Introduction
Background
1.On13April,theDepartmentpublishedaconsultationpaper,‘ANorthernIrelandMarineBill–PolicyProposals’,seekingviewsonthepolicyproposalsfortheNorthernIrelandMarineBill.ThefulltextoftheconsultationpaperisavailableontheDepartment’swebsiteat:

2.TheproposedNIMarineBillwillestablishaframeworkforourseasbasedonanewsystemofmarineplanning;afurtherstreamliningofmarinelicensinginadditiontotheimprovementsalreadyprovidedforintheMarineandCoastalAccessAct2009(theUKAct),whichextendstoNorthernIreland;andprovisionsforMarineConservationZoneswhich,oncedesignated,canprotectawiderangeofspeciesandhabitats.TheproposedNIMarineBillincombinationwiththeUKActandtheUK-wideMarineStrategyRegulations2010willdeliveranewmanagementandlegislativeprogrammeforourseas.
3.Inparallel,workiscontinuingatUK-leveltoagreeaMarinePolicyStatement(MPS),requiredundertheUKAct,toprovidetheover-archingpolicyframeworkforpreparingmarineplansandtakingdecisionsthateffectthemarineenvironment.AUK-wideconsultationexerciseontheMPSclosedon13October2010andresponsesareunderconsideration.
4.Inaddition,theNIsubordinatelegislationflowingfromtheUKActwillintroduceanewmarinelicensingregimewhichwillreplacePart2oftheFoodandEnvironmentProtectionAct1985.Thenewregimeshouldservebothtoprovidecertaintyandtransparencytoindustry(suchastherenewableenergysector),andtoencourageinvestmentinmarineactivitiesinNorthernIreland.Thisnewregimeisalsosubjecttoaconsultationexercisewhichwillcloseon3November2010.
5.TheproposedNIMarineBillwillprovidethefinalpieceofNI’smarineprogrammeensuringthatNIwillbewellplacedtobenefitsocially,economicallyandenvironmentallyfromtheresourcesthatitsseashavetooffer.TheBillwillplayakeyroleinensuringthatanintegrated,coherentmarineplanisinplacein2014.TheDepartmentoftheEnvironment,asthemarineplanauthority,willworkwithotherDepartmentswithmarinefunctionstoconsiderhowmarineresourcescanbestbemanagedinordertoachievesustainabledevelopmentobjectiveswithinNI.Themarineplanwillidentifyareasofconstraintandlocationswherearangeofactivitiesmaybeaccommodated.
6.TheBillwillfulfiltheExecutive’scommitmenttoachievingthevisionof“clean,healthy,safe,productiveandbiologicallydiverseoceansandseas”.

7.TheconsultationperiodontheNIMarineBillPolicyProposalsranfrom13thApriluntil9thJuly.
8.Fortytwowrittenresponseswerereceived.Ofthese,thirtysevenweresubstantive.Asummaryofrespondents’comments,alongwiththeDepartment’sresponsetothespecificpointsraisedisprovidedinAnnexA.AlistofallrespondentsisattachedatAnnexB.
9.NocommentswerereceivedontheoutlineRegulatoryImpactAssessment(RIA)orpreliminaryscreeningforEqualityImpactcontainedintheconsultationpaper.
10.Alltherespondentsweresupportiveoftheproposalstoputinplaceanewlegislativeandmanagementframeworkincorporatingmarineplanning,furtherstreamliningoflicensingandimprovementstomarinenatureconservation.Theproposalstoestablishamarineprogrammefoundedontheprinciplesofsustainabledevelopment,betterregulationandmodernGovernmentwerewelcomedasameansofprovidinggreaterclarityandconsistencyinmarineissues.
11.AnumberofissuesemergedandthefollowingparagraphprovidesmoredetailwithabriefsummaryoftheDepartment’sresponse.Theissuesaregroupedunderthegeneralheadingsofmarineplanning,marinelicensingandmarinenatureconservation.
12.MarinePlanning
(i)ArobustinterfacebetweentheMarinePlanandterrestrialDevelopmentPlansandthattheconceptofIntegratedCoastalZoneManagement(ICZM)shouldbetakenintoaccount.TheBillprovidesforthisbyensuringthattheDepartment,asMarinePlanAuthority,willdevelopaMarinePlanwhichiscompatiblewithterrestrialDevelopmentPlans.

(ii)Respondentsvoicedapreferencefortheestablishmentofasimple,flexibleandinclusivelicensingregime.TheDepartmenthasalreadytakenthisintoaccountastheNIMarineBillwillcreateamoreeffective,streamlinedandtransparentsystemtoprovideaclearer,simplerapproachfordevelopersandoperators.Thenewlicensingandplanningsystemswillrequirewidespreadstakeholderinvolvementincludingtheparticipationoflocalinterests.
MarineNatureConservation
(iii)Anumberofrespondentsalsoraisedtheobjectivedevelopment,selectionanddesignationofMarineConservationZones(MCZs)asacriticalfactor.TheDepartmenthastakenthisintoaccountandwillconsidertheeconomic,socialandenvironmentalaspectspriortoidentifyinganddesignatinganMCZ.ThedesignationofMCZswillbesubjecttoconsultationandagreementofallDepartmentspriortoseekingSecretaryofStateapproval.

TheDepartmentiscommittedtoacloseworkingrelationshipwiththeotherUKAdministrationsandtheNIMarineBillwilloutlinethestepstoachievecompatibilitybetweenmarineplansthatareadjacenttoeachother.ItwillalsomaintainaconsistencyofapproachwhereourwatersabutthoseoftheRepublicofIreland.Thedevelopmentofamarineplanwillbeconsistentandintegratedwithotherplans.

Thedevelopmentofamarineplanisdependentonstakeholderinvolvementandwillbesubjecttopublicconsultation.Themarineplanwillensurethatastrategicviewistakenofalloftheconcerns/recommendationsmadeandwillcontributetotheeffectivemanagementofmarineactivities.TheNIMarineBillwillprovidetheframeworkforconsistent,sustainableandevidence-baseddecision-making.

TheaquacultureandfishingsectorsaresubjecttoaseparatelicensingregimeadministeredbyDARD.TheUKActenablesthelicensingauthoritytoexemptcertainactivitiesfromthelicensingregimeandaconsultationexerciseiscurrentlyunderwaycoveringthisinmoredetail.Thenewlicensingsystemwillintroduceanewappealsprocedure,newcivilsanctionsintheformoffixedandvariablepenalties,andarevisedlistofexemptactivities.TheproposedNIMarineBillmayalsoprovideforspecificexemptionsand/orspecialproceduresrelevanttoNI.
Respondentsrecommendedthatthelicensingsystemshouldbeflexibleenoughtorespondtonewinformationandconditions,inordertosupporttheinnovationprocess.
TheDepartmentwillensurewidespreadstakeholderinvolvementinthedevelopmentofanewlicensingregime.Considerationisbeinggiventoflexiblefeesfornon-standardactivitiesandwillbesubjecttoaseparateconsultationexercise.
