第一部分国家的国际不法行为
第一章一般原则
第一条国家对其国际不法行为的责任
国家的每一个国际不法行为都会引起该国的国家责任
第二条国家国际不法行为的构成要件
当行为是由下列作为或者不作为构成的,就产生了国家的国际不法行为:
(1)按照国际法,可归因于该国家;
(2)构成对该国国际义务的违背。
第三条国家的国际不法行为的认定
国家的国际不法行为的认定为国际法所规范。
其认定不受国内法把同一行为认定为合法所影响。
第二章归因于国家的行为
第四条国家机关的行为
(1)任何国家机关的行为在国际法下都应当被看作是该国的行为,不管该机关行使的是立法、行政、司法还是其他职能,不管它在国内政治结构中的地位如何,也不管它是作为中央政府的一个机关还是作为该国地方政府的一个机关。
(2)一个机关包括根据该国国内法具有此种地位的任何个人或实体。

ThedevelopmentofthearticlesonstateresponsibilityoftheInternationalLawCommission(ILC)[FN1]hasbeendescribedelsewhere,inparticularintheILC'sYearbook.Thephasesofdevelopmentofthefirst(1955-1996)andsecond(1998-2001)readingsarewellenoughknown,andthereislittlepointinrepeatingthismaterial.[FN2]Whateverthetrialsandlongueursoftheirproduction,thearticleswiththeircommentariesnowexistandmaybeassessedasawhole.
Thefirstreadingwastheproductofdecadesofworkundersuccessivespecialrapporteurs(RobertoAgo,WillemRiphagen,andGaetanoArangio-Ruiz).Thesecondreadingwasequallyacollectiveprocessandmanymemberscontributedtothefinalresult.AsIwasformallyresponsibleforshapingtheworkonsecondreading,Imaynotbethebestpersontocommentontheoutcome.Anythinglessthanafull-scaledefenseofthetextwillbeseenasanunauthorizedretreat,andifthetextcannotdefenditselfwiththeaidofthecommentaries,itistoolateforindividualstomakeupforanydeficiencies.
Nonetheless,someofthereflectionsinthishelpfulandtimelysymposiumdocallforsomecomment.Ratherthandealwiththecommentssuccessively,Iwilldosothematically,focusingonthequestionsthatnowseemthemostimportant.Aswillbeseen,thesearemostlyquestionsofageneralcharacter.Indeed,thesymposiumisstrikingforthecomparativeabsenceofsuggestionsastohowparticularprovisionscouldhavebeenwordeddifferently--assumingatleastthattheILCwascorrectinlimitingthetexttoissuesofstateresponsibilityandtoinvocationsofthatresponsibilitybystates,amatterdiscussedbyEdithBrownWeissandonetowhichIwillreturn.Furthermore,Iagreewithmuchofwhatissaidhere--intermsofboththedescriptionsofwhatwasdoneandintendedbytheILCand,tosomeextent,thecriticismsofwhatmayhavebeenleftundone--sothatitispossibletobeselective.
Aninitialpointshouldbemade,whichsomeofthecontributorstendtoignore.[FN3]TheILCprocessdidnotoccurinisolation.Inadditiontodebatesintheliterature(someofitappearingintimetobereflectedinthetext),theCommissionreceivedratherregularfeedbackfrom*875governments,throughtheSixthCommitteeandotherwise.Itistruethattheformsofdiscussionfellshortofconsultationprocessesadoptedbynationallawcommissions,andofcoursetheILC'sconsultationswerenotnecessarilyrepresentative.Buttheywerenotnegligible.ThedraftarticlesinthecourseoftheirdevelopmentweresubjectedtoseveralhundredoralcommentsintheSixthCommittee(mostoftheminformallymadeavailableinwriting),aswellasmanyhundredsofpagesofwrittencomments,publishedbytheUnitedNationsSecretariat.Altogether,theprocessofcommentandfeedbackduringthesecondreadingwas,relativelyspeaking,substantial.Severalarticlesowetheirlanguage,andinafewcaseseventheirexistence,[FN4]tocommentsofgovernments.Wheresuggestionswererejected,reasonsweregiven.Overandabovethespecificpointsondrafting,thecommentsconveyedasenseofthesustainablebalanceofthearticlesasawhole,whichwasparticularlysignificantinthelatterstagesofthework.
