3、n water1.1.4船舶、驳船或运输工具与水以外的任何其他外界物体的碰撞或触碰1.1.5 discharge of cargo at a port of distress1.1.5 在避难港卸货1.1.6 earthquake volcanic eruption or lightning,1.1.6 地震、火山爆发或雷电1.2 loss of or damage to the subject-matter insured caused by1.2 保险标的因下述原因导致的灭失或损害：1.2.1 general average sacrifice1.2.1共同海损牺牲1.2.2 jettis

5、海或跌落导致整件货物的全损。General Average2. This insurance covers general average and salvage charges, adjusted or determined according to the contract of carriage and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses

6、 4, 5, 6 and 7 below.2.共同海损（General Average）本保险承保根据运输合同及/或适用法律和惯例理算或确定的，为避免或与避免任何原因导致的有关引起共同海损和救助费用的损失，但不包括以下第4、5、6和7条的除外责任。Both to Blame Collision Clause3. This insurance indemnifies the Assured, in respect of any risk insured herein, against liability incurred under any Both to Blame Collision Cla

In the event of any claim by carriers under the said Clause, the Assured agree to notify the Insurers who shall have the right, at their own cost and expense, to defend the Assured against such claim.3.“船舶互有责任碰撞条款”（ Both to Blame Collision Clause）本保险赔偿被保险人根据运输契约船舶互有责

In no case shall this insurance cover4. 在任何情况下，本保险不承保：4.1 loss damage or expense attributable to wilful misconduct of the Assured4.1可归因于被保险人的恶意行为引起的灭失、损害或费用；4.2 ordinary leakage, ordinary loss in weight

9、or volume, or ordinary wear and tear of the subject-matter insured4.2保险标的的自然渗漏、重量或容量的自然损耗或自然磨损；4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured to withstand the ordinary incidents of the insured transit where such packing or

10、preparation is carried out by the Assured or their employees or prior to the attachment of this insurance (for the purpose of these Clauses packing shall be deemed to include stowage in a container and employees shall not include independent contractors)4.3 由于保险标的的包装或配装不足或不当引起的无法承受运输途中发生的通常的事故而产生的灭失

11、、损害或费用，此种情况适用于：该包装或配装是由被保险人或其受雇人员完成的，或该包装或配装是在本保险责任开始前完成的。( 本条所称的“包装”，包括集装箱 ；本条所称的“雇员”，不包括独立合同人。)4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured4.4 保险标的的固有缺陷或特性导致的灭失损害或费用；4.5 loss damage or expense caused by delay, even though the delay be caused by a risk

12、insured against(except expenses payable under Clause 2 above)4.5迟延引起的灭失损害或费用，即使该迟延由于承保风险所引起( 上述第 2 条可以赔付的费用除外) 。4.6 loss damage or expense caused by insolvency or financial default of the owners managers charterers or operators of the vessel where, at the time of loading of the subject-matter insure

13、d on board the vessel, the Assured are aware, or in the ordinary course of business should be aware, that such insolvency or financial default could prevent the normal prosecution of the voyage.This exclusion shall not apply where the contract of insurance has been assigned to the party claiming her

14、eunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.4.6 因船舶所有人、经理人、租船人或经营人破产或不履行债务导致的灭失损害或费用 。此情况适用于 ， 在保险标的装上船舶之时 ，被保险人知道 ，或被保险人在正常业务经营中应当知道 ，此种破产或不履行债务会导致该航程被取消。本条除外条款不适用于 ，当保险合同已经转让给另一 方 ，即另一方已经善意购买或同意购买保险标的且受保险合同约束。4.7 deliberate damage to or

15、deliberate destruction of the subject-matter insured or any part thereof by the wrongful act of any person or persons4.7 由任何个人或数人的不法行为故意损坏或故意破坏保险标的或其任何部分。4.8 loss damage or expense directly or indirectly caused by or arising from the use of any weapon or device employing atomic or nuclear fission an

16、d/or fusion or other like reaction or radioactive force or matter.4.8因使用任何原子或核子裂变和 ( 或) 聚变或其他类似反应或放射性力量或物质的武器或设备直接或间接导致的灭失损害或费用。5. 5.1 In no case shall this insurance cover loss damage or expense arising from5.5.1 本保险在任何情况下均不承保因下述原因所致的灭失损害或费用：5.1.1 unseaworthiness of vessel or craft or unfitness of

17、vessel or craft for the safe carriage of the subject-matter insured, where the Assured are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein5.1.1被保险人在保险标的装船时已经知道船舶或驳船的不适航 ，及船舶或驳船不适合安全运输保险标的所引起的损失或费用。5.1.2 unfitness of container or conveyance for the

18、 safe carriage of the subject-matter insured, where loading therein or thereon is carried out prior to attachment of this insurance or by the Assured or their employees and they are privy to such unfitness at the time of loading.5.1.2在本保险合同生效前，装载已开始或已完成，或被保险人或其雇员在装载时已经知道集装箱或运输工具不适合安全运输保险标的。5.2 Exclu

