TheseregulationsmaybecitedasthePublicHealth（AnimalsandBirds）（Exhibitions）Regulations.

Cap139Freg2Interpretation

（1）Intheseregulationsunlessthecontextotherwiserequires-

"exhibitionofanimalsorbirds"（动物或禽鸟展览）meansanexhibitionofanimalsorbirdstowhichthepublicareadmittedonpaymentofafeeorothermoneyconsideration;

"housingfacility"（畜舍设施）meansaroom,building,premisesorotherplaceusedtocontainaprimaryenclosure;

"licence"（牌照）meansalicencegrantedorrenewedunderregulation4;

"outdoorarea"（户外范围）meansanoutdoorareaorspace,whethercontainingaprimaryenclosureornot,usedforthekeeping,exerciseorcontainmentofanimalsorbirds;

"permit"（许可证）meansapermitissuedunderregulation8;

"primaryenclosure"（基本围封物）meansaroom,pen,cage,compartment,hutchorstructureusedtorestrictanimalsorbirdstoalimitedamountofspace;

"sanitary"（卫生）meansphysicallycleanandfreefromagentswhichareinjurioustohealthandfromanyotherobnoxiousoroffensivematerial.

（2）Forthepurposesoftheseregulations,apersonholdsanexhibitionofanimalsorbirdsifhehascontrolormanagementoftheplaceatwhichtheanimalsorbirdsarekeptforthepurposeofexhibition.

Cap139Freg3Prohibitionofexhibitinganimalsorbirdswithoutlicenceorpermit

Nopersonshallholdanexhibitionofanimalsorbirdssaveunderandinaccordancewithalicencegrantedorapermitissuedundertheseregulations.

Cap139Freg4PowerofDirectortograntlicence

（1）UponapplicationintheformspecifiedbytheDirector,theDirectormaygrantalicencetoanypersontoholdapermanentexhibitionofanimalsorbirdsandmayrenewanysuchlicence.

（2）Alicenceshallnotbegrantedorrenewedunless-

（a）theDirectorhasinspectedandapprovedtheplaceatwhichtheexhibitionistobeheld;and

（b）theDirectorissatisfiedthattheprimaryenclosures,housingfacilitiesandoutdoorareasinwhichtheanimalsorbirdsaretobekeptconformwiththestandardsspecifiedunderregulation5.（3）TheDirectormayattachtoalicencesuchconditionsashemaythinkfit.

（4）Alicenceshallbevalidforaperiodof12monthsbeginningonthedateitisgranted.（L.N.411of1990）

（5）Thefeeforalicenceshallbe$10720.（L.N.411of1990;L.N.47of1995;L.N.208of1996;L.N.525of1997）

（6）Alicenceshallspecify-

（a）theresidentialaddressofthepersonlicensedtoholdtheexhibition;

（b）theaddressoftheplaceatwhichtheexhibitionmaybeheld;and

（c）theplaceatwhichtheanimalsorbirdsforthepurposeofexhibitionmaybekept.

Cap139Freg5Standardsofprimaryenclosuresetc.

（1）Aprimaryenclosureshallbe-

（a）structurallysoundandmaintainedingoodrepair;

（b）designedsoastocontaintheanimalsorbirdskeptthereinandtoprotectthemfrominjuryandpredators;

（c）constructedandmaintainedsoastoenabletheanimalsorbirdscontainedthereinto-

（i）remaindryandclean;

（ii）haveconvenientaccesstofoodandwater;and

（iii）moveaboutfreelyandtostand,sit,lieandperchcomfortably;and（d）locatedsoastoavoidexcessiveillumination.

（2）Housingfacilitiesshall-

（a）bestructurallysoundandmaintainedingoodrepair;

（b）bedesignedsoastocontaintheanimalsorbirdskeptthereinandtorestricttheentranceofotheranimalsorbirds;

（c）containanadequatesupplyofpotablewaterandsuitabledrainagefortheescapeofexcesswater;

（d）providesufficientspaceforthestorageoffreshfoodandbedding;

（e）providefortheremovalanddisposalofanimalandfoodwaste,usedbedding,deadanimalsorbirdsanddebristominimizeinfestation,contamination,odoursandtheriskofdisease;

（f）beprovidedwithsufficientfreshairventilationbymeansofwindows,doors,ventsorairconditioning,topromotethehealthandcomfortoftheanimalsorbirdskeptthereinandtominimizedraughts,odoursandmoisturecondensation;

（g）haveamplelightingbynaturalorartificialmeansorboth,ofgoodqualityandsodistributedastoprovidesufficientlightintensitytopermitroutineinspectionandcleaning;and

（h）containinteriorsurfaceswhicharesubstantiallyimpervioustomoistureandmaybesanitarilycleanedatalltimes.（3）Anoutdoorareashallprovide-

（a）sufficientshadetoenabletheanimalsorbirdstoprotectthemselvesfromthedirectraysofthesun;

（b）adequatesheltertoallowtheanimalsorbirdsprotectionininclementweather;

（c）suitabledrainagefortheescapeofexcesswater.

