Article1Inordertostrengthenthesupervisionandadministrationofproductionsafety,topreventandreducetheaccidents,toguaranteethepeople’slifeandpropertysafety,andtopromotetheeconomicdevelopment,thislawisherebyenacted.

Article2ThisLawshallapplytotheproductionsafetyinvolvingtheunitsengagedinproductionoperationswithintheterritoryofthePeople’sRepublicofChina（hereinafterreferredtoasthe“productionoperationunits”）.Therelevantlawsandadministrativeregulationsconcerningfireprotectionsafety,roadtrafficsafety,railwaytrafficsafety,marinetrafficsafetyandcivilaviationsafetyshallalsoapplyifavailable.

Article3Theadministrationofproductionsafetyshallcomplywiththeguidelineof“safetyandprecautionfirst.”

Article4ProductionoperationunitsshallabidebythisLaw,otherlawsandadministrativeregulationsonproductionsafety,strengthenthecontroloverproductionsafety,establishandperfectliabilitysystemofproductionsafety,improvesafetyconditions,andensureproductionsafety.

Article5Thepersonnelchieflyinchargeofproductionoperationunitsshalltakeoverallresponsibilityfortheirownproductionsafety.

Article6Theemployeesofproductionoperationunitsshallobtaintherightofguaranteeingtheproductionsafety,andmeanwhilefulfilltheobligationsasregardsproductionsafetyaccordingtolaw.

Article7TheLaborUnionshallcallontheemployeestoparticipateindemocraticmanagementandsupervisiontosafeguardthelawfulrightsandinterestsinthematterofproductionsafety.

Article8TheStateCouncilandlocalpeople’sgovernmentsatalllevelsshallstrengthentheguidanceofproductionsafetywork,supportandoverseealltherelevantdepartmentstofulfilltheirresponsibilityforsafetycontrolandsupervisionaccordingtolaw.

Article9TheStateCouncildepartmentinchargeofthecontrolandsupervisionofproductionsafetyshallcarryouttheoverallsupervisionandadministrationofproductionsafetythroughoutthenationaccordingtolaw;thedepartmentsofthepeople’slocalgovernmentsatandabovethecountylevelinchargeofthecontrolandsupervisionofproductionsafetyshallaccordingtolawcarryouttheoverallsupervisionandadministrationofproductionsafetywithintheiradministrativedivisions.

AccordingtothisLawandtheprovisionsofotherlawsandadministrativeregulations,thedepartmentsconcernedintheStateCouncilshallcontrolandoverseetheproductionsafetywithintheirownresponsibilityrange;thedepartmentsconcernedinthelocalpeople’sgovernmentsabovethecountylevelshallcontrolandoverseetheproductionsafetywithintheirindividualresponsibilityrangeinaccordancewiththisLawandtheprovisionsofotherlawsandadministrativeregulations.

Article10TheStateCouncildepartmentsconcernedshallaccordingtolawconstituteforthwithnationalstandardsortradestandardsbasedontherequirementsofproductionsafetyguaranties,andmaketimelyrevisionsinthelightoftechnologicalandeconomicdevelopment.

Productionoperationunitsshallcarryoutthenationalstandardsortradestandardsguaranteeingproductionsafetyestablishedaccordingtolaw.

Article11Thepeople’sgovernmentsatalllevelsandtherelevantdepartmentsshalladoptvariousmeanstostrengthenthelawsandprovisionsconcerningproductionsafetyandwidenthepublicityofproductionsafetyknowledge,andimprovetheemployees’awarenessofproductionsafety.

Article12Theintermediaryorgansestablishedaccordingtolaw,shall,entrustedbytheproductionoperationunits,supplytechnologicalservicesforproductionsafetyworkinaccordancewiththelaws,administrativeregulationsandlicenseguidelines.

Article13TheStatecarriesoutlegalliabilityfortheaccidentsandtrackdownthelegalliabilityofthepersonnelblamingfortheaccidentsinaccordancewiththisLawandotherrelevantlawsandprovisions.

Article14TheStateencouragesandsupportsthescientificandtechnologicalresearchonproductionsafetyandthepopularizationanddisseminationofadvancedtechnologysoastoimprovetheproductionsafety.

Article15TheStaterewardsthoseunitsandindividualswhomakeremarkableachievementsinmattersofimprovingproductionsafetyconditions,preventingaccidents,andgoinginforriskingandrescuingandsoon.