Moreparticularly,Article54(countermeasuresbystatesotherthaninjuredstates)wasreducedbetween2000and2001fromasubstantivearticletoasavingclauseinresponsetothegeneralviewsofgovernments.Theexclusionofanyformofpunitiveor"exemplary"damages(asatonestageenvisagedforArticle41)resultedfromnearlyunanimouscriticismsofgovernments;thisdecisionhelpedtoconsolidatetheILC'sviewthatformerArticle19(internationalcrimesofstates)shouldbedeleted.
Onthepositiveside,therewaswidespreadsupportintheSixthCommitteeandinwrittencommentsforsuchmattersastheretentionofthearticlesoncountermeasures;thedistinctionbetweeninjuredandotherstates(Articles42and48);thesimplificationofformerchapterIIIofpart1onbreach;andtheconceptofinvocationasthekeyorganizingideainchapterIofpart3.Thefinalbalancestruckinthechapteroncountermeasuresowedmuchtogovernmentcomments,aswellasthedecisiontoretainchapterIVofpart1dealingwithresponsibilityofonestatefortheconductofanother,despitethecriticism(arguablyjustified)thatitdidnotformpartofthesecondaryrulesofresponsibility.
Thesegovernmentcommentsandstatements(manyofthemexpressedbylegaladvisersintheregularweekfortheirattendanceinNewYork)formedpartofaprocessoffeedbackthatparalleledandindeedovershadowedthelessdirectandmoresubtle"feedbackloop"withtheInternationalCourtofJustice.[FN5]Suchopinionscannotsimplybemanipulated.ThefactthatgovernmentcommentswerecarefullytakenintoaccountmaywellhaveplayedaroleintherelativelybenignreceptionofthearticlesbytheSixthCommitteeatthefifty-sixthsessionoftheUNGeneralAssemblyinOctober2002,andintherapidadoptionoftheAssembly'sResolution56/83.Ofmorethanfiftygovernments[FN6]thatexpressedviewsinthedebate,onlytwo(MexicoandGuatemala)madecriticismsofsuchakindastoimplyrejectionoftheILC'sproposals--andtheydidsointermsofapreferenceforanimmediatediplomaticconferenceratherthanoutrightrejectionofthetext.Neitherofthesepossibilities,however,stoodanychanceofacceptancebytheSixthCommittee,andtherewaslittlesupportevenforadeferralofaresolutiontothefollowingyear.Astheeditorsofthissymposium,DanielBodanskyandJohnCrooknote,Resolution56/83leavesopenthequestionoftheformofthearticles,inaccordancewiththeILC'srecommendation.[FN7]Itannexesthearticles(theterm"draft"isdeleted)andcommendsthemtotheattentionofgovernments.TheGeneralAssemblydidnoless(andnomore)thantheILChadhoped,anddiditwithremarkablepromptness.
*876Againstthisbackground,Iproposefirsttomentioncertainissuesregardingthecontentofthearticles,andthen,atrathergreaterlength,todiscusssomeofthequestionsraisedabouttheircharacterandfuture.
I.THECONTENTOFTHEARTICLES
TheDistinctionBetweenPrimaryandSecondaryObligationsasanOrganizingDevice
Aninitialpointconcernsthedistinctionbetweenprimaryandsecondaryobligationsasthecentralorganizingdeviceofthearticles.Thisapproach,ofcourse,goesbacktoAgo,and(uniquely)heiscitedinthecommentarybyname,andhisownexpressionofthedistinctionquotedwithapproval:
"[I]tisonethingtodefinearuleandthecontentoftheobligationitimposes,andanothertodeterminewhetherthatobligationhasbeenviolatedandwhatshouldbetheconsequencesoftheviolation."[FN8]Tobeprecise,thekeyideaisthatabreachofaprimaryobligationgivesrise,immediatelybyoperationofthelawofstateresponsibility,toasecondaryobligationorseriesofsuchobligations(cessation,reparation...).Thearticlesspecifythedefaultrulesthatdeterminewhenabreachoccursand,ingeneral,thecontentoftheresultingsecondaryobligations.Intheirfinalformthe
