1.TheseRulesmaybecitedastheHousingDevelopers Rules.
Definitions
2.IntheseRules,unlessthecontextotherwiserequires—
"advertisement" includes—
(a) anynoticepublishedinanynewspaper,journal ormagazine;
(b) anycircular,pamphlet,brochureorotherdocument;
(c) anyannouncementdisplayedonanyhoarding,boarding, roof,wall,paling,fence,frame,signboard,plate,cloth,bar, pillar,post,wire,casingorothererectionorcontrivance;or
(d) anyannouncementmadebymeansoffilmsorby meansofbroadcastsoundreceiversortelevisionreceivers;
"building" includesanycompletedbuilding, oranybuildingpartiallycompletedortobeerected,whetheror notintendedforanystratasubdivisioninaccordancewithanypermission orauthorizationforstratasubdivisiongrantedunderthePlanning Act(Cap.232);
"CommissionerofBuildings" meansthe CommissionerofBuildingsappointedundertheBuildingMaintenance andStrataManagementAct(Cap.30C);
"CommissionerofBuildingControl" means theCommissionerofBuildingControlappointedundertheBuilding ControlAct(Cap.29);
"housingproject" meansanylandonwhich constructionworkisbeingcarriedoutorhasbeencarriedout withaviewtobuilding5ormoreseparateunitsforuseasresidential dwellings;
"land" includeslandofanytenure,any buildingorpartthereof,somuchoftheair-spaceabovethesurface asmaybereasonablyusedorenjoyedbyanyproprietor,andall substancesunderthesurface,whetherornotheldapartfromthe surface,andanyestateorinteresttherein;
"limitedcommonproperty" hasthesame meaningasintheBuildingMaintenanceandStrataManagementAct (Cap.30C);
"lot" meansastratumwhichisshown asalotonastratatitleplan;
"registeredland" hasthesamemeaning asisassignedtoitintheLandTitles(Strata)Act(Cap.158);
"RegistrarofTitles" meanstheRegistrar ofTitlesappointedundertheLandTitlesAct(Cap.157);
"stratasubdivision" hasthesamemeaning asisassignedtoitintheLandTitles(Strata)Act;
"stratatitleplan" hasthesamemeaning asintheLandTitles(Strata)Act;
"stratum" meansanypartoflandconsisting ofaspaceofanyshapebelow,onorabovethesurfaceoftheland, orpartlybelowandpartlyabovethesurfaceoftheland,thedimensions ofwhicharedelineated;
"unit" ,inrelationtoahousingproject, meansaunitinahousingprojectwhichcanbeusedasaseparate andcompletedwelling.
Mandatoryparticularsinadvertisements
3.Anyadvertisement(otherthanthoseconveyedbymeans ofbroadcastsoundreceiversorthroughtelevisionreceivers)made byoronbehalfofalicensedhousingdeveloperinrespectofany housingprojectshallincludethefollowingparticulars:
(a) thenameandthelicensenumberofthehousing developer;
(b) thetenureofthelandandencumbrances,ifany, towhichthelandissubject;
(c) theexpecteddatewhenthepurchasersoftheunits inthehousingprojectwillbeabletotakevacantpossessionof theunits;
(d) theexpecteddatewhenthelegaltitleofthe unitssoldwillbeconveyedtothepurchasers;
(e) thelocationofthehousingprojectincluding thelotnumberandMukim/TownSubdivision;and
(f) thebuildingplannumberallocatedbytheCommissioner ofBuildingControlandthedateofbuildingplanapproval.
PowerofControllertowaiverequirements
4.TheControllermay,inhisdiscretion,waiveanyof therequirementsoftheseRulesrelatingtoadvertisementsofhousing projects.
PermissionofStreetandBuildingNames Board
5.Everylicensedhousingdevelopershallobtainthewritten permissionoftheStreetandBuildingNamesBoardbeforeusingany nameforanysiteusedforahousingproject.
Prohibitedparticularsinadvertisements
6.Anadvertisementofahousingprojectshallnotcontain anythingwhichsuggestsoriscalculatedtosuggest—
(a) thepatronageofthePresidentorofanyofthe membersofhisfamily;
(b) anyconnectionwithanyGovernmentdepartment, statutorybodyorpublicbuildingorplace;or
(c) anyattributetowhichthehousingdevelopercannot genuinelymakeaclaim.
Falseparticularsinadvertisements
7.Nopersonshalldisplayorcausetobedisplayedany advertisementinrelationtoahousingprojectwhich—
(a) containsanystatementwhichisfalseormisleading;
(b) failstocomplywiththerequirementsofrule 3;or
(c) contravenesrule6.
Bookingfee
8.Apurchaserofaunitinahousingprojectshallbe requiredtopayforanyoptionorrighttopurchasetheunit,a bookingfeeormakeanyotherpaymentbywhatevernameitiscalled, whichisnotlessthan5%butnotmorethan10%of thepurchasepriceoftheunit.
