mootcourt英文模拟法庭实训
实践内容二:
英文模拟法庭实训（mootcourt）一、实训目的:
在裁决某一案件之前～必须先了解该案件的具体事实情况～然后在找出法律依据。
通过模拟法庭～培养学生缜密、条理的思维习惯～学会分析具体问题并归纳分析～合理判断事实的性质～并根据不同的法律关系～恰当适用法律。
二、组织方式
1、以班为单位组织进行～各班分别准备～在同一天依班次顺序模拟开庭。
2、由主讲老师讨论设定一个典型的案例。
3、各班配备一名指导老师～具体由指导老师组织进行。
三、前期准备
1、由指导老师介绍案情
2、学生按原告方、被告方、法官分三组～指定组长～组织对案情进行讨论～分析
案情事实～提出对案情事实看法或观点～并安排记录。
3、各组自荐或推荐或通过竞争演说决出本方的角色担当者,如
原告方要有原告、
代理律师,～每个角色确定A、B两人。
4、由指导老师组织查找资料～撰写法律文书。
5、法庭实地观摩～如有条件的话亦可请法院到学校开庭。
6、校内广告宣传、邀请。
服装、道具准备

英文模拟法庭实训（mootcourt）
由各班就模拟法庭在校内进行广告宣传,海报形式:
时间、地点、案情简介,
邀请校领导、各系主任及老师参加并给予指导。
并邀请各系同学参加旁听
场所的确定、服装、道具的借用等物质准备由各班指导老师担
当～需要时请系主任帮助解决。
四、模拟演练
一共进行两次演练～各班分别由其指导老师组织。
通过演练～最终确定角色名单
及所需具体时间。
五、模拟开庭
六、在各班分别总结的基础上进行综合评比、考核。
七、角色的定位及要求
实习除管理人、指导老师外～根据案情至少确定如下主角～即原告方及其律师、被告方及其律师、法官三人,审判长一人～审判员二人,、书记员一人。
需要的时候还可以设第三人、证人、律师事务所等。
每个角色设定AB二人～通过竞争择优～选出一人。
管理人:
管理所有参与实习的班级资料、指导老师资料和实习通知内容。

建立实习计划～为参加实习的学生分配角色～在网站发布新闻～指导学生角色的进入～对暴露出来的知识盲点予以补充教育～并对学生所准备的文书资料予以审查、指导～力求学生能够正确担当各自的角色～担当模拟法庭的场所、布置、服装道具的联络、确认～保证模拟法庭的顺利进行。
设定实习评分标准～最终对学生的实习成果给予评定。
原告方及其律师:
原告方作为案件的当事人之一～应列明本案的全部事实～通过分析、判断～找出对本方所有的有利的事实情节～逐条列出～寻找人证、物证加以证明～并注意证据的相互映证性、关联性～并查找相关法律规定～以此为依据～提出自己的观点～围绕自己的观点～以事实为依据～以法律为准绳～撰写起诉书～并按照被告人人数提交副本。
在接到答辩状后～组织全组成员仔细分析对方的答辩状～分析出不合理、不合法之处～以便在法庭上进行反驳、辩论。
写出辩论提纲～并且要站在对方角度思考～随时准备应对对方提出的新证据和新观点。
被告方及其律师:
被告方作为案件的当事人之一～应把握本案的全部事实～通过分析、判断～与本案有关的事实情节以及起诉书～找出对本方所有的有利的事实情节～逐条列出～寻找人证、物证加以证明～并注意证据的相互映证性、关联性～并查找相关法律规定～以此为依据～提出自己的观点～围绕自己的观点～以事实为依据～以法律为准绳～撰写答辩状～并提交法院。

这可是一项充满挑战和乐趣的工作。
法官及书记员:
熟悉诉讼程序的相关规定～譬如:
当事人到庭情况的
询问～回避的规定、庭审的程序等。
同时还要求能够把握庭审的进
展时间、气氛～学会适当利用法锤等手段～把握整个法庭的局面。
证人、第三人:
根据自己的角色～准备相应的书面资料。
4.模拟法庭程序及要求（theprocedureandrequestsofmootcourt）
Amootisanargument（andnotadebate）betweenstudentsactingasadvocatesrepresentingdifferentpartiesinalegalaction（acase）.Thefactsandhistorytogetherwithsupportingmaterialandauthoritiesaregiveninadvancetothestudents.
Theaimistoreproduce,ascloselyaspossible,thediscussionandargumentofagenuinehearingintheEuropeanCourtofJustice.ThecaseisbaseduponanareaofEuropeanCommunityLawandhasbeenpreparedbyawritingcommitteeoftheorganisersandexternalexperts.
TheorganisersareawarethataccessofthecompetingteamstoEuropeanCommunitylawmaterialswillvarygreatly.Thereforeafullbundleofsupportingmaterialsandauthoritiesisincludedandencompassesalltheauthoritieswhichteamsarepermittedtorefertointhiscase,toensurethatnounfairadvantageisgainedfromthosewithlessfacilities.

