承保风险

Risks

1.Thisinsurancecovers,exceptasexcludedbytheprovisionsofClauses4,5,6and7below,

1.1lossofordamagetothesubject-matterinsuredreasonablyattributableto

1.1保险标的的灭失或损害可合理归因于：

1.1.1fireorexplosion

1.1.1火灾或爆炸

1.1.2vesselorcraftbeingstrandedgroundedsunkorcapsized

1.1.2船舶或驳船触礁、搁浅、沉没或倾覆

1.1.3overturningorderailmentoflandconveyance

1.1.3陆上运输工具倾覆或出轨

1.1.4collisionorcontactofvesselcraftorconveyancewithanyexternalobjectotherthanwater

1.1.4船舶、驳船或运输工具与水以外的任何其他外界物体的碰撞或触碰

1.1.5dischargeofcargoataportofdistress

1.1.5在避难港卸货

1.1.6earthquakevolcaniceruptionorlightning,

1.1.6地震、火山爆发或雷电

1.2lossofordamagetothesubject-matterinsuredcausedby

1.2保险标的因下述原因导致的灭失或损害：

1.2.1generalaveragesacrifice

1.2.1共同海损牺牲

1.2.2jettisonorwashingoverboard

1.2.2投弃或浪击落海

1.2.3entryofsealakeorriverwaterintovesselcraftholdconveyancecontainerorplaceofstorage,

海水、湖水或河水进入船舶、驳船、船舱、运输工具、集装箱或储存处所

1.3totallossofanypackagelostoverboardordroppedwhilstloadingonto,orunloadingfrom,vesselorcraft.

1.3货物在装卸船舶或驳船时落海或跌落导致整件货物的全损。

GeneralAverage

2.Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofcarriageand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7below.

2.共同海损（GeneralAverage）

本保险承保根据运输合同及/或适用法律和惯例理算或确定的，为避免或与避免任何原因导致的有关引起共同海损和救助费用的损失，但不包括以下第4、5、6和7条的除外责任。

"BothtoBlameCollisionClause"

3.ThisinsuranceindemnifiestheAssured,inrespectofanyriskinsuredherein,againstliabilityincurredunderanyBothtoBlameCollisionClauseinthecontractofcarriage.IntheeventofanyclaimbycarriersunderthesaidClause,theAssuredagreetonotifytheInsurerswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.

3.“船舶互有责任碰撞条款”（"BothtoBlameCollisionClause"）

本保险赔偿被保险人根据运输契约船舶互有责任碰撞条款，由被保险人就承保风险应承担的责任。

在上述条款下若承运人向被保险人提起索赔，被保险人同意通知保险人，保险人有权自负费用为被保险人就此项索赔抗辩。

EXCLUSIONS

除外责任

4.Innocaseshallthisinsurancecover

4.在任何情况下，本保险不承保：

4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

4.1可归因于被保险人的恶意行为引起的灭失、损害或费用；

4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

4.2保险标的的自然渗漏、重量或容量的自然损耗或自然磨损；

4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsuredtowithstandtheordinaryincidentsoftheinsuredtransitwheresuchpackingorpreparationiscarriedoutbytheAssuredortheiremployeesorpriortotheattachmentofthisinsurance（forthepurposeoftheseClauses"packing"shallbedeemedtoincludestowageinacontainerand"employees"shallnotincludeindependentcontractors）

4.3由于保险标的的包装或配装不足或不当引起的无法承受运输途中发生的通常的事故而产生的灭失、损害或费用，此种情况适用于：

该包装或配装是由被保险人或其受雇人员完成的，或该包装或配装是在本保险责任开始前完成的。

（本条所称的“包装”，包括集装箱；本条所称的“雇员”，不包括独立合同人。

）

4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

4.4保险标的的固有缺陷或特性导致的灭失损害或费用；

4.5lossdamageorexpensecausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst（exceptexpensespayableunderClause2above）

4.5迟延引起的灭失损害或费用，即使该迟延由于承保风险所引起（上述第2条可以赔付的费用除外）。

4.6lossdamageorexpensecausedbyinsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevesselwhere,atthetimeofloadingofthesubject-matterinsuredonboardthevessel,theAssuredareaware,orintheordinarycourseofbusinessshouldbeaware,thatsuchinsolvencyorfinancialdefaultcouldpreventthenormalprosecutionofthevoyage.

Thisexclusionshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract.

4.6因船舶所有人、经理人、租船人或经营人破产或不履行债务导致的灭失损害或费用。

此情况适用于，在保险标的装上船舶之时，被保险人知道，或被保险人在正常业务经营中应当知道，此种破产或不履行债务会导致该航程被取消。

本条除外条款不适用于，当保险合同已经转让给另一方，即另一方已经善意购买或同意购买保险标的且受保险合同约束。

4.7deliberatedamagetoordeliberatedestructionofthesubject-matterinsuredoranypartthereofbythewrongfulactofanypersonorpersons

4.7由任何个人或数人的不法行为故意损坏或故意破坏保险标的或其任何部分。

4.8lossdamageorexpensedirectlyorindirectlycausedbyorarisingfromtheuseofanyweaponordeviceemployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

4.8因使用任何原子或核子裂变和（或）聚变或其他类似反应或放射性力量或物质的武器或设备直接或间接导致的灭失损害或费用。

5.5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom

5.5.1本保险在任何情况下均不承保因下述原因所致的灭失损害或费用：

5.1.1unseaworthinessofvesselorcraftorunfitnessofvesselorcraftforthesafecarriageofthesubject-matterinsured,wheretheAssuredareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein

5.1.1被保险人在保险标的装船时已经知道船舶或驳船的不适航，及船舶或驳船不适合安全运输保险标的所引起的损失或费用。

5.1.2unfitnessofcontainerorconveyanceforthesafecarriageofthesubject-matterinsured,whereloadingthereinorthereoniscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheiremployeesandtheyareprivytosuchunfitnessatthetimeofloading.

