federalsuit/case:

联邦法案件。

美国是联邦制国家,除联邦的司法系统和法律外,各州有自己的司法体系和法律。

如州法律与联邦法律相矛盾,则以联邦法律为准。

以联邦法律为依据提起的讼案(即指称被告违反联邦法的案件),称为“federalsuit”或“federalcase”。

课文中Bilott代表Tennant依据联邦法律(如ToxicSubstancesControlAct)提起诉讼,所以称为联邦法案件。

ToxicSubstancesControlAct(TSCA):

《有毒物质控制法》。

该法案1976年经美国国会通过,由环境保护局(EnvironmentalProtectionAgency)执行。

其中规定在化学新产品投产前,厂商必须通知E.P.A.,提供有关信息,由后者判定是否禁止或限制该产品的生产。

由于不要求厂商必须首先通过安全性测试确定产品无害,该法案被很多人认为是一个“没有牙齿”的法案。

EPA:

Teflon:

aregisteredtrademarkofTheChemoursCompany(formerlyDuPont)whichitusesforitsrangeoffluoropolymers,thebestknownofwhichispolytetrafluoroethylene(PTFE).Itprovidesaverysmoothsurfacewhichfooddoesnotstickto,soitisoftenusedtocoatpans.特富龙是科慕公司(由杜邦公司剥离而出)使用在其一系列氟聚合物产品上的注册商标,其中最有名的是聚四氟乙烯。

✓Beforetacklingaparagraph,haveastudentreadaloudtheparagraphfirst,andthencorrectthemispronouncedwords(ifany).HaveSsreadafteryouthenewwordswhicharelikelytobemispronounced

✓Givecontextualexplanationsofwords,phrases,andsentenceswhereyoudeemnecessary.Atthisstage,focusisonunderstandinginsteadofusage.

1.Take,forexample,thesentenceinPara.I"Tennanthadtriedtoseekhelplocally,butDuPontjustaboutownedtheentiretown"Takenoutofcontext,thetwoclausesofthissentencedonotseemwellconnected.However,thenextsentence"HehadbeenspurnednotonlybyParkersburg'slawyers…"offersacluetounderstandingthesecondpart:

EveryoneseemedtobeworkingforDuPont,andnoonewaswillingtohelpTennant.Thisshowsthatwordsacquirespecificmeaningswhenputinaspecificcontext,andifoneisnotsureofwhataparticularsentenceorwordmeans,heorshemaywelljustreadonandprobablythenextsentenceexplainseverything.

2.Often,thesamewordmeansdifferentthingsindifferentcontexts.Comparethefollowingsentencesandtellwhattheword“right”meansineachofthem:
