可在协商一致的基础上调整或重新分配乙方的工作职位，如乙方同意被分派到一个不同的职位，则甲方有权根据该职位的要求和该职位的市场情况重新审定和调整乙方的报酬。

2.2AccordingtotheneedsofproductionandmanagementofPartyA,andaccordingtotheability（specialty,skill,health）

andworkperformanceofPartyB,PartyAcanadjusttheworkingpositionofPartyB,orreassignPartyBtootherpositions

onaconsensualbasis.IfPartyBagreestobeassignedtoadifferentposition,PartyA,accordingtothedutiesofthisposition

andmarketconditions,hastherighttoauthorizeandadjusttheremunerationofPartyB.

第三条工作时间

Article3WorkingTime

3.1甲方实行每周正常的工作时间40小时（用餐、休息时间除外），特殊岗位需实行不定时工作制或综合计时制的，双方将另行签订《补充协议》。

3.1PartyAwillimplementanordinaryworkweekof40hours（excludingmealsandrestperiods）.Forspecialpositionsthat

requireanindefiniteperiodoftimeoracertainaccumulatedamountoftime,bothsideswillsignaseparatesupplementary

agreement.

3.2甲方因工作需要，如需延长工作时间的，应按国家有关规定执行。

3.2Duetotheneedsofwork,PartyAshallcomplywithallrelevantstateregulationsincarryingoutanextensionofthe

workperiod.

3.3甲方应按国家有关规定支付乙方加班费。

3.3PartyAshallpayPartyBovertimeaccordingtothepertinentregulationsofthestate.

第四条劳动保护和劳动条件

Article4LabourProtectionandWorkingConditions

4.1甲方应按《中华人民共和国劳动法》规定，必须为乙方提供符合国家规定、安全卫生的工作环境，保证乙方在人身安全及人体不受危害的环境条件下工作；

甲方根据乙方的岗位实际情况，按照国家及甲方的规定向乙方提供必要的劳动防护用品。

4.1PartyAshall,accordingtoTheLabourLawofthePeople'

sRepublicofChina,conformtothestateregulationsin

providingforPartyBasafeandhealthyworkingenvironment,andguaranteesthatPartyBworksunderconditionswhere

personalsecurityandthehumanbodyarenotendangered;

accordingtotheworkingconditionsofPartyB,andaccordingto

theregulationsoftheStateandPartyA,PartyAshallprovidetoPartyBanynecessaryprotectivearticles.

4.2甲方负责对乙方进行职业道德、业务技术、劳动安全卫生及各种规章制度的教育和培训。

包括但不限于《人事手册》在内的甲方各类的培训材料及培训内容均可作为对乙方工作表现的考核标准

4.2PartyAisresponsibleforcarryingouteducationandtrainingregardingprofessionalethics,businesstechnology,labour

safetyandhygieneandothervariousregulations.PartyB'

sworkperformancewillbeassessedaccordingtoPartyA'

svarious

trainingsandrelatedmaterialsincluding,butnotlimitedto,thePersonnelManual.

第五条劳动报酬

Article5LabourRemuneration

5.1乙方的税前工资为每月人民币______元，试用期税前工资每月人民币_______元。

乙方的奖金、津贴由甲方按国家规定支付。

5.2甲方遇生产（工作）不景气时，支付乙方的收入不低于本市规定的最低工资标准。

5.3甲方按本公司规定的工资形式和考核办法确定乙方的劳动所得，甲方按月支付乙方工资，乙方必须按国家规定缴纳个人所得税，月薪制工资发放时间为每月____日，并以银行卡转帐的方式向乙方支付。
