Article4Loaninterestrate

4.1LoaninterestrateappliesthesameperiodandleveloftheloaninterestratepublishedbythePeople'sBankofChinaasbenchmarkinterestratewithfloatingsee36.10（up/down）see36.11determined,whichdeterminestheannualinterestrateassee36.12.Onthebasisofcertaininterestratesintheborrowingproofrecord,thefollowingcalculationconversionis:

monthlyinterestrate=annualinterestrate/12,dailyinterestrate=annualinterestrate/360.

4.2Ifthebenchmarkinterestisadjustedandappliedtotheloanunderthiscontractbeforetheloangranted,theadjustedbenchmarkinterestisapplicableanditshouldconfirmthenewinterestrateastheArticle4.1.Ifthebenchmarkinterestrateisadjustedaftertheloan,theloaninterestrateshouldbesettledassee36.13ofwaytodealwith:

6.2Eachrepaymentdateisthecorrespondingdateineachtermfortheissuingdaysincethenextmonthoftheissuingday.Iftheloanissuingdatesunderthiscontractisnotthecorrespondingdayoftherepaymentdayasstipulated,theinterestforthefirstperiodandlastrepaymentshouldbecalculatedwiththeactualdaysandinterestrate.

6.4Beforeeachrepaymentday,borrowershoulddepositfullamountofrepaymentintotherepaymentaccountforloanprincipalandinterest,andauthorizethelendertodeducttherepaymentaccordingtothefirstrepaymentaccountIfborrowershasoutstandingloanprincipalandinterestorotherfees,heshouldbetimelydeposittotherepaymentaccount,andauthorizethelenderdeductatanytime.Iftherepaymentaccountmoneyisnotenoughtopaytheduepaymentunderthiscontract,lendershallhavetherighttodecidethepriorityofcost,interest（includingpenaltyinterest,compoundinterest）andprincipal.

6.5Incaseofrepaymentaccountloss,freeze,stoppayment,cancellation,orborrowerneedtochangerepaymentaccount,borrowershouldprocesstherepaymentaccountchangeprocedureatthesiteoflender.Beforethechangetotakeeffect,iftheoriginalrepaymentaccountisunabletofullydeducted,theborrowershouldmaketherepaymentonthecounteratthesiteoflender.Theborrowerfailedtomaketherepaymentaccountchangeproceduretimelyornotinatimelyrepaymentonthecounterwhichleadsnofullamountfortherepaymentprincipalandinterestandotherfees,theborrowershallassumetheliabilityforbreachofcontract.

Article7Repaymentinadvance

7.1Ifborrowerrepaysallorpartoftheloaninadvance,heshouldsubmitawrittenapplicationtothelender15daysbeforetherepaymentdate.

7.2Borrowerrepaymentinadvanceshallmeetthefollowingconditions:

7.3Partoftheadvancedrepaymentshouldbecalculatedwiththeintereststipulatedinarticle4oftheinterestrateandtheactualoccupancydays.Iftheborrowerrepaysallloanprincipalinadvance,heshouldsettlealltheinterest.

7.4Duetotheborrower’advancedrepaymentwhichleadsthechangeofloanterm,theoutstandingpartshouldbecalculatedwiththeloanrateaccordingtothefollowingsee36.24kind:

AAccordingtotheoriginalloaninterest;

BSincethedateofshorteningthetimelimit,theactualloantermloaninterestrateafterchangeisinaccordancewithbenchmarkinterestratesandarticle4.1,theinterestbeforetheshortendeadlinepartwhichhasbeencollectedshallnotberetroactive.

Article8Loanextension

Ifborrowercannotrepaytheloanunderthiscontract,heneedtohandleloanextension.Itshallbemadetothelenderwithawrittenapplication30dayspriortotheexpiryoftheloan.Subjecttoconsentbythelendertoreviewextension,bothpartiesshallsigntheagreementofloanextension.Iflendersdon'tagreetoloanextension,theborrowershouldstillrepaytheloanprincipalandintereststipulatedbythiscontract.

Article9Interestpenalty

9.1Ifborrowerdoesnotrepaytheloanaccordingtothedateofthecontract（includingdeclareddueinadvancedue）,lendershallhavetherighttocollecttheinterestpenaltybydayaccordingtothepenaltyinterestrate.Ifborrowerisunabletopaytheinterest,lendershallhavetherighttocollectthecompoundinterestaccordingtothepenaltyinterestrate.Penaltyinterestrateisstipulatedinarticle4withsee36.25increase.

9.2Ifborrowerdoesnotusetheloanaccordingtocontractagreement,lendershallhavetherighttocollecttheinterestbydayaccordingtothepenaltyinterestrate.Ifborrowerisunabletopaytheinterest,lendershallhavetherighttocollectthecompoundinterestaccordingtothepenaltyinterestrate.Penaltyinterestrateisstipulatedinarticle4withsee36.26increase.

9.3Loaninterestrateisadjustedaccordingtothearticle4.2ofthecontract,andthepenaltyinterestrateisalsoadjustedcorrespondinglyafterinterestrateadjustment.Theadjustmentcycleofpenaltyinterestrateiscorrespondingwiththeadjustmentcycleofinterest.
