Tohelpmaintainpeace,security,andstabilityintheWesternPacificandtopromotetheforeignpolicyoftheUnitedStatesbyauthorizingthecontinuationofcommercial,cultural,andotherrelationsbetweenthepeopleoftheUnitedStatesandthepeopleonTaiwan,andforotherpurposes.
BeitenactedbytheSenateandHouseofRepresentativesoftheUnitedStatesofAmericainCongressassembled,
SHORTTITLE
SECTION1.ThisActmaybecitedasthe"TaiwanRelationsAct".
FINDINGSANDDECLARATIONOFPOLICY
*SEC.2.（a）ThePresident-havingterminatedgovernmentalrelationsbetweentheUnitedStatesandthegoverningauthoritiesonTaiwanrecognizedbytheUnitedStatesastheRepublicofChinapriortoJanuary1,1979,theCongressfindsthattheenactmentofthisActisnecessary--
o
（1）tohelpmaintainpeace,security,andstabilityintheWesternPacific;and
o
（2）topromotetheforeignpolicyoftheUnitedStatesbyauthorizingthecontinuationofcommercial,cultural,andotherrelationsbetweenthepeopleoftheUnitedStatesandthepeopleonTaiwan.
*（b）ItisthepolicyoftheUnitedStates--
o
（1）topreserveandpromoteextensive,close,andfriendlycommercial,cultural,andotherrelationsbetweenthepeopleoftheUnitedStatesandthepeopleonTaiwan,aswellasthepeopleontheChinamainlandandallotherpeoplesoftheWesternPacificarea;
o
（2）todeclarethatpeaceandstabilityintheareaareinthepolitical,security,andeconomicinterestsoftheUnitedStates,andaremattersofinternationalconcern;
o（3）tomakeclearthattheUnitedStatesdecisiontoestablishdiplomaticrelationswiththePeople'sRepublicofChinarestsupontheexpectationthatthefutureofTaiwanwillbedeterminedbypeacefulmeans;
o（4）toconsideranyefforttodeterminethefutureofTaiwanbyotherthanpeacefulmeans,includingbyboycottsorembargoes,athreattothepeaceandsecurityoftheWesternPacificareaandofgraveconcerntotheUnitedStates;
o（5）toprovideTaiwanwitharmsofadefensivecharacter;and
o（6）tomaintainthecapacityoftheUnitedStatestoresistanyresorttoforceorotherformsofcoercionthatwouldjeopardizethesecurity,orthesocialoreconomicsystem,ofthepeopleonTaiwan.
*（c）NothingcontainedinthisActshallcontravenetheinterestoftheUnitedStatesinhumanrights,especiallywithrespecttothehumanrightsofalltheapproximatelyeighteenmillioninhabitantsofTaiwan.ThepreservationandenhancementofthehumanrightsofallthepeopleonTaiwanareherebyreaffirmedasobjectivesoftheUnitedStates.
IMPLEMENTATIONOFUNITEDSTATESPOLICYWITHREGARDTOTAIWAN
*SEC.3.（a）Infurtheranceofthepolicysetforthinsection2ofthisAct,theUnitedStateswillmakeavailabletoTaiwansuchdefensearticlesanddefenseservicesinsuchquantityasmaybenecessarytoenableTaiwantomaintainasufficientself-defensecapability.
*（b）ThePresidentandtheCongressshalldeterminethenatureandquantityofsuchdefensearticlesandservicesbasedsolelyupontheirjudgmentoftheneedsofTaiwan,inaccordancewithproceduresestablishedbylaw.SuchdeterminationofTaiwan'sdefenseneedsshallincludereviewbyUnitedStatesmilitaryauthoritiesinconnectionwithrecommendationstothePresidentandtheCongress.
*（c）ThePresidentisdirectedtoinformtheCongresspromptlyofanythreattothesecurityorthesocialoreconomicsystemofthepeopleonTaiwanandanydangertotheinterestsoftheUnitedStatesarisingtherefrom.ThePresidentandtheCongressshalldetermine,inaccordancewithconstitutionalprocesses,appropriateactionbytheUnitedStatesinresponsetoanysuchdanger.
APPLICATIONOFLAWS;INTERNATIONALAGREEMENTS
*SEC.4.（a）TheabsenceofdiplomaticrelationsorrecognitionshallnotaffecttheapplicationofthelawsoftheUnitedStateswithrespecttoTaiwan,andthelawsoftheUnitedStatesshallapplywithrespecttoTaiwaninthemannerthatthelawsoftheUnitedStatesappliedwithrespecttoTaiwanpriortoJanuary1,1979.