ChapterIIProductionSafetyGuarantiesforProductionOperationUnits

Article16ProductionoperationunitsshallpossessproductionsafetyconditionsasrequiredbythisLaw,otherrelevantlawsandadministrativeregulations,aswellasnationalstandardsortradestandards.Whoeverfailstoprovidesafetyconditionsshallnotengageinproductionoperation.

Article17Thepersonnelchieflyinchargeofproductionoperationshalltakethefollowingresponsibilitiesforproductionsafetyintheirunits.

（1）Toestablishandimproveproductionsafetyresponsibilitysystem

（2）Toorganizeandestablishsafetyregulationsandoperatingprinciples.

（3）Toensureeffectiveenforcementofproductionsafetyintheseunits.

（4）Tosuperviseandexamineproductionsafetyworkintheseunitsandtoclearupthehiddenhazardstosafetyintime.

（5）Toorganize,frameandcarryouttheemergencyrescuecontingentproposalsoftheseunits.

（6）Tomakeatimelyandtruereportofaccidents.

Article18Productionoperationunitsshallbeprovidedwithcapitalinvestmentindispensabletoproductionsafetyconditions,guaranteedbypolicy-makingbody,thepersonnelchieflyincharge,orindividualinvestorsintheseunits,andbearresponsibilityforalltheconsequencesarisingfromtheshortageofcapitalinvestment.

Article19Mines,constructionworkunitsandunitsthatmanufacture,dealin,andstorethedangerousarticlesshallestablishsafetyregulatoryagency,orsupplyfull-timepersonnelinchargeoftheadministrationofproductionsafety.

TheotherproductionoperationunitsnotprovidedintheprecedingParagraph,ifinvolvingmorethan300personnel,shallestablishtheproductionsafetyregulatoryagency,orbesuppliedwithfull-timepersonnelinchareoftheadministrationofproductionsafety.Thosewiththepersonneloflessthan300shallbeprovidedwithfull-timeorpart-timepersonnelinchargeofthecontroloverproductionsafety,orentrusttheengineersholdingtherelevantprofessionalskillqualificationswithproductionsafetymanagementandservice.

IntheeventthatproductionoperationunitsentrusttheengineerstoprovidethesafetymanagementandserviceinaccordancewiththeprovisionoftheprecedingParagraph,theseunitsshalltakeresponsibilityforensuringproductionsafety.

Article20Thepersonnelchieflyinchargeofproductionoperationunitsandthestaffengagingintheadministrationofproductionsafetyshallpossesssafetyknowledgeandoperatingcapabilitycorrespondingtoproductionoperationstheyareengagedin.

Thepersonnelchieflyinchargeofunitsthatmanufacture,dealin,andstoredangerousgoods,andminesandconstructionworkunitsandthestaffinchargeofthecontrolofproductionsafetyaswellshallnotholdthepostsunlesstheypasstheexaminationinsafetyknowledgeandoperatingcapabilityheldbytherelevantdepartmentsincharge.Theexaminationmustnotbecharged.

Article21Productionoperationunitsshalloffertheemployeesinstructionandtraininginproductionsafetyknowledge,ensuringthattheyareprovidedwithnecessarysafetyknowledge,thattheyarefamiliarwiththerelevantsafetyregulationsandoperatingconvention,andthattheyhaveagoodcommandofoperatingsafetyskillsintheirownposts.Whoeverdoesnotundergosafetyinstructionandtrainingshallnotholdtheposts.

Article22Incaseproductionoperationunitsadoptnewtechniques,newtechnology,newmaterialsorusenewequipments,theyshallunderstandandcommandthetechnicalsafetyproperties,adopteffectiveprecautiousmeasuresagainstaccidents,andprovidetheemployeeswithspecialinstructionsandtraininginproductionsafetyknowledge.

Article23ThespecialoperatingstaffinproductionoperationunitsshallnotholdthepostsunlesstheyaccordingtotherelevantprovisionsoftheStatetakepartinthespecialtrainingandobtainthequalificationforthisspecialoperation.

TheextentofspecialoperatingstaffshallbedefinedbytheStateCouncildepartmentinchargeofsafetysupervisionandadministration,alongwiththeotherStateCouncildepartmentsconcerned.

Article24Thesafetyfacilitiesinvolvingnewconstruction,reconstructionandexpansionoftheconstruction（hereinafterreferredtoasthe“constructionproject”）onthepartofproductionoperationunitsshallbedesigned,constructed,putonstreamandputintousealongwiththeprincipalpartoftheprojectatthesametime.Theinvestmentinsafetyfacilitiesshallbebroughtintobudgetaryestimateofconstructionproject.