5.Scoring
Thecompetitionwillbeheldoverthreerounds.
FirstRound
Inthisroundallteamswillbeinvitedtoargueboththesidesofthecase.Thiswillrequiremembersfromtheteamtorepresenttheappellant’scaseagainstanotherteamarguingonbehalfoftherespondentandthenrepresenttherespondent’scaseagainsta
differentteamarguingonbehalfoftheappellant.Itisrequiredthatallmembersoftheteamspeakaseitherrespondentorapplicantbutitisnotrequiredthatallmembersspeakbothasrespondentandapplicantduringthefirstround.Duringthispartofthecompetition,thecourtswillfocusonquestions1,2and3whichwerereferredfor
judgmentbythefictitiousECMemberStateforarulingbytheECJ.
Scoreswillbeallocatedattheconclusionofthisroundonthebasisofboththewrittenandoralpleadings.

SecondRound
Inthisround,thebestteamsfromthefirstroundwillagainbeinvitedtopleadbothsidesofthecaseagainstotherteams.Thisroundwillfocusonquestions4and
5andthecourtwillindicateonwhichoftheotherquestionstheywouldliketobeaddressedreferredbythefictitiousECMemberStatenationalcourtforrulingbythe
ECJ.Markswillbeawardedforthesamecriteriaasapplytothefirstround,withtheexceptionthatmarksfromwrittenpleadingsarenolongercounted.Duringthisround,itisnecessaryforallmembersoftheteamtospeakbothasapplicantandrespondentinthesemi-finals.

Inthethirdround（final）eachteamwillrepresentonesideofthecase（tobechosenbylot）andthejudgeswillindicatewhichquestionswillbeconsidered.Eachmemberoftheteamisexpectedtospeakinthefinalandsotheteammustbepreparedtore-allocatethosequestionscoveredtoensurethateachteammemberspeaks.Itisofcoursepermissibleforonememberoftheteamtodothereplyorrejoinderatthisstage..
Threejudgeswillsitinthefirstandsecondround.Aplenarycourtwillbeconvenedforthefinal.
Thedecisionofthejudgeswillbeconclusiveinselectingthesemi-finalists,finalistsandeventualwinningteamandbestspeaker.AspecialprizeofashortstageintheECJatLuxembourgwillbeawardedtotheindividualdeemedtobethebestspeakerfromthesemi-finalistsorfinalists.

Thisshouldbeanoutlineofyourcaseforbothapplicantanddefendant,notexceeding10typedsidesofargumentonA4paperforbothapplicantandrespondent（nospecificrequirementsforfontorspacingareprescribedandanattachedlistofauthoritiesisnotincludedinthe10pagesallowance）
Youshouldsetoutyourargumentinnumberedparagraphs,whichshouldbesupportedandcross-referencedtoaseparatelistoftheauthoritiesonwhichyouintendtorely.
ONLYteamslodgingthesepleadingswillbeinvitedtoparticipateintheoralroundsofthecompetition（e-mailandfaxedpleadingsarenotacceptable）
Intheeventthatmorethanoneteamsendswrittenpleadingsfromoneuniversity,theteamtoparticipatewillbethatsubmittingthebestwrittenpleadings.
OralArgument
Thisargumentneednotbelimitedtothescopeoftheparticipant'swrittenpleadings,butstricttimelimitationsaretobemaintained.TeamswillbeadvisedofthescheduleofcourtsatregistrationonarrivalinZagreb.
Themainargumentofeachpartyshallbepresentedwithin20minutes.

Theapplicantthenhas5minutestoreply,butislimitedinthisreplytothemattersraisedinthedefendant'soralpleadings.
Thedefendantthenhas5minutestoreplyinrejoinderandisalsolimitedtomattersraisedintheapplicant'sreply.
PermissionmustbesoughtofthePresidentoftheCourt,ifanytimelimitistobeexceeded.Onlyafurther5minutescanbeallowedathis/herdiscretion.
Inthefinalnoformaltimingwillbepre-setwiththejudgesindicatingattheannouncementofthefinalteamstheamountoftimeallowedforthepresentationofthecasebyeachparty.
6.Roles
Eachteammayhaveuptofourmembers.Teamsshouldbeinapositiontoarguebothsidesandcandivideinwhichmannertheywishtoachievethateitherasafullgrouporbydividingtheirteams,howeverthejudgeswillexpecttohaveheardfromeachmemberoftheteamindividuallyatleastonceduringthefirstroundofthecompetition.
Thiswillchangeinthesecondandthirdroundsofthecompetitionwherethejudgeswillexpecttohearfromeachmemberoftheteamduringtheirpresentation.
TIPSFORTEAMS
LanguageinCourt
Whenaddressingajudgethefollowingcourtesiesshouldbeobserved.Youmustinvestigatethetitleofthejudgeandqualification.IfanEnglishlord,hemustbeformallyaddressedasMyLordorSir.AmoregeneraltermisYourHonour.
Bepolitetothejudges.
Listencarefullytotheirquestionsandtrytoensureyoufollowtheirstatements.Answerthequestionstheyputandnotthosetowhichyouknowtheanswer.Neverarguewiththejudge,ifyouwanttowinyourcase.Thesamepointcouldalwaysbeputpolitelyandjustaseffectively.
