Preamble

Members,

Desiringtoreducedistortionsandimpedimentstointernationaltrade,andtaking

intoaccounttheneedtopromoteeffectiveandadequateprotectionofintellectualpropertyrights,andtoensurethatmeasuresandprocedurestoenforceintellectualpropertyrightsdonotthemselvesbecomebarrierstolegitimatetrade;

Recognizing,tothisend,theneedfornewrulesanddisciplinesconcerning:

(a)theapplicabilityofthebasicprinciplesofGATT1994andofrelevantinternationalintellectualpropertyagreementsorconventions;

(b)theprovisionofadequatestandardsandprinciplesconcerningtheavailability,scopeanduseoftrade-relatedintellectualpropertyrights;

(c)theprovisionofeffectiveandappropriatemeansfortheenforcementoftrade-relatedintellectualpropertyrights,takingintoaccountdifferencesin

nationallegalsystems;(d)theprovision

ofeffectiveandexpeditiousproceduresforthemultilateralpreventionand

settlementofdisputesbetweengovernments;and

(e)transitionalarrangementsaimingatthefullestparticipationintheresults

ofthenegotiations;

Recognizingtheneedforamultilateralframeworkofprinciples,rulesand

disciplinesdealingwithinternationaltradeincounterfeitgoods;

Recognizingthatintellectualpropertyrightsareprivaterights;

Recognizingtheunderlyingpublicpolicyobjectivesofnationalsystemsforthe

protectionofintellectualproperty,includingdevelopmentalandtechnological

objectives;

Recognizingalsothespecialneedsoftheleast-developedcountryMembersinrespectofmaximumflexibilityinthedomesticimplementationoflawsandregulationsin

ordertoenablethemtocreateasoundandviabletechnologicalbase;

DesiringtoestablishamutuallysupportiverelationshipbetweentheWTOandthe

WorldIntellectualPropertyOrganization(referredtointhisAgreementas“WIPO)aswellasotherrelevantinternationalorganizations;

Hereby?

agreeasfollows:

PartIGeneralProvisionsandBasicPrinciples

Article1NatureandScopeofObligations

shallgiveeffecttotheprovisionsofthisAgreement.Membersmaybutshallnotbeobligedto,implementintheirlawmoreextensiveprotectionthanisrequired

bythisAgreement,providedthatsuchprotectiondoesnotcontravenetheprovisions

ofthisAgreement.Membersshallbefreetodeterminetheappropriatemethodof

implementingtheprovisionsofthisAgreementwithintheirownlegalsystemandpractice.

thepurposesofthisAgreement,theterm“intellectualproperty”referstoall

categoriesofintellectualpropertythatarethesubjectofSections1through7ofPartII.

Article4Most-Favored-NationTreatment

Withregardtotheprotectionofintellectualproperty,anyadvantage,favor,

privilegeorimmunitygrantedbyaMembertothenationalsofanyothercountryshall

beaccordedimmediatelyandunconditionallytothenationalsofallotherMembers

Exemptedfromthisobligationareanyadvantage,favor,privilegeorimmunity

accordedbyaMember:

(a)derivingfrominternationalagreementsonjudicialassistaneeorlawenforcement

ofageneralnatureandnotparticularlyconfinedtotheprotectionofintellectual

property;

(b)?

grantedinaccordancewiththeprovisionsoftheBerneConvention(1971)ortheRomeConventionauthorizingthatthetreatmentaccordedbeafunctionnotofnationaltreatmentbutofthetreatmentaccordedinanothercountry;

(c)?

inrespectoftherightsofperformers,producersofphonogramsandbroadcastingorganizationsnotprovidedunderthisAgreement;

(d)?

derivingfrominternationalagreementsrelatedtotheprotectionofintellectualproperty

whichenteredintoforcepriortotheentryintoforceoftheWTOAgreement,providedthatsuchagreementsarenotifiedtotheCouncilforTRIPSanddonotconstituteanarbitraryorunjustifiablediscriminationagainstnationalsofotherMembers.

Article5MultilateralAgreementsonAcquisitionorMaintenanceofProtectionTheobligationsunderArticles?

3and4donotapplytoproceduresprovidedinmultilateralagreementsconcludedundertheauspicesofWIPOrelatingtotheacquisitionormaintenanceofintellectualpropertyrights.

Article6Exhaustion

ForthepurposesofdisputesettlementunderthisAgreement,subjecttotheprovisionsofArticles?

3and4nothinginthisAgreementshallbeusedtoaddresstheissueoftheexhaustionofintellectualpropertyrights.

Article7Objectives

Theprotectionandenforcementofintellectualpropertyrightsshouldcontributetothepromotionoftechnologicalinnovationandtothetransferanddisseminationoftechnology,tothemutualadvantageofproducersandusersoftechnologicalknowledgeandinamannerconducivetosocialandeconomicwelfare,andtoabalanceofrightsandobligations.

Article8Principles

may,informulatingoramendingtheirlawsandregulations,adoptmeasuresnecessarytoprotectpublichealthandnutrition,andtopromotethepublicinterestinsectorsofvitalimportancetotheirsocio-economicandtechnologicaldevelopment,providedthatsuchmeasuresareconsistentwiththeprovisionsofthisAgreement.

COPYRIGHTANDRELATEDRIGHTS?

Article9RelationtotheBerneConvention

shallcomplywithArticles1through21oftheBerneConvention(1971)andtheAppendixthereto.However,MembersshallnothaverightsorobligationsunderthisAgreementinrespectoftherightsconferredunderArticle6bisofthatConventionoroftherightsderivedtherefrom.
