Chapter1:
GeneralProvisions
Article1ThisLawisformulatedtoassurefoodsafety,andsafeguardpeople'shealthhandlife.
Article2WheneverthefollowingactivitiesarecarriedoutintheterritoryofthePeople'sRepublicofChina,thisLawmustbeobserved:
1)Foodproductionandprocessing(referredtoas“FoodProduction”hereafter);fooddistributionandcateringservice(referredtoas“FoodTrading”hereafter);
2)Productionandtradingoffoodadditives;
3)Productionandtradingofpackingmaterials,vessels,detergentsanddisinfectantsforfoodaswellasutensilsandequipmentusedinfoodproductionandtrading(referredtoas“Food-RelatedProducts”hereafter);
4)Foodadditivesandfood-relatedproductsusedbyfoodproducersandtraders;
5)Safetymanagementoffood,foodadditivesandfood-relatedproducts.
Thequalityandsafetymanagementofprimaryagriculturalproductsforconsumption(hereinafterreferredtoas“EdibleAgriculturalProducts”)shallbeinaccordancewiththeQualityandSafetyofAgriculturalProductsLaw.However,thisLawmustbeobservedindevelopingqualityandsafetystandardsforedibleagriculturalproductsandreleasingsafetyinformationonedibleagriculturalproducts.
Article3Foodproducersandtradersshallstrictlyfollowrelevantlawsandregulationsandfoodsafetystandardsintheirfoodbusinessactivities,beresponsibleforthepublic,ensurethefoodsafety,receivethesupervisionofthepublicandbearthesocialresponsibility.
Article4TheStateCouncilshallestablishtheFoodSafetyCommittee,withtheresponsibilitiesdeterminedbytheStateCouncil.
ThehealthauthoritiesundertheStateCouncilisresponsiblefortheoverallcoordinationforfoodsafety,andfoodsafetyassessment,developmentoffoodsafetystandards,publishingoffoodsafetyinformation,developmentofthecertificationconditionsforqualificationofthefoodinspectionandtestingagenciesandthespecificationofinspectionandtesting,andorganizationforinvestigationandtreatmentofthesignificantfoodsafetyaccidents.
Theauthoritiesforqualitysupervision,administrationofindustryandcommerceandFDAundertheStateCouncilshallberesponsibleforsupervisionandmanagementofthefoodproduction,fooddistributionandcateringservicerespectivelyaccordingtotheLawandtherequirementsoftheStateCouncil.
Article5Localpeople'sgovernmentsatandabovecountylevelshalltakeoverallresponsibilityfor,lead,organizeandcoordinatethesupervisionandmanagementoffoodsafetyintheirjurisdiction;establishandhonefoodsafetycoordinationmechanismsfortheinspectionandmanagementoffoodsafety,taketheleadingandcommandingroleindealingwithfoodsafetyemergencies,developafoodsafetyaccountabilitysystem,andreviewandevaluatetheperformanceoffoodsafetyregulatoryagencies.
ThelocalPeople’sGovernmentatthecountyleveloraboveshalldefinetheresponsibilitiesoftheadministrativedepartmentsforhealth,agriculture,qualitysupervision,industryandcommerceandFDAforsupervisionandmanagementoffoodsafety,accordingtotheLawandtherequirementsoftheStateCouncil.Therelevantauthoritiesshallbeinchargeofthesupervisionandmanagementoffoodsafetyintherespectivejurisdiction.
Thesubordinateadministrativedivisionssetupbelowahigherlevelpeople'sgovernmentmustbeundertheunifiedcoordinationofthelowerlevelgovernmentincarryingouttheirfoodsafetyinspectionandmanagement.
Article6Theadministrativedepartmentsforhealth,agriculture,qualitysupervision,industryandcommerceandFDAatthecountyleveloraboveshallstrengthencommunicationandclosecooperation,exercisetherightandbeartheresponsibilitiesaccordingtotheworkdivision.
Article7Therelatedfoodindustryassociationsshallstrengthentheirself-discipline,andguidefoodproducersandtraderstoconductproductionandoperationaccordingtolaw,enhancetheconstructionoftheindustrialcredit,andpublicizeanddisseminatethefoodsafetyknowledge.
Article8Civilsocietyandcommunitygroupsareencouragedtoconductfoodsafetyeducationalactivitiesonunderstandingoffoodsafety,laws,regulationsandstandards,toadvocatehealthydietsandtoraiseconsumerawarenessoffoodsafetyandlookingaftertheirhealth.
Themediashallpublicizefoodsafetyinformation,laws,regulationsandstandardsandknowledgefreeofcharge,andprovidethesupervisionofpublicopinionregardingtheactinviolationoftheLaw.
Article9TheStateencouragesandsupportsbasicandappliedfood-relatedresearch,andencouragesandsupportsfoodproducersandtraderstoapplyadvancedtechnologiesandgoodmanagementpracticesinordertoimprovefoodsafety.
Article10AnyorganizationorindividualhastherighttoreportandindictbehaviorinviolationoftheLaw,torequestinformationfromrelevantagencies,andtoproposecommentsandsuggestionsonfoodsafetyinspectionandmanagement.Consumersalsohavetherighttodemandcompensationaccordingtolawforanyphysicalandpropertydamagecausedbyconsumptionoffood,foodadditivesorfood-relatedproducts.
Chapter2:
SurveillanceandAssessmentofFoodSafetyRisks
Article11Asurveillancesystemforfoodsafetyshallbeestablishednationwideforsurveillanceoverfood-bornedisease,foodcontaminationandotherfood-relatedhazardstohumanhealth.
ThehealthadministrativedepartmentsoftheStateCouncilshallestablishandimplementplansforthesurveillanceofnationalfoodsafetyinconjunctionwithotherdepartmentsoftheStateCouncil.Thehealthadministrativedepartmentsofgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernmentshallestablishandimplement,accordingtothenationalplansforfoodsafetysurveillanceandtakingintoconsiderationregionalparticularities,theplansandschemesforthesurveillanceoffoodsafetywithintheirrespectivejurisdictions.
Article12Theauthoritiesforagriculture,qualitysupervision,administrationofindustryandcommerceandFDAundertheStateCouncilshall,uponknowledgeofanyinformationonfoodsafetyrisk,reporttotherelevantauthoritiesundertheStateCouncil.ThehealthauthoritiesundertheStateCouncil,inconjunctionwithotherrelevantauthorities,shallverifytheinformationandtimelyadjustthefoodsafetyrisksurveillanceplan.
Article13Amechanismtoassessfoodsafetyrisksshallbeestablishednationwidetoassessrisksofbiological,chemicalandphysicalhazardsinfoodsandfoodadditives.
Theassessmentoffoodsafetyriskshallbetheresponsibilityofafoodsafetyriskassessmentcommitteecomposingexpertsinmedicine,agriculture,food,nutritionandotherfieldsinvitedbythehealthauthoritiesundertheStateCouncil.
Theassessmentoffoodsafetyriskforpesticide,fertilizer,growthregulator,animalremedy,animalfeedandfeedadditives,etc.shallbeattendedwiththeexpertsofthefoodsafetyriskassessmentexpertcommittee.
Theassessmentoffoodsafetyriskshallbeconductedbyutilizingthescientificmethods,basedontheinformationoffoodsafetyrisksurveillance,thescientificdataandotherrelevantinformation.
Article14ThehealthauthoritiesundertheStateCouncil,upondiscoveringanypossiblesafetyproblemthroughfoodsafetyrisksurveillanceorreportingofotherparties,shallimmediatelyorganizeinspectionandassessmentoffoodsafetyrisk.
Article15Theauthoritiesforagriculture,qualitysupervision,administrationofindustryandcommerceandFDAundertheStateCouncilshallproposethesuggestionsonassessmentofthefoodsafetyrisk,andprovidetherelevantinformation.
ThehealthauthoritiesundertheStateCouncilshalltimelyreporttheresultsofthefoodsafetyriskassessmenttotherelevantauthoritiesundertheStateCouncil.
Article16Foodsafetyriskassessmentresultsshallbethescientificbasisfordevelopingandmodifyingfoodsafetystandards,andoverseeingandadministeringfoodsafety.
Iftheresultofafoodsafetyriskassessmentprovesfoodtobeunsafe,theauthoritiesforqualitysupervision,industryandcommerceandFDAundertheStateCouncilshallpromptlytakeappropriatemeasurestoensurefoodproducersortraderstosuspendorceasetradingofsuchfood,andinformconsumerstostopuseaccordingto
