AbbreviatedExpressions

Article1

IntheseRules:

"Determination"meansthedecisionissuedbytheExpertinaccordancewithArticle17oftheseRulesonthematterreferredtoexpertdetermination;

"Expert"meansasoleExpertoralltheExpertswheremorethanoneisappointed;

"ExpertDeterminationAgreement"meansanagreementbythepartiestosubmittoexpertdeterminationallorcertainmatterswhichhavearisenorwhichmayarisebetweenthem; anExpertDeterminationAgreementmaybeintheformofanexpertdeterminationclauseinacontractorintheformofaseparatecontract;

"WIPO"meanstheWorldIntellectualPropertyOrganization;

"Center"meanstheWIPOArbitrationandMediationCenter.

Wordsusedinthesingularincludethepluraland viceversa,asthecontextmayrequire.

ScopeofApplicationofRules

Article2

WhereanExpertDeterminationAgreementprovidesforexpertdeterminationundertheWIPOExpertDeterminationRules,theseRulesshallbedeemedtoformpartofthatExpertDeterminationAgreement.Unlessthepartieshaveagreedotherwise,theseRulesasineffectonthedateofthecommencementoftheexpertdeterminationshallapply.

CommunicationandPeriodsofTime

Article3

（a）Unlessthepartieshaveagreedotherwise,ortheCenterortheExperthasdeterminedotherwise,anynoticeorothercommunicationthatmaybeorisrequiredtobegivenundertheseRulesshallbe:

（i）inwritingandshallbedeliveredbyexpeditedpostalorcourierservice,e-mailorothermeansofcommunicationthatprovidearecordthereof;and

（ii）copiedtoeachotherparty,theExpertandtheCenter.

（b）ForthepurposeofcalculatingaperiodoftimeundertheseRules,suchperiodshallbegintorunonthedayfollowingthedaywhenanoticeorothercommunicationisreceived.Ifthelastdayofsuchperiodisanofficialholidayoranon-businessdayattheresidenceorplaceofbusinessoftheaddressee,theperiodisextendeduntilthefirstbusinessdaywhichfollows.Officialholidaysornon-businessdaysoccurringduringtherunningoftheperiodoftimeareincludedincalculatingtheperiod.

（c）Anoticeorothercommunicationshallbedeemedtohavebeenreceivedonthedayitisdeliveredinaccordancewithparagraph（a）ofthisArticle.

（d）Forthepurposeofdeterminingcompliancewithatimelimit,anoticeorothercommunicationshallbedeemedtohavebeensent,madeortransmittedifitisdispatched,inaccordancewithparagraph（a）ofthisArticle,priortooronthedayoftheexpirationofthetimelimit.

（e）TheCenterortheExpertmay,attherequestofapartyoronitsownmotion,extendperiodsoftimefixedbytheseRules.

LanguageofExpertDetermination

Article4

（a）Unlessotherwiseagreedbytheparties,thelanguageoftheexpertdeterminationshallbethelanguageoftheExpertDeterminationAgreement,subjecttothepoweroftheExperttodetermineotherwise,havingregardtoanyobservationsofthepartiesandthecircumstancesoftheexpertdetermination.

（b）TheExpertmayorderthatanydocumentssubmittedinlanguagesotherthanthelanguageoftheexpertdeterminationbeaccompaniedbyatranslationinwholeorinpartintothelanguageoftheexpertdetermination.

RequestforExpertDetermination

Article5

（a）ApartytoanExpertDeterminationAgreementthatwishestocommenceanexpertdeterminationshallsubmitaRequestforExpertDeterminationtotheCenter.ItshallatthesametimesendacopyoftheRequesttotheotherparty.TheRequestforExpertDeterminationmayalsobejointlyfiledbythepartiestotheExpertDeterminationAgreement.

（b）TheRequestforExpertDeterminationshallcontainorbeaccompaniedby:

（i）thenames,addressesandtelephone,e-mailorothercommunicationreferencesofthepartiestotheexpertdeterminationandofanyrepresentativeofthepartyfilingtheRequestforExpertDetermination;

（ii）acopyoftheExpertDeterminationAgreement;

（iii）adescriptionofthematterreferredtoexpertdetermination;

（iv）anindicationofanyrightsandthenatureofanytechnologyinvolved;

（v）anydocumentsorotherinformationwhichthepartydeemsrelevanttotheDetermination;

（vi）observationsonthescopeandtimeframeoftheexpertdetermination;

（vii）ifthepartieshaveagreedontheappointmentofaparticularExpert,thename,addressandtelephone,e-mailorothercommunicationreferencesoftheExpert; ifthepartieshavenotagreedontheappointmentofaparticularExpert,observationsontheexpectedqualificationsoftheExpert;

（viii）informationonanylegalorotherdisputeresolutionproceedingscommencedorterminatedinconnectionwiththematterreferredtoexpertdetermination;and

（ix）paymentoftheadministrationfeeinaccordancewithArticle21.

Article6

（a）IntheabsenceofanExpertDeterminationAgreement,apartythatwishestoproposesubmittingadisputetoexpertdeterminationshallsubmitaRequestforExpertDeterminationinwritingtotheCenter.ItshallatthesametimesendacopyoftheRequestforExpertDeterminationtotheotherparty.TheRequestforExpertDeterminationshallincludetheparticularssetoutinArticle5（b）（i）and（iii）to（viii）.TheCentermayassistthepartiesinconsideringtheRequestforExpertDetermination.

（b）Uponrequestbyaparty,theCentermayappointanexternalneutraltoassistthepartiesinconsideringtheRequestforExpertDetermination.TheexternalneutralmayactasExpertinthedisputeprovidedallpartiesagree.Article16shallapply mutatismutandis.

DateofCommencementofExpertDetermination

Article7

（a）ThedateofcommencementoftheexpertdeterminationshallbethedateonwhichtheRequestforExpertDeterminationisreceivedbytheCenter.

（b）TheCentershallinformthepartiesinwritingofthereceiptbyitoftheRequestforExpertDeterminationandofthedateofcommencementoftheexpertdetermination.

AnswertotheRequest

Article8

（a）WhenaRequestforExpertDeterminationisnotjointlyfiledbytheparties,thepartythathasnotfiledtheRequestmaysubmit,within14calendardaysofthedateofcommencementoftheexpertdetermination,anAnswertotheRequest.

（b）TheAnswertotheRequestshallreplytotheparticularsoftheRequestforExpertDeterminationandshallbeaccompaniedbyanyadditionaldocumentsorotherinformationwhichthepartydeemsrelevanttotheDetermination.

AppointmentofExpert

Article9

（a）UnlessthepartieshaveagreedthemselvesonthepersonoftheExpert,theCentershallproceedtoappointtheExpertuponreceiptoftheAnswertotheRequestorthelapseofthetimeperiodforthesubmissionofsuchAnswer.WhenaRequestforExpertDeterminationisjointlyfiledbytheparties,andthepartieshavenotagreedthemselvesonthepersonoftheExpert,theCentershallproceedtoappointtheExpertuponreceiptoftheRequestforExpertDetermination.

（b）WherethepartieshavenotagreedonthenumberofExperts,theCentershallappointasoleExpert,exceptwheretheCenterinitsdiscretiondeterminesthat,inviewofallrelevantcircumstances,morethanoneExpertisappropriate.

（c）UnlessthepartieshaveagreedthemselvesonthepersonoftheExpertoronanotherprocedureforappointingtheExpert,theExpertshallbeappointedbytheCenterafterconsultationwiththeparties.

（d）TheCenter’sappointmentoftheExpertwillhaveregardto,withoutlimitation:

（i）anyviewsexpressedbytheparties;

（ii）thematteronwhichtheDeterminationissought;

（iii）theExpert’srelevantexpertise;

（iv）theabilityoftheExperttocompletetheexpertdeterminationwithdueexpedition;

（v）thelanguageoftheexpertdetermination;

（vi）theplaceandnationalityoftheExpertandtheparties.

（e）Forthepurposesofparagraph（d）（i）ofthisArticle,theCentermaycommunicatetothepartiesthedetailsofoneormorecandidatesforappointmentandinvitepartiestocommunicatetheirviews.

（f）TheExpertshall,byacceptingappointment,bedeemedtohaveundertakentomakeavailablesufficienttimetoenabletheexpertdeterminationtobecompletedwithdueexpedition.

ImpartialityandIndependence

Article10

（a）TheExpertshallbeimpartialandindependent.

（b）TheprospectiveExpertshall,beforeacceptingappointment,disclosetothepartiesandtheCenteranycircumstancesthatmightgiverisetojustifiabledoubtastotheExpert’simpartialityorindependence,orconfirminwritingthatnosuchcircumstancesexist.

（c）If,atanystageduringtheexpertdetermination,newcircumstancesarisethatmightgiverisetojustifiabledoubtastotheExpert’simpartialityorindependence,theExpertshallpromptlydisclosesuchcircumstancestothepartiesandtheCenter.

（d）Unlessrequiredbyacourtoflaworauthorizedinwritingbytheparties,theExpertshallnotactinanycapacitywhatsoever,otherwisethanasanExpert,inanypendingorfutureproceedings,whetherjudicial,arbitralorotherwise,relatingtothematterreferredtoexpertdetermination.

ChallengeofExpert

Article11

（a）TheExpertmaybechallengedbyapartyifcircumstancesexistthatgiverisetojustifiabledoubtastotheExpert’simpartialityorindependence.

（b）ApartychallenginganExpertshallsendnoticeofthechallenge,statingthereasonsforthechallenge,withinsevencalendardaysafterbeingnotifiedoftheExpert’sappointmentorafterbecomingawareofthecircumstancesunderlyingsuchchallenge.

（c）TheExpertortheCentermay,initsdiscretion,suspendorcontinuetheexpertdeterminationduringthependencyofthechallenge.

（d）IftheExpertischallengedbyaparty,andtheotherpartydoesnotagreetothecha