*（b）Theapplicationofsubsection（a）ofthissectionshallinclude,butshallnotbelimitedto,thefollowing:
o
（1）WheneverthelawsoftheUnitedStatesreferorrelatetoforeigncountries,nations,states,governments,orsimilarentities,suchtermsshallincludeandsuchlawsshallapplywithsuchrespecttoTaiwan.
o
（2）WheneverauthorizedbyorpursuanttothelawsoftheUnitedStatestoconductorcarryoutprograms,transactions,orotherrelationswithrespecttoforeigncountries,nations,states,governments,orsimilarentities,thePresidentoranyagencyoftheUnitedStatesGovernmentisauthorizedtoconductandcarryout,inaccordancewithsection6ofthisAct,suchprograms,transactions,andotherrelationswithrespecttoTaiwan（including,butnotlimitedto,theperformanceofservicesfortheUnitedStatesthroughcontractswithcommercialentitiesonTaiwan）,inaccordancewiththeapplicablelawsoftheUnitedStates.
o（3）（A）TheabsenceofdiplomaticrelationsandrecognitionwithrespecttoTaiwanshallnotabrogate,infringe,modify,deny,orotherwiseaffectinanywayanyrightsorobligations（includingbutnotlimitedtothoseinvolvingcontracts,debts,orpropertyinterestsofanykind）underthelawsoftheUnitedStatesheretoforeorhereafteracquiredbyorwithrespecttoTaiwan.
o（B）ForallpurposesunderthelawsoftheUnitedStates,includingactionsinanycourtintheUnitedStates,recognitionofthePeople'sRepublicofChinashallnotaffectinanywaytheownershipoforotherrightsorinterestsinproperties,tangibleandintangible,andotherthingsofvalue,ownedorheldonorpriortoDecember31,1978,orthereafteracquiredorearnedbythegoverningauthoritiesonTaiwan.
o（4）WhenevertheapplicationofthelawsoftheUnitedStatesdependsuponthelawthatisorwasapplicableonTaiwanorcompliancetherewith,thelawappliedbythepeopleonTaiwanshallbeconsideredtheapplicablelawforthatpurpose.
o（5）NothinginthisAct,northefactsofthePresident'sactioninextendingdiplomaticrecognitiontothePeople'sRepublicofChina,theabsenceofdiplomaticrelationsbetweenthepeopleonTaiwanandtheUnitedStates,orthelackofrecognitionbytheUnitedStates,andattendantcircumstancesthereto,shallbeconstruedinanyadministrativeorjudicialproceedingasabasisforanyUnitedStatesGovernmentagency,commission,ordepartmenttomakeafindingoffactordeterminationoflaw,undertheAtomicEnergyActof1954andtheNuclearNon-ProliferationActof1978,todenyanexportlicenseapplicationortorevokeanexistingexportlicensefornuclearexportstoTaiwan.
o（6）ForpurposesoftheImmigrationandNationalityAct,Taiwanmaybetreatedinthemannerspecifiedinthefirstsentenceofsection202（b）ofthatAct.
o（7）ThecapacityofTaiwantosueandbesuedincourtsintheUnitedStates,inaccordancewiththelawsoftheUnitedStates,shallnotbeabrogated,infringed,modified,denied,orotherwiseaffectedinanywaybytheabsenceofdiplomaticrelationsorrecognition.
o（8）Norequirement,whetherexpressedorimplied,underthelawsoftheUnitedStateswithrespecttomaintenanceofdiplomaticrelationsorrecognitionshallbeapplicablewithrespecttoTaiwan.
*（c）Forallpurposes,includingactionsinanycourtintheUnitedStates,theCongressapprovesthecontinuationinforceofalltreatiesandotherinternationalagreements,includingmultilateralconventions,enteredintobytheUnitedStatesandthegoverningauthoritiesonTaiwanrecognizedbytheUnitedStatesastheRepublicofChinapriortoJanuary1,1979,andinforcebetweenthemonDecember31,1978,unlessanduntilterminatedinaccordancewithlaw.
*（d）NothinginthisActmaybeconstruedasabasisforsupportingtheexclusionorexpulsionofTaiwanfromcontinuedmembershipinanyinternationalfinancialinstitutionoranyotherinternationalorganization.
OVERSEASPRIVATEINVESTMENTCORPORATION
*SEC.5.（a）Duringthethree-yearperiodbeginningonthedateofenactmentofthisAct,the$1,000percapitaincomerestrictionininsurance,clause
（2）ofthesecondundesignatedparagraphofsection231ofthereinsurance,ForeignAssistanceActof1961shallnotrestricttheactivitiesoftheOverseasPrivateInvestmentCorporationindeterminingwhethertoprovideanyinsurance,reinsurance,loans,orguarantieswithrespecttoinvestmentprojectsonTaiwan.
*（b）Exceptasprovidedinsubsection（a）ofthissection,inissuinginsurance,reinsurance,loans,orguarantieswithrespecttoinvestmentprojectsonTaiwan,theOverseasPrivateInsuranceCorporationshallapplythesamecriteriaasthoseapplicableinotherpartsoftheworld.
THEAMERICANINSTITUTEOFTAIWAN
*SEC.6.（a）Programs,transactions,andotherrelationsconductedorcarriedoutbythePresidentoranyagencyoftheUnitedStatesGovernmentwithrespecttoTaiwanshall,inthemannerandtotheextentdirectedbythePresident,beconductedandcarriedoutbyorthrough--
o
（1）TheAmericanInstituteinTaiwan,anonprofitcorporationincorporatedunderthelawsoftheDistrictofColumbia,or
o
（2）suchcomparablesuccessornongovermentalentityasthePresidentmaydesignate,（hereafterinthisActreferredtoasthe"Institute"）.
*（b）WheneverthePresidentoranyagencyoftheUnitedStatesGovernmentisauthorizedorrequiredbyorpursuanttothelawsoftheUnitedStatestoenterinto,perform,enforce,orhaveinforceanagreementortransactionrelativetoTaiwan,suchagreementortransactionshallbeenteredinto,performed,andenforced,inthemannerandtotheextentdirectedbythePresident,byorthr
