Chapter1GeneralProvisions
Article1ThisLawisformulatedforthepurposeofimprovingtheadministrationoftrademarks,protectingtherighttoexclusiveuseoftrademarksandencouragingproducersandoperatorstoguaranteethequalityoftheirgoodsandservicesandmaintainthereputationoftheirtrademarks,soastoprotecttheinterestsofconsumersandofproducersandoperators,andtopromotethedevelopmentofthesocialistmarketeconomy.
Article2TheTrademarkOfficeoftheadministrativedepartmentforindustryandcommerceundertheStateCouncilshallbeinchargeofthetrademarkregistrationandadministrationthroughoutthecountry.
TheadministrativedepartmentforindustryandcommerceundertheStateCouncilshallestablishaTrademarkReviewandAdjudicationBoardtoberesponsibleforhandlingtrademarkdisputes.
Article3RegisteredtrademarksarethosethathavebeenapprovedandregisteredbytheTrademarkOffice,includingcommoditytrademarks,servicetrademarks,collectivemarksandcertificationmarks;trademarkregistrantsshallbeentitledtotherighttoexclusiveuseoftheirtrademarksandshallbeprotectedbylaw.
CollectivemarksusedinthisLawshallrefertothemarksthatareregisteredinthenameofgroups,associationsorotherorganizationsandthatareprovidedtothemembersofthesaidorganizationsforbusinessactivityuse,thustoindicatethemembershipoftheusersinthesaidorganizations.
CertificationmarksusedinthisLawshallrefertothemarksthatarecontrolledbytheorganizationswithsupervisingpoweroversomekindofcommoditiesorservicesyetareusedbytheunitsorindividualsapartfromthesaidorganizationsontheircommoditiesorservices,thustocertificatetheorigins,rawmaterials,manufacturingmethods,qualityorotherspecificcharacteristicsofthesaidcommoditiesorservices.
ThespecialmattersconcerningtheregistrationandadministrationofcollectivemarksandcertificationmarksshallbeprovidedforbythedepartmentforindustryandcommerceundertheStateCouncil.
Article4Anynaturalperson,legalpersonorotherorganizationthatneedstoacquiretherighttoexclusiveuseofatrademarkforthecommoditiesitproduces,manufactures,processes,selectsormarketsshallfileanapplicationforcommoditytrademarkregistrationwiththeTrademarkOffice.
Anynaturalperson,legalpersonorotherorganizationthatneedstoacquiretherighttoexclusiveuseofatrademarkfortheserviceitemsitprovidesshallfileanapplicationforservicetrademarkregistrationwiththeTrademarkOffice.
TheprovisionsofthisLawrelatingtocommoditytrademarksshallbeapplicabletotheservicetrademarks.
Article5Twoormorenaturalpersons,legalpersonsorotherorganizationsmayjointlyapplytotheTrademarkOfficefortheregistrationofthesametrademark,andenjoyandexercisetherighttoexclusiveuseofthattrademarkjointly.
Article6Withrespecttothecommoditiesthatthestatehasdesignatedasrequiringtheuseofaregisteredtrademark,anapplicationfortrademarkregistrationmustbefiled;thecommoditiesmaynotbesoldonthemarketbeforetheregistrationisgranted.
Article7Theuserofatrademarkshallberesponsibleforthequalityofthecommoditiesonwhichthetrademarkisused.Theadministrativedepartmentsforindustryandcommerceatalllevelsshall,bymeansoftrademarkadministration,stopanypracticesthatdeceivetheconsumers.
Article8Anapplicationfortrademarkregistrationmaybefiledforanyvisiblemarkincludingword,design,letter,number,3D(three-dimension)markorcolorcombination,orthecombinationoftheelementsabovementioned,thatcandistinguishthecommoditiesofthenaturalperson,legalpersonorotherorganizationfromthoseofothers.
Article9Thetrademarkforwhichanapplicationforregistrationisfiledshallhavedistinctivecharacteristicseasytoidentify,andmaynotconflictwiththelegalrightsacquiredbyothersinpriority.
Atrademarkregistranthastherighttomarkthewords“Registeredtrademark”orasignindicatingthatthetrademarkisregistered.
Article10Thefollowingmarksmaynotbeusedastrademarks:
1)thoseidenticalwithorsimilartothenationalname,nationalflag,nationalemblem,militaryflagormedalsofthePeople’sRepublicofChina,aswellasthoseidenticalwiththenamesofthespecificsitesorthenamesanddesignsofthesymbolbuildingsoftheplaceswherethecentralgovernmentagenciesarelocated;
2)thoseidenticalwithorsimilartothenationalname,nationalflag,nationalemblemormilitaryflagofanyforeigncountry,exceptwiththeconsentofthegovernmentofthatcountry;
3)thoseidenticalwithorsimilartothename,flag,oremblemofanyintergovernmentalinternationalorganization,exceptwiththeconsentofthatorganizationandthoseunlikelytomisleadthepublic;
4)thoseidenticalwithorsimilartotheofficialmarks,inspectionmarksthatindicatethecontrollingorprovidingguarantee,exceptwithauthorization;
5)thoseidenticalwithorsimilartothenameorsymboloftheRedCrossortheRedCrescent;
6)thosehavingthenatureofdiscriminationagainstanynationality;
7)thoseconstitutingexaggeratedadvertisingandaredeceitful;and
8)thosedetrimentaltosocialistmoralityorcustoms,orhavingotherharmfulinfluences.
Theplacenamesoftheadministrativedistrictsatthelevelofcountyoraboveortheforeignplacenamesknownbythepublicmaynotbeusedastrademarks.However,theplacenamesthathaveothermeaningsandthoseusedaspartofacollectivemarkorcertificationmarkareexceptional;theregisteredtrademarksthatuseplacenamesshallcontinuetobevalid.
Article11Thefollowingmarksmaynotberegisteredastrademarks:
1)thoseonlyhavingthegenericnames,designsandmodelsofthecommoditiesconcerned;
2)thosesimplydirectlyindicatingthequality,mainrawmaterials,functions,use,weight,quantityorothercharacteristicsofthecommoditiesconcerned;and
3)thoselackingdistinctivecharacteristics.
Ifthemarkslistedintheprecedingparagraphhave,throughusage,obtaineddistinctivecharacteristicsandcanbeeasilyidentified,theymayberegisteredastrademarks.
Article12Incaseofapplicationfortrademarkregistrationon3Dmarks,theregistrationshallnotbegrantedifthefiguresaregeneratedsimplybythenatureofthecommodities,thecommodityfiguresareneededfortechnicaleffectsorthefiguresmakethecommoditiesbecomesubstantiallyvaluable.
Article13Ifatrademark,forwhichanapplicationforregistrationisfiled,ofthesameorsimilarcommodityisthecopy,imitationortranslationofawell-knowntrademarkofotherswhichhasn’tbeenregisteredinChina,andislikelytocauseconfusion,itshallnotberegisteredandshallbeprohibitedfromuse.
Ifatrademark,forwhichanapplicationforregistrationisfiled,ofadifferentordissimilarcommodityisthecopy,imitationortranslationofawell-knowntrademarkofotherswhichhasbeenregisteredinChina,andmisleadsthepublicandleadstopossibledamagetotheinterestsoftheregistrantofthatwell-knowntrademark,itshallnotberegisteredandshallbeprohibitedfromuse.
Article14Thefollowingfactorsshallbetakenintoconsiderationinthedeterminationofwell-knowntrademarks:
1)howwellisthattrademarkknownbytherelevantpublic;
2)theperiodduringwhichthattrademarkhasbeeninuse;
3)theperiod,extentandgeographicscopeofanypublicityofthattrademark;
4)therecordofprotectionofthattrademarkasawell-knowntrademark;and
5)otherfactorsforwhichthattrademarkiswell-known.
Article15Ifanagentorarepresentativeregistersthetrademarkoftheprincipalortherepresentedinhis/herownnamewithoutauthorization,thetrademarkshallnotberegisteredandshallbeprohibitedfromuseupontheoppositionraisedbytheprincipalortherepresented.
Article16Ifatrademarkcontainsthegeographicmarkofthecommoditieswhilethecommoditiesdon’tcomefromtheregionindicatedbythatmark,andthusmisleadsthepublic,thetrademarkshallnotberegisteredandshallbeprohibitedfromuse;however,thosethathavebeenregisteredingoodfaithshallcontinuetobevalid.
Thegeographicmarkmentionedintheprecedingparagraphreferstothemarkthatindicatestheregionthecommoditiescomefrom.Andthespecificquality,reputationorothercharacteristicsofthesaidcommoditiesaredeterminedmainlybythenaturalfactorsorhumanculturalfactorsofthatregion.
Article17WhereaforeigneroraforeignenterpriseappliesfortrademarkregistrationinChina,themattershallbehandledinaccordancewithanyagreementconcludedbetweenthecountrytowhichtheapplicantbelongsandthePeople’sRepublicofChina,oranyinternationaltreatytowhichbothcountriesareparties,oronthebasisoftheprincipleofreciprocity.
Article18WhereaforeigneroraforeignenterpriseappliesfortrademarkregistrationordealswithothertrademarkmattersinChina,itshallentrustanorganizationcertifiedb
