各国死刑

我个人认为死刑不应该存在，但现阶段的刑罚不能没有死刑。

我们一直高举着天赋人权的旗帜，认为人的生命不应该被剥夺，而死刑的存在意味着人的生命是不能够随着自然而结束的。

既然人权是天赋的，生来即有，那么就不应该因为犯罪者存在过错就丧失自身的人权。

其次，法律作为治理国家的工具，本身就需要人去运用，是人就会犯错，所以不能否认法律在实施过程中会出现偏差错误。

而死刑一旦在实施过程中出现错误，那后果是无法挽回的

纵使死刑的存在有着一些违背人权、违背人类文明的印记但是现阶段的中国，死刑废不得。

如果一个人犯下严重的暴力行为，而法院没有判处其死刑，民众会认为司法有失公平，失去对法律的信心。

其次死刑对于扼杀犯罪念头有很大的作用。

靠人的自身素质来进行自我约束的条件不充分，如果暴力犯罪不会被剥夺生命，暴力犯罪行为可能会增多