19、sion 5.1.1 above shall not apply where the contract of insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract.5 . 2 上述 5 . 1.1 所述的除外条款不适用于: 当保险合同已经善意转让给另一方 ,即另一方已经购买或同意购买保险标的且受合同约束。5.3 The Insurers

20、 waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination.5.3 保险人放弃运载保险标的至目的地的船舶违反适航或船舶适货的任何默示保证。6. In no case shall this insurance cover loss damage or expense caused by6.本保险在任何情况下均不承保因下述原因所致的灭失损害或费用：6.1 war ，

21、civil war， revolution， rebellion ，insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power；6.1 战争、内战、革命、叛乱、暴乱，或由此引起的内乱，或来自交战方或针对交战方的任何敌对行为。6.2 capture， seizure， arrest， restraint， or detainment , and the consequences thereof or any attempt thereat；6.2 捕获、

22、扣押、扣留、管制或拘押，以及由此引起的后果或任何企图、威胁。6.3 derelict mines， torpedoes ，bombs or other derelict weapons of war.6.3 丢弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。7. In no case shall this insurance cover loss damage or expense7. 本保险在任何情况下均不承保下述灭失损害或费用：7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturb

23、ances, riots or civil commotions7.1由罢工者、被迫停工工人或参与工潮、暴动或民众骚乱人员引起的；7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions7.2 由罢工、被迫停工、工潮、暴动或民众骚乱结果引起的；7.3 caused by any act of terrorism being an act of any person acting on behalf of, or in connection with, any organizatio

24、n which carries out activities directed towards the overthrowing or influencing, by force orviolence, of any government whether or not legally constituted7.3由任何恐怖主义行为 ，或与恐怖主义行为相联系 ，任何组织通过暴力直接实施的旨在推翻或影响法律上承认的或非法律上承认的政府的行为引起的；7.4 caused by any person acting from a political, ideological or religious m

25、otive.7.4由任何人出于政治、信仰或宗教目的实施的行为引起的。DURATION保险期间Transit Clause运输条款8. 8.1 Subject to Clause 11 below, this insurance attaches from the time the subject-matter insured is first moved in the warehouse or at the place of storage (at the place named in the contract of insurance) for the purpose of the imme

26、diate loading into or onto the carrying vehicle or other conveyance for the commencement of transit, continues during the ordinary course of transit and terminates either8.1依据下述第11条的规定，本保险的责任自保险标的为了开始运输立即搬运至运输车辆或其他运输工具的目的，在仓库或储存处所（本保险合同载明的地点）开始搬移时生效，包括正常运输过程，直至运到下述地点时终止：8.1.1 on completion of unload

27、ing from the carrying vehicle or other conveyance in or at the final warehouse or place of storage at the destination named in the contract of insurance,8.1.1在本保险合同载明的目的地最后仓库或储存处所 ，从运输车辆或其他运输工具完成卸货 ；8.1.2 on completion of unloading from the carrying vehicle or other conveyance in or at any other war

28、ehouse or place of storage, whether prior to or at the destination named in the contract of insurance, which the Assured or their employees elect to use either for storage other than in the ordinary course of transit or for allocation or distribution, or8.1.2 在本保险合同载明的目的地任何其他仓库或储存处所 ，或在中途任何其他仓库或储存处所

29、 ，从运输车辆或其他运输工具完成卸货 ，上述任何其他仓库或储存处所是由被保险人或者其雇员选择用作 在正常运送过程之外的储存货物 ，或分配货物 ，或分派货物，或8.1.3 when the Assured or their employees elect to use any carrying vehicle or other conveyance or any container for storage other than in the ordinary course of transit or8.1.3 被保险人或其雇员在正常运输过程之外选择任何运输车辆或其它运输工具或任何集装箱储存货物

30、，或8.1.4 on the expiry of 60 days after completion of discharge overside of the subject-matter insured from the oversea vessel at the final port of discharge,whichever shall first occur.8.1.4 自保险标的在最后卸货港卸离海轮满 60 天为止。 上述情况以先发生者为准。8.2 If, after discharge overside from the oversea vessel at the final po

31、rt of discharge, but prior to termination of this insurance, the subject-matter insured is to be forwarded to a destination other than that to which it is insured, this insurance, whilst remaining subject to termination as provided in Clauses 8.1.1 to 8.1.4, shall not extend beyond the time the subj

32、ect-matter insured is first moved for the purpose of the commencement of transit to such other destination.8.2如果 保险标的在最后卸货港卸离海轮后 , 但本保险责任终止前 , 需被转运至非保单载明的其他目的地时 ,本保险 在依然受条款 8 . 1 . 1 至 8 . 1 . 4 有关终止规定所制约的同时 ,截止于该项保险标的为开始向该其他目的地转运而开始搬移之时 ；8.3 This insurance shall remain in force (subject to termination as provided for in Clauses 8.1.1 to 8.1.4 above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharg
