SEC.3001.SHORTTITLE;REFERENCES 

（a）SHORTTITLE-Thistitlemaybecitedasthe`AnticybersquattingConsumerProtectionAct'. 

（b）REFERENCESTOTHETRADEMARKACTOF1946-AnyreferenceinthistitletotheTrademarkActof1946shallbeareferencetotheActentitled`AnActtoprovidefortheregistrationandprotectionoftrademarksusedincommerce,tocarryouttheprovisionsofcertaininternationalconventions,andforotherpurposes',approvedJuly5,1946（15U.S.C.1051etseq.）. 

SEC.3002.CYBERPIRACYPREVENTION. 

（a）INGENERAL-Section43oftheTrademarkActof1946（15U.S.C.1125）isamendedbyinsertingattheendthefollowing:

（d）

（1） 

（A）Apersonshallbeliableinacivilactionbytheownerofamark,includingapersonalnamewhichisprotectedasamarkunderthissection,if,withoutregardtothegoodsorservicesoftheparties,thatperson-- 

（i）hasabadfaithintenttoprofitfromthatmark,includingapersonalnamewhichisprotectedasamarkunderthissection;and

（ii）registers,trafficsin,orusesadomainnamethat-- 

（I）inthecaseofamarkthatisdistinctiveatthetimeofregistrationofthedomainname,isidenticalorconfusinglysimilartothatmark; 

（II）inthecaseofafamousmarkthatisfamousatthetimeofregistrationofthedomainname,isidenticalorconfusinglysimilartoordilutiveofthatmark;or 

（III）isatrademark,word,ornameprotectedbyreasonofsection706oftitle18,UnitedStatesCode,orsection220506oftitle36,UnitedStatesCode. 

（B）（i）Indeterminingwhetherapersonhasabadfaithintentdescribedundersubparagraph（A）,acourtmayconsiderfactorssuchas,butnotlimitedto--

（I）thetrademarkorotherintellectualpropertyrightsoftheperson,ifany,inthedomainname; 

（II）theextenttowhichthedomainnameconsistsofthelegalnameofthepersonoranamethatisotherwisecommonlyusedtoidentifythatperson; 

（III）theperson'sprioruse,ifany,ofthedomainnameinconnectionwiththebonafideofferingofanygoodsorservices; 

（IV）theperson'sbonafidenoncommercialorfairuseofthemarkinasiteaccessibleunderthedomainname; 

（V）theperson'sintenttodivertconsumersfromthemarkowner'sonlinelocationtoasiteaccessibleunderthedomainnamethatcouldharmthegoodwillrepresentedbythemark,eitherforcommercialgainorwiththeintenttotarnishordisparagethemark,bycreatingalikelihoodofconfusionastothesource,sponsorship,affiliation,orendorsementofthesite; 

（VI）theperson'soffertotransfer,sell,orotherwiseassignthedomainnametothemarkowneroranythirdpartyforfinancialgainwithouthavingused,orhavinganintenttouse,thedomainnameinthebonafideofferingofanygoodsorservices,ortheperson'spriorconductindicatingapatternofsuchconduct; 

（VII）theperson'sprovisionofmaterialandmisleadingfalsecontactinformationwhenapplyingfortheregistrationofthedomainname,theperson'sintentionalfailuretomaintainaccuratecontactinformation,ortheperson'spriorconductindicatingapatternofsuchconduct; 

（VIII）theperson'sregistrationoracquisitionofmultipledomainnameswhichthepersonknowsareidenticalorconfusinglysimilartomarksofothersthataredistinctiveatthetimeofregistrationofsuchdomainnames,ordilutiveoffamousmarksofothersthatarefamousatthetimeofregistrationofsuchdomainnames,withoutregardtothegoodsorservicesoftheparties;and（IX）theextenttowhichthemarkincorporatedintheperson'sdomainnameregistrationisorisnotdistinctiveandfamouswithinthemeaningofsubsection（c）

（1）ofsection43.

（ii）Badfaithintentdescribedundersubparagraph（A）shallnotbefoundinanycaseinwhichthecourtdeterminesthatthepersonbelievedandhadreasonablegroundstobelievethattheuseofthedomainnamewasafairuseorotherwiselawful.`

（C）Inanycivilactioninvolvingtheregistration,trafficking,oruseofadomainnameunderthisparagraph,acourtmayordertheforfeitureorcancellationofthedomainnameorthetransferofthedomainnametotheownerofthemark. 

（D）Apersonshallbeliableforusingadomainnameundersubparagraph（A）onlyifthatpersonisthedomainnameregistrantorthatregistrant'sauthorizedlicensee. 

（E）Asusedinthisparagraph,theterm`trafficsin'referstotransactionsthatinclude,butarenotlimitedto,sales,purchases,loans,pledges,licenses,exchangesofcurrency,andanyothertransferforconsiderationorreceiptinexchangeforconsideration.

