[Abstract]studieshaveshownthatconflictistheessentialcharacteristicoflaborrelations,andthewaytoachieveaharmoniouslaborrelationsistobalancethebodyrightthroughthecollectivewayofadjustment,withtheco-operationtoresolveconflictsandcontradictions.Conflictiscreatedbythemarketeconomyofproductionandpossessionofdegreelaborfordifferentpurposes,andtheresultingdifferencesininterestsofthedecision.whilethebenefits,rights,institutionalimbalancewillcausetheintensificationoftheconflict,whilethebalanceistoachievethemainwayofharmoniouslaborrelations,collectivebalanceadjustmentisaneffectivemeansofTherefore,policiesandlawsshouldalsobesubjecttobalancetherightsandprocess-oriented,focusingoncollectivelaborrelations.

Since2006theSixthPlenarySessionoftheSixteenthCPCCentralCommittee,thedevelopmentofharmoniouslaborrelationsarealsowrittentobuildingasocialistharmonioussocietyrequirements.Communityontheharmoniouslaborrelationsandsafeguardthelegitimaterightsandinterestsofworkersvoicesgrowing,theNationalFederationofTradeUnionsalsoinInthesameyearpresentedaharmoniouslaborrelationscompanystandards. 

However,inrecentyears,increasinglabordisputes,especiallysincethesummerof2010people,collectivelabordisputes"andSpray"brokeout,showingaharmoniouslaborrelationspropagandaandrealitycoexistinsharpcontradictionbetweenlaborandthestatusofthestudyshowthattheconflicttheessentialcharacteristicsoflaborrelations,conflictandconcealdenyconflictcanonlycauseaccumulationandintensificationofcontradictions,butcannotachieveaharmoniouslaborrelations. 

Aconflictoftheessentialcharacteristicsoflaborrelations. 

Laborrelationsisnotonlyanimportantpartofsocialrelations,socialrelationsalsoaffectothersignificantfactors. Whetheritsdefinedrange,thegenerationanddevelopmentprocess,aswellastheexperienceofdevelopedmarketeconomiespointofview,theconflicthasbeenassociatedwithlaborrelationsrun,andledtoavarietyofrelatedpolicyandlegalformation.Broadlyspeaking,laborrelationsreferstotheindustrializedproductionofsocialcontext,workersandlabororganizationsfortherealizationoftheuseraswellasthelaborprocessposedbythesocialrelations.¨.Suchsocialrelationsintheproductionprocessatthebeginningandcontinuationofacommongoal,tolabororganizationsasthecore,istheowneroftheinteractionbetweenfactorsofproduction. 

Conflictuallaborrelationsastheessentialcharacteristichasbeenwidelyrecognizedbyscholars,whetheritisfromtheperspectiveofpluralism,suchaslaborrelationswillbeconsideredaworkadjustment,[21Productionofsocialregulation,[31efficiency,equityandvoicedevelopment,[41orfromaMarxistpointofview,suchasclassconflict,¨1socialmovements,¨1¨1againstsuchstructuralpointofview.Althoughtheydifferonthesolutiontotheconflict,butaconflictofinterestasarethebasiccharacteristicsoflaborrelationsandregulationobjects.Broadlyspeaking,laborrelationsinmodernsocietyisthebasisoftheemploymentrelationship,therightsandobligationsprescribedbylawfortheactsoftheframework,policyandinstitutionalbackground,thesubjectoflaborrelationsintheworkplacebytheexpansionoftherangeofsocialrelationshipdevelopmentofcapitalistproductionfromtheperspectiveoflaborrelationsintheprocessoftheemergenceanddevelopmentofdifferentsocialstatusbetweenthemainmeansofproductionandpossessionofdifferentdegrees,determinetheirdifferentneedsofthelaborprocess,whichbeproducedconflictinglaborrelationsonthebasisofobjectiveandsubjective.

Whentheowneroftheassetsinthemarket,findingandorganizingworkersintothefactorystartedproduction,andproductionworkers,afterlosingtotheirownlaborforreward,whenattachedtothelaboroncapitalShen1Inthisenvironment,theproductiontheexpansionnolongeratthecoreofskilledworkers,butinthecapitaloftheprimaryconditionsfortheproductionofactiveworkersnotdirectlyexchangegoods,buttheproductionofcapitalintheirorganizationusinglaborworkerstoachievecapitalappreciationpurposes. 