Cap139Freg6Licenseenottomakechangestoprimaryenclosuresetc.andnottokeepanimalsorbirdselsewhere

ExceptwiththepriorconsentoftheDirector,nopersontowhomalicencehasbeengrantedshall-

（a）makeorcauseorpermittobemadeanymaterialchangetotheprimaryenclosures,housingfacilitiesoroutdoorareasinwhichtheanimalsorbirdsforexhibitionaretobekept;or

（b）keeporcauseorpermittobekeptanyanimalorbirdtobeexhibited,ataplaceotherthantheplacespecifiedinhislicence.

Cap139Freg7Husbandryandsanitation

Exceptasmayreasonablybejustifiedforthepurposeofveterinarytreatment,apersontowhomalicencehasbeengrantedshallcomplywiththefollowingrequirements-

（a）theanimalsorbirdsshallbefedatleastoncedailywithwholesome,palatableandnutritiousfoodwhichshallbeofsufficientquantitytomeetthenormaldailyrequirementsoftheanimalsorbirds,havingregardtotheirspecies,sizeandcondition;

（b）allfoodandwaterreceptaclesfortheanimalsorbirdsshallbe-

（i）readilyaccessibletotheanimalsorbirds;

（ii）solocatedastominimizecontaminationbyexcretaorotherwise;

（iii）cleanedatregularintervalssoastobekeptinasanitaryconditionatalltimes;and

（iv）keptingoodconditionatalltimes;（c）theanimalsorbirdsshallbesuppliedwithadequateandpotablewaterand,ifnoconstantsupplyofpotablewaterisavailable,theyshallbesuppliedwithpotableliquidatleasttwicedailyforaperiodofnotlessthanonehoureachtime;

（d）allexcretaandotherwastemattershallberemovednotlessthanoncedailyfromtheplaceatwhichtheanimalsorbirdsarekept;

（e）theprimaryenclosures,housingfacilitiesandoutdoorareasshallbemaintainedinasanitarycondition;

（f）aprogrammeforthecontrolanddestructionofinsects,ectoparasites,avianandmammalianpestsattheplaceatwhichtheanimalsorbirdsarekeptshallbeestablishedandmaintainedtothesatisfactionoftheDirector;

（g）animalsorbirdsshallnotbehousedinthesameprimaryenclosureunlesstheyareofthesameoracompatiblegenus;and

（h）notwithstandingthattheanimalsorbirdsareofthesameoracompatiblegenus-

（i）femalesinseason（oestrus）shallnotbehousedinthesameprimaryenclosurewithmalesexceptforbreedingpurposes;and

（ii）theyshallbehousedindividuallyinseparateprimaryenclosuresiftheyareofviciousdisposition.

Cap139Freg8PowerofDirectortograntpermit

（1）UponapplicationintheformspecifiedbytheDirector,theDirectormayissueapermittoanypersontoholdatemporaryexhibitionofanimalsorbirds.

（2）Apermitissuedunderparagraph

（1）shallnotbevalidforaperiodofmorethanonemonthfromthedateofissue.

（3）TheDirectormayattachtoapermitsuchconditionsashemaythinkfit.

（4）Thefeeforapermitshallbe$1380.（L.N.75of1988;L.N.292of1988;L.N.404of1989;L.N.47of1995;L.N.208of1996;L.N.525of1997）

（5）Apermitshallspecify-

（a）theparticularsofthepersontowhomthepermitisissued;

（b）theplaceatwhichtheexhibitionmaybeheld;and

（c）theplaceatwhichtheanimalsorbirdsforthepurposeofexhibitionmaybekept.

Cap139Freg9Offencesandpenalties

（1）Anypersonwhocontravenesregulation3shallbeguiltyofanoffenceandshallbeliableonconvictiontoafineof2000dollars.

（2）Anypersontowhomalicencehasbeengrantedwhocontravenes-

（a）anyconditionattachedtohislicence;or

（b）regulation6or7,shallbeguiltyofanoffenceandshallbeliableonconvictiontoafineof1000dollars.

（3）Anypersontowhomapermithasbeenissuedwhocontravenesanyconditionattachedtohispermitshallbeguiltyofanoffenceandshallbeliableonconvictiontoafineof1000dollars.