（2） 

（A）Theownerofamarkmayfileaninremcivilactionagainstadomainnameinthejudicialdistrictinwhichthedomainnameregistrar,domainnameregistry,orotherdomainnameauthoritythatregisteredorassignedthedomainnameislocatedif-- 

（i）thedomainnameviolatesanyrightoftheownerofamarkregisteredinthePatentandTrademarkOffice,orprotectedundersubsection（a）or（c）;and（ii）thecourtfindsthattheowner-- 

（I）isnotabletoobtaininpersonamjurisdictionoverapersonwhowouldhavebeenadefendantinacivilactionunder

paragraph

（1）;or 

（II）throughduediligencewasnotabletofindapersonwhowouldhavebeenadefendantinacivilactionunder

paragraph

（1）by-- 

（aa）sendinganoticeoftheallegedviolationandintenttoproceedunderthisparagraphtotheregistrantof

thedomainnameatthepostalande-mailaddressprovidedbytheregistranttotheregistrar;and（bb）publishingnoticeoftheactionasthecourtmaydirectpromptlyafterfilingtheaction.

（B）Theactionsundersubparagraph（A）（ii）shallconstituteserviceofprocess. 

（C）Inaninremactionunderthisparagraph,adomainnameshallbedeemedtohaveitssitusinthejudicialdistrictinwhich-- 

（i）thedomainnameregistrar,registry,orotherdomainnameauthoritythatregisteredorassignedthedomainnameislocated;or 

（ii）documentssufficienttoestablishcontrolandauthorityregardingthedispositionoftheregistrationanduseofthedomainnamearedepositedwiththecourt. 

（D）（i）Theremediesinaninremactionunderthisparagraphshallbelimitedtoacourtorderfortheforfeitureorcancellationofthedomainnameorthetransferofthedomainnametotheownerofthemark.Uponreceiptofwrittennotificationofafiled,stampedcopyofacomplaintfiledbytheownerofamarkinaUnitedStatesdistrictcourtunderthisparagraph,thedomainnameregistrar,domainnameregistry,orotherdomainnameauthorityshall-- 

（I）expeditiouslydepositwiththecourtdocumentssufficienttoestablishthecourt'scontrolandauthorityregardingthe

dispositionoftheregistrationanduseofthedomainnametothecourt;and 

（II）nottransfer,suspend,orotherwisemodifythedomainnameduringthependencyoftheaction,exceptuponorderofthecourt.

（ii）Thedomainnameregistrarorregistryorotherdomainnameauthorityshallnotbeliableforinjunctiveormonetaryreliefunderthisparagraphexceptinthecaseofbadfaithorrecklessdisregard,whichincludesawillfulfailuretocomplywithanysuchcourtorder.

[（d）]（3）Thecivilactionestablishedunderparagraph

（1）andtheinremactionestablishedunderparagraph

（2）,andanyremedyavailableundereithersuchaction,shallbeinadditiontoanyothercivilactionorremedyotherwiseapplicable. 

[（d）]（4）Theinremjurisdictionestablishedunderparagraph

（2）shallbeinadditiontoanyotherjurisdictionthatotherwiseexists,whetherinremorinpersonam.'

（b）CYBERPIRACYPROTECTIONSFORINDIVIDUALS- 

（1）INGENERAL-

（A）CIVILLIABILITY-Anypersonwhoregistersadomainnamethatconsistsofthenameofanotherlivingperson,oranamesubstantiallyandconfusinglysimilarthereto,withoutthatperson'sconsent,withthespecificintenttoprofitfromsuchnamebysellingthedomainnameforfinancialgaintothatpersonoranythirdparty,shallbeliableinacivilactionbysuchperson. 

（B）EXCEPTION-Apersonwhoingoodfaithregistersadomainnameconsistingofthenameofanotherlivingperson,oranamesubstantiallyandconfusinglysimilarthereto,shallnotbeliableunderthisparagraphifsuchnameisusedin,affiliatedwith,orrelatedtoaworkofauthorshipprotectedundertitle17,UnitedStatesCode,includingaworkmadeforhireasdefinedinsection101oftitle17,UnitedStatesCode,andifthepersonregisteringthedomainnameisthecopyrightownerorlicenseeofthework,thepersonintendstosellthedomainnameinconjunctionwiththelawfulexploitationofthework,andsuchregistrationisnotprohibitedbyacontractbetweentheregistrantandthenamedperson.Theexceptionunderthissubparagraphshallapplyonlytoacivilactionbroughtunderparagraph

（1）andshallinnomannerlimittheprotectionsaffordedundertheTrademarkActof1946（15U.S.C.1051etseq.）orotherprovisionofFederalorStatelaw.

（2）REMEDIES-Inanycivilactionbroughtunderparagraph

（1）,acourtmayawardinjunctiverelief,includingtheforfeitureorcancellationofthedomainnameorthetransferofthedomainnametotheplaintiff.Thecourtmayalso,initsdiscretion,awardcostsandattorneysfeestotheprevailingparty. 

（3）DEFINITION-Inthissubsection,theterm`domainname'hasthemeaninggiventhatterminsection45oftheTrademarkActof1946（15U.S.C.1127）. 

（4）EFFECTIVEDATE-ThissubsectionshallapplytodomainnamesregisteredonorafterthedateoftheenactmentofthisAct.