Register
9.—
(1) Everyhousingdevelopershallmaintain aregisterasshowninFormAintheScheduleshowingtheparticulars ofthepersonswhohaveobtainedoptionsforthepurchaseofthe unitsinahousingproject.
(2) TheControlleroranyofhisofficersmayrequire anyhousingdevelopertoproduceforhisinspectiontheregister maintainedbythedeveloperunderparagraph
(1).
Option
10.—
(1) Ahousingdevelopershallgivetoan intendingpurchaserofaunitinahousingprojectanoptionfor thepurchasewhichshallbeinFormBintheSchedule.
(2) Theoptiongrantedbythehousingdevelopershall notbeassignableortransferable.
(3) Noamendment,deletionoralterationtotheoption referredtoinparagraph
(1)shallbemadeexceptwiththeapproval inwritingoftheController.
(4) Wherethenumberofparkingspacestobeprovided inahousingprojectislessthanthenumberofunitsinthehousing project,thehousingdevelopershall,beforeacceptingabooking feefromanintendingpurchaserforanoptiontopurchaseaunitin thathousingproject—
(a) notifytheintendingpurchaserthatinformation onthenumberofparkingspacesandunitsinthathousingproject isavailableforhisinspectionataspecifiedplaceandduring specifiedhoursfreeofcharge;and
(b) makeavailablesuchinformationforinspection atthespecifiedplaceandduringthespecifiedhoursifsorequested bythatintendingpurchaser.
(5) Whereaunitinahousingprojectisintended tocomprisealotinastratatitleplan,thehousingdeveloper shall,beforeacceptingabookingfeefromanintendingpurchaser foranoptiontopurchasethatunit—
(a) notifytheintendingpurchaserthatthefollowing documentsareavailableforhisinspectionataspecifiedplace andduringspecifiedhoursfreeofcharge:
(i) acopyofthescheduleofstrataunitsoramended scheduleofstrataunitsforthathousingprojectasfiledwith andacceptedbytheCommissionerofBuildings;
(ii) whereanycommonpropertyofthehousingproject isdesignatedaslimitedcommonproperty,aplanordescription ofthelimitedcommonpropertyandtheunitsinthehousingproject thepurchasersofwhichwillbeentitledtotheexclusivebenefit ofthelimitedcommonproperty;and
(b) makeavailablesuchdocumentsforinspectionat thespecifiedplaceandduringthespecifiedhoursifsorequested bythatintendingpurchaser.
Validityofoption
11.—
(1) Whereahousingdeveloperhasgranted toapersonanoptiontopurchaseaunitinahousingproject, heshallnotgranttoanyotherpersonanoptiontopurchasethe sameunituntilafterthefirst-mentionedoptionhaslapsed.
(2) Anoptiongrantedbyahousingdevelopertoany persontopurchaseaunitinahousingprojectshallremaininforce for3weeksfromthedateofdeliverytotheoptionholder’s solicitorsofthetitledeedsorcopiesthereofandthedraftagreementfor thesaleandpurchaseoftheunit.
Saleandpurchaseagreement
12.—
(1) Anagreementmadebetweenahousing developerandapurchaserforthesaleandpurchaseofaunitin ahousingprojectwhichisnotintendedtocomprisealotinastrata titleplanshallbeinFormDintheSchedule.
(2) Anagreementforthesaleofaunitinahousing projectwhichisintendedtocomprisealotinastratatitleplan shallbeinFormEintheSchedule.
(3) Noamendment,deletionoralterationshallbe madetotheagreementreferredtoinparagraph
(1)or
(2)without thepriorapprovalinwritingoftheController.
(4) Anyamendment,deletionoralterationtotheagreement referredtoinparagraph
(1)or
(2)madewithoutthepriorapproval inwritingoftheControllershallbenullandvoid.
(5) TheSingaporeAcademyofLawestablishedunder theSingaporeAcademyofLawAct(Cap.294A)shallactasstakeholder undertheagreementsreferredtoinparagraphs
(1)and
(2).
CompliancewithdirectionsgivenbyController
13.—
(1) TheControllermay,bygivingdirections inwritingpursuanttosection23oftheAct,requireahousing developertofurnishhimwithsuchinformationorparticularsas theControllermayrequirepertainingtoanyhousingprojectwhich isbeingcarriedoutorhasbeencompletedbythehousingdeveloper.
(2) Whereadirectionreferredtoinparagraph
(1) hasbeengivenbytheController,thehousingdeveloperconcerned shallcomplywiththedirectionwithin14daysofthereceiptof thedirectionunlessthehousingdeveloperhaspriortotheexpirationof the14daysappliedforanextensionoftimetocomplywiththe direction.
(3) ThehousingdevelopershallsupplytheController withsuchinformationanddocumentsasmayberequiredinsupport oftheapplicationunderparagraph
(2).
(4) Whereanapplicationforanextensionoftime—
(a) isrejectedbytheController,thehousingdeveloper shallcomplywiththedirectionreferredtoin