5.1.2在本保险合同生效前，装载已开始或已完成，或被保险人或其雇员在装载时已经知道集装箱或运输工具不适合安全运输保险标的。

5.2Exclusion5.1.1aboveshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract.

5.2上述5.1.1所述的除外条款不适用于:

当保险合同已经善意转让给另一方,即另一方已经购买或同意购买保险标的且受合同约束。

5.3TheInsurerswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination.

5.3保险人放弃运载保险标的至目的地的船舶违反适航或船舶适货的任何默示保证。

6.Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

6.本保险在任何情况下均不承保因下述原因所致的灭失损害或费用：

6.1war，civilwar，revolution，rebellion，insurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower；

6.1战争、内战、革命、叛乱、暴乱，或由此引起的内乱，或来自交战方或针对交战方的任何敌对行为。

6.2capture，seizure，arrest，restraint，ordetainment,andtheconsequencesthereoforanyattemptthereat；

6.2捕获、扣押、扣留、管制或拘押，以及由此引起的后果或任何企图、威胁。

6.3derelictmines，torpedoes，bombsorotherderelictweaponsofwar.

6.3丢弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。

7.Innocaseshallthisinsurancecoverlossdamageorexpense

7.本保险在任何情况下均不承保下述灭失损害或费用：

7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions

7.1由罢工者、被迫停工工人或参与工潮、暴动或民众骚乱人员引起的；

7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions

7.2由罢工、被迫停工、工潮、暴动或民众骚乱结果引起的；

7.3causedbyanyactofterrorismbeinganactofanypersonactingonbehalfof,orinconnectionwith,anyorganizationwhichcarriesoutactivitiesdirectedtowardstheoverthrowingorinfluencing,byforceor

violence,ofanygovernmentwhetherornotlegallyconstituted

7.3由任何恐怖主义行为，或与恐怖主义行为相联系，任何组织通过暴力直接实施的旨在推翻或影响法律上承认的或非法律上承认的政府的行为引起的；

7.4causedbyanypersonactingfromapolitical,ideologicalorreligiousmotive.

7.4由任何人出于政治、信仰或宗教目的实施的行为引起的。

8.8.1SubjecttoClause11below,thisinsuranceattachesfromthetimethesubject-matterinsuredisfirstmovedinthewarehouseorattheplaceofstorage（attheplacenamedinthecontractofinsurance）forthepurposeoftheimmediateloadingintoorontothecarryingvehicleorotherconveyanceforthecommencementoftransit,continuesduringtheordinarycourseoftransitandterminateseither

8.1依据下述第11条的规定，本保险的责任自保险标的为了开始运输立即搬运至运输车辆或其他运输工具的目的，在仓库或储存处所（本保险合同载明的地点）开始搬移时生效，包括正常运输过程，直至运到下述地点时终止：

8.1.1oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratthefinalwarehouseorplaceofstorageatthedestinationnamedinthecontractofinsurance,

8.1.1在本保险合同载明的目的地最后仓库或储存处所，从运输车辆或其他运输工具完成卸货；

8.1.2oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedinthecontractofinsurance,whichtheAssuredortheiremployeeselecttouseeitherforstorageotherthanintheordinarycourseoftransitorforallocationordistribution,or

8.1.2在本保险合同载明的目的地任何其他仓库或储存处所，或在中途任何其他仓库或储存处所，从运输车辆或其他运输工具完成卸货，上述任何其他仓库或储存处所是由被保险人或者其雇员选择用作在正常运送过程之外的储存货物，或分配货物，或分派货物，或

8.1.3whentheAssuredortheiremployeeselecttouseanycarryingvehicleorotherconveyanceoranycontainerforstorageotherthanintheordinarycourseoftransitor

8.1.3被保险人或其雇员在正常运输过程之外选择任何运输车辆或其它运输工具或任何集装箱储存货物，或

8.1.4ontheexpiryof60daysaftercompletionofdischargeoversideofthesubject-matterinsuredfromtheoverseavesselatthefinalportofdischarge,

whichevershallfirstoccur.

8.1.4自保险标的在最后卸货港卸离海轮满60天为止。

上述情况以先发生者为准。

8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredistobeforwardedtoadestinationotherthanthattowhichitisinsured,thisinsurance,whilstremainingsubjecttoterminationasprovidedinClauses8.1.1to8.1.4,shallnotextendbeyondthetimethesubject-matterinsuredisfirstmovedforthepurposeofthecommencementoftransittosuchotherdestination.

8.2如果保险标的在最后卸货港卸离海轮后,但本保险责任终止前,需被转运至非保单载明的其他目的地时,本保险在依然受条款8.1.1至8.1.4有关终止规定所制约的同时,截止于该项保险标的为开始向该其他目的地转运而开始搬移之时；

8.3Thisinsuranceshallremaininforce（subjecttoterminationasprovidedforinClauses8.1.1to8.1.4aboveandtotheprovisionsofClause9below）duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarg
