Introduction
TheMinistryofLabouroftheKingdomofSaudiArabiawelcomesallexpatriatesrecruitedforworkintheKingdomandwishesthemasuccessfulworkperioduntiltheyreturntotheirhomecountriesaftertheendoftheirworkperiod.
TheMinistryofLabourandallconcernedbodiesassureallworkersthattheyareguestsoftheMinistryandthatitiseagertotakecareoftheminaccordancewiththerulesofIslamicSharia',theapplicablelawsandinternationalconventions.
TheMinistryofLabourpreparedthisGuidebookforallexpatriatesrecruitedforworkintheKingdomofSaudiArabiatoprovidethemwithbasicinformationontheKingdomandtoclarifytheprovisionsoftheLabourLaw,theregulations&decisionsrenderedpursuanttoitwhichdefinetherelationshipbetweentheworkerandtheemployerinordertocreateasuitableenvironmentforexpatriateworkers,tomaintaintheirrights,toestablishaproperrelationshipbetweenthetwopartiesandtomakebetterunderstandingofthelabourmarketintheKingdom.

TheKingdomappliesfreemarketeconomyandopensthedoorforworkersfromallnationalitieswithoutrestrictionsaftertheysatisfyhealth,occupational,educationalandtrainingrequirements.EmployershavelibertytorecruitworkersfromallovertheworldinaccordancewiththeprovisionsoftheLabourLaw,theregulations&decisionsrenderedonitsimplementationandtheotherrelevantlawsapplicableintheKingdom.

TheLabourLawinSaudiArabiaisabalancedlawthatregulatesallaspectsoflabourrelationsbetweenworkersandemployeesandapplicabletoallSaudiandNon-Saudiworkerswithoutdiscrimination.
Respectingthelawsandcompliancewiththeirprovisionsenhanceslabourrelationsstabilityandactsasakeyforprogressanddevelopment.UponthisconcepttheMinistryofLabourissuedthisGuidebookforworkersandforallbodiesconcernedwithlabourrelationsintheKingdom.Weadviseworkers,particularly,toabidewiththefollowing:
1-Toconcludewrittenworkcontractswiththeiremployers.
2-Tobepunctual.
3-Toavoidabsencefromworkwithoutpriorpermissionorvalidreason.
4-Toobeytheordersandinstructionsoftheirimmediatesupervisors.
5-Toavoidassaultingsupervisorsorthemanagerin-chargebywordorhand.
6-Torefrainfrommalingering.
7-Toabidewithoccupationalhealth&safetyinstructions.
8-Toavoidtamperingwiththeequipmentandtoolsoffirmortoolsofworksites.
9-Toavoidescapefromworkplaceexceptinemergencies.
10-Toreturntoworkintimeaftertheelapseofannualvacationoranyothervacation.
11-AfterenteringtheKingdom,aworkerhastomakesurethathisemployerhasstartedprocedureforrenderingworklicense&residencepermit(Iqama)within90daysfromthedateofarrival.Anypermitorauthorizationrequiredbyanyotherbodyforpracticingworkorprofessionwillnotbeacceptableasasubstituteforworklicense.
12-Toavoidworkingforothersasitviolatesthelawunlessofficialprocedurearesatisfied.
13-Toavoidworkinginajobotherthanthatmentionedintheworklicensebeforesatisfyingthenecessarylegalprocedure.
14-Toappealtothecompetentlabourofficeinyourworkregionifyoufaceanyproblemorgrievancefromtheconcernedpersonsofthefirminwhichyouworkandyoufailtosettleitamicably.
15-ToavoidtraffickinginpersonsorinvisasasitisanillegalpracticeandpunishablebytheLaw.
16-AfirmshallbearmedicalcostsofitsemployeesaccordingtoitsworkorganizationregulationapprovedbytheMinistryofLabourortotheLabourLaw.
17-AfirmshallsubscribeforallemployeesinOccupationalHazardsBranchofSocialInsuranceLaw.TheprovisionsofOccupationalHazardsBranchofSocialInsuranceLawshallbeappliedonworkaccidentsandoccupationaldiseases.
Partthree:
residencepermit(Iqama)&worklicenseandrecruitmentcosts:
1-Anemployershallissueresidencepermit(Iqama)&worklicensefortheworkerherecruitswithin90daysfromthedateoftheworker'sarrivalattheKingdom.Incaseanemployerfailstoissueresidencepermit(Iqama)&worklicense,heshallberesponsibleforanyfinesresultingfromthat.Inthiscaseaworker'sserviceshallbedeemedinbreachoftheLawandthedecisionsregulatingtheemploymentofNon-Saudis.Workersshall,insuchacase,notifythecompetentlabourofficeofthattotakethenecessaryprocedureagainsttheemployer.
2-AworkershallbemedicallyfitfortheworkforwhichheisrecruitedandfreefromanydiseaseunderamedicalcertificaterenderedfromacompetentmedicalbodyintheKingdominaccordancewiththeinstructionsissuedinthisrespect.
3-Aworklicenseshallbeissuedforoneortwoyearsandshallberenewableforasimilarperiodundertheconsentoftheemployerandtheworkerboth.Aworklicenseshallberenewedimmediatelyafterexpirytoavoidfinesappliedunderthelawsofresidencyandlabouronemployerswhodelayrenewal.Asnon-renewalaffectstheworker,theworkershallrequesthisemployertorenewresidencepermit(Iqama)&worklicenseaslongastheworkrelationexistsbetweenhimandhisemployer.Ifanemployerfailstorespondtotheworker'srequest,theworkershallnotifythecompetentlabourofficeofthattotakethenecessaryprocedureagainsttheemployer.
4-Theemployershallberesponsibleforworkers'recruitmentfees,feesonissue&renewalofresidencepermit(Iqama)&worklicense,feesresultingfromrenewaldelay,feesofsponsorshiptransferforwork,jobtitlechangefeesandre-entryvisasfees.
5-Allworkersmustholdresidencepermit(Iqama)&worklicenseduringtheirtravelwithintheKingdomandtoshowthemtotheconcernedgovernmentbodiesincludinglabourofficeofficialsandpassportpolice.
Howtoobtainresidencepermit(Iqama)&worklicense?
Worklicense:
AworklicenseshallbeissuedbytheMinistryofLabour(labouroffices)undercertainconditionswhileaworkershouldsatisfythefollowingconditions:
1-aworkershouldhavelegallyenteredtheKingdom
2-aworkershallhaveaworkcontractwithaSaudioranon-SaudiemployerlicensedforworkunderInvestmentLaw.
3-aworkershallhaveapassportvalidfor,atleast,sixmonths.
4-aworkershallhaveprofessionalcompetenceoracademicqualificationrequiredbythecountry.
5-aworkermustbemedicallyfitandfreefromalldiseases.
Residencepermit(Iqama):
Residencepermit(Iqama)shallbeissuedfrompassportdepartmentslocatedinvariousregionsoftheKingdomundercertainconditions.

workcontract:
1-aworkcontractisacontractconcludedbetweenanemployerandaworkerbywhichthelatterundertakestoworkunderthecontrolandsupervisionoftheemployeragainstawage.Theworkcontractshallincludetheworkconditionsagreeduponbetweenthetwoparties.
2-Theworkershallconcludeaworkcontractwiththeemployerwithwhomhewillworkorwithhisdulyauthorizedrepresentative.ThiscontractshallbewritteninArabicorinduallanguage(Arabic&anotherlanguage)knowingthattheArabictextwillprevailincaseofduallanguage.Nootherworkcontractmaybeconcluded.
3-TheworkershallreceiveacopyoftheworkcontracttoholditduringalltheperiodofhisworkintheKingdom.
4-Aworkcontractshallincludethedateonwhichitisconcluded,thedateofworkcommencement,placeandperiodofwork,salary,allowancesandtheworker'sjob.Aworkcontractforanon-Saudiworkershallbewrittenandforadefiniteperiod.Ifthecontractperiodisnotmentioned,theworklicenseperiodshallbedeemedtheperiodoftheworkcontract.
5-Theworkcontractshallstateclearlywhetheraworkerishiredonprobation.Probationperiodshallbeclearlystatedandmaynotexceed90daysinwhichtheLesserBairam&GreaterBairamholidaysandsickl