Intheprocessofproductionoutofthepersonaldataoftheownertocarryoutproductionintheformandsetupthebusinessthewayforemployersbyprovidingjobopportunitiesinthelabormarketlookingtoaccepthisproposedpriceoflaborworkers,whileindividualsunderstandtheirtechnology,basedontheabilitytofindasuitablepaidwork.Whenemployersandworkersinacertainenvironmentandinformationsupplyundertheconditionsofacceptanceofeachothertoreachinordertoachievetheproductiontargetoftheagreement.Remunerationoflaborandexchangeinthisprocess,thetwosidesdecidedtoexchangetheforceisdifferent,becausethecontroloftheemployerThiscorecapitalandobviousfactorsofproductionhavemorediscretion,employeescandecidetoselllabortocapitalinthecaseofapartyisinaweakpositionin20thcenturyAmerica,lowwages,longworkinghours,unemploymentandotherlaborissues,isduetoexcessivelaborsupply,labormarketfailureasaresultofindividualnegotiationswithemployerstheadvantagesofstrengthandstatuscaused.f90employersandworkersinthelaborrelationsfactoinequalityisalsoreflectedinthelegalsenseofthelaborcontract.Ontheonehand,fromalaborlawperspective,withalaborcontract-basedlaborrelationsis"formalequalityconcealtheactualinequality,"theworkertheemployerisasubordinaterelationship,ratherthanthepropertyofanequalrelationshipwiththepeoplewho[oneisthenatureofthisrelationshipiscalledthecapitalofthesubsidiarylabor,laborrelationsthisunequalrelationshipisanobjectivebasisforgeneratingconflictontheotherhand,sincethedestructionofthecontractandbringlossestobothsidesofthedifferentlevelsofworkersinthemarketinevitablewithemployersatadisadvantageinthegame,whenproductioncannotexpand,theemployeristhelossofpartofthecapitalincreaseinvalue,whiletheworkershavelostsourcesofincomecannotbesocialreproductionandevensurvival. 

So,inordertoconcludealaborcontractasasymbolofaseriesofactivitiesthatwillbringlaborrelationswithintheenterprisebythemarket,inordertoachieveobjectofthecontract. 

Workerswereaskedtoaccepttheauthorityoftheemployer'scontrolofproductioninthehumanbodysubordinatetotheowner. Thisbroughtbytheeconomicfoundationofinequalityofrightsofinequality.Employersandmanagersthroughdifferentmanagementmethods,rulesandregulations,legalregulationsonemployeebehaviorandobligationtomakeprovisions,andforcingworkerstocomply,whichitselfisthepowerofcastingprocess.Similarly,workersarenotdefenseless,throughindividualandcollectivestrengthwillimposepressureonemployerstonegotiate,negotiation,industrialactionapproach,reflectingontherightsandinterestsandthefight,andwhenoneorbothimplementationoftheoutcomeofthenegotiationshaveconcludedobjectiontore-condition,conflictorcollectivedisputetheinevitable.

Laborrelationsanddevelopmentisthecoreoflabor,whichisthemostfundamentalformofproduction. Marxlaborisdefinedas:

humanandnaturallyoccurringprocessthatispeoplethroughtheirownactions,mediation,regulateandcontroltheirmetabolismwithnatureroleintheprocess.[luwhichconscious,purposefultransformationoftheworldisthehumanlaborandanimalinstinctsmostfundamentaldifference,soinamarketeconomythelaborrelationsofproductionoccupiesanobjectivedeterminethestatusofemployersandworkerstopursuedifferentlaborpurposes,whenboththeobjectivepursuedirreconcilable,theconflictwillnaturallyoccur. 

Thisisbecausethelaborrelationsisaspecialexchangerelationshipdifferentfromordinarycommodityexchange,laborcannotbecompletelyseparatedfromitsowner,whichisboundtotheuseoflaborwhointroducedtheinitiative.ProfitsandmarketvaluegrowthistheemployerTheultimategoal,whichisalsothecapitalexpansionandgreedynatureofthedecision.[l2Jinanindustrialsociety,wageincomeisthebasisofpersonallifeonlybecauseofmarketcompetitioninthecaseofafixedtotalrevenueworkerswageincreasemeansreducedprofitsandinvestment,thisfundamentaleconomicinterestsirreconcilablecontradictions,whilelaborandremunerationinestablishingexchangerelations,aspromisedexchangecarrierlaborcontractdoesnotcompletelydefinetherights,responsibilityandbehavior,fromtheestablishmentofbilateralrelationsthereisuncertainty.
