TobettersafeguardtheBuyer’sandtheSeller’slegitimaterightsandinterests,theBuyerandtheSellerareexpectedtoreadthroughthefollowingcontentscarefullybeforeconcludingthiscontract..
1.Thetextofthiscontractisautomaticallygeneratedthroughthe“OnlineTransactionSystemforSecond-handRealEstateinShenzhen”.Thecontractingpartiescan,aftermutualagreement,makemodificationorsupplementationtoitemsspecifiedintheContract,butsuchmodificationandsupplementationmustbeinconformitywiththerelevantprovisionsstipulatedinlawsandrules.
2.Priortoenteringthiscontract,theBuyerandtheSellermayrequesttheotherpartytoshowhisorherrelevantcertificates,suchasIDcard,BusinessLicenseofEnterpriseLegalPerson,HouseOwnershipCertificate,etc.Theyshallcarefullyreadthroughthecontentsofthiscontractandthenmakeconfirmationsabouttheitemsselected,supplemented,ormodified.Ifyouhaveanyquestions,pleaseaskforprofessionaladvicefrompeoplefamiliarwithlawsandlegislations.
3.TheBuyershall,priortoenteringintothiscontract,makeacompleteandfullsitesurveyoverthehousepropertyinrespectoftheenvironment,transportation,adjacentschools,opportunitytoattendschools,andhouseholdconditions.TheSellerisobligatedtoprovidetrueinformationaboutthehouseproperty’sownership,leasecondition,household,etc.
4.Forthepurposeofassuringthesafetyofthecapital,itisrecommendedthattheBuyerandtheSellershallhaveathirdpartysupervisethefundsbyconcludingaspecialagreementtoclearlyspecifythecapitalsupervisionaccountandtheothermattersaboutpaymentoffunds.
5.Afterthiscontractcomesintoeffect,theunmodifiedandprintedwordsaswellasthevalidwritingsandmarksfilledoutintheblanksshallbedeemedascontentsagreedbybothparties.Inaddition,theattachmentsandthesupplementaryagreementsofthiscontract,oncesignedbybothparties,shallhavethesamelegalforceasthetextofthiscontract.
6.WheretheBuyerneedstoborrowamortgageloantopaythepriceofthehouseproperty,heorsheshallfirstofallgettoknowexactlyabouttherequirementsformortgageloanaswellasthedocumentstobeprovided.
7.Thetransferofownershipisnotmarkedbytheconclusionofthiscontract,butbytheregistrationofownershiptransferbyhousepropertyrightregistrationorgan.Asittakestimetotransfertheownershipafterconcludingthiscontract,theremaybespecialconditionslikesealingupofhouseproperty,pleasepayattentiontothepossiblerisksinthetransaction.

ThehouseownershipcertificateNo.isXXX;thehousepropertyisusedforthepurposeofResidence.
Theregisteredconstructionareais:
84.12squaremeters;theroombuildingareais---squaremeters.
ThelanduserightrelatingtothehousepropertyfeaturesatermfromOctober17,1984toOctober16,2054.ThehousepropertyiscompletedinJuly1984.
Currentlythehousepropertymanagementcompanyis------------------;thepropertymanagementfeeisRMB----/squaremeter.
Article2[CurrentStatusofHouseProperty]
Thehousepropertyisneithermortgagednorsealedup;theSellerenjoysfullrighttodisposethehouseproperty.
Article3[LeaseConditionofHouseProperty]
Theleaseconditionofthehousepropertyisasthefollowing1condition:
1.Thehousepropertyisnotleasedtoanybody.
2.Thehousepropertyisleasedtosomeone;pleaserefertotheattachmentsfortheleasecontract(No.------).ThemonthlyrentalisRMB---/month;theleasetermis---yearsfrom----to---.TheSellershall,beforesigningonthiscontract,obtainthelessee’swrittenacknowledgementofgivinguptheprioritytobuythehouseproperty;otherwiseitshallbedeemedasviolationofthecontract.Afterconsultation,theSellerandtheBuyerdecidetodealwiththeleasecontractinthefollowing----ways:

TheSellerhaspromisedtotransferoutthehouseholdaffiliatedtothehousepropertywithin30daysafterreceivingthetotalpaymentforthehouseproperty.Iftheyfailtodosowithinthetimelimit,theyshallpaytheBuyerliquidateddamagesat0.03%ofthetotalhousetransferpriceonadailybasis.
Article5[TransferPriceofHouseProperty]
ThetransferpriceofthehousepropertyisRMBThirty-sixThousand,FiveHundredandForty-fiveYuanonly(innumber:
36545);itdoesnotincludethetaxes.
Article6[EarnestMoney]
TheearnestmoneyforthetransactionofthepropertyisRMBFiveThousandYuanonly(innumber:
RMB5000).TheSelleragreesthatitshallbepaidinthefollowingways:
Uponconclusionofthiscontract,theBuyershallpaytheSellertheearnestmoneyofRMBFiveThousandYuanonly(RMB5,000).
ItisrecommendedthattheBuyershallfirstgivetheearnestmoneytoamutuallyspecifiedthirdpartyforsupervision.TheBuyer’spayingtheearnestmoneytothethirdpartyforsupervisionshallbedeemedastheSeller’sreceivingofthedeposit.TheearnestmoneywillbelatterlypaidtoSelleraspartofthetransferpriceofthehousepropertywhentheformalitiesfortransferofownershiparecompleted.
Article7[DepositforDeliveryofHouseProperty]
InordertopreventrisksinthetransactionandmeanwhileurgetheSellertodeliverthehouseandsettlerelevantexpensesasscheduled,theBuyerandtheSellerbothagreethatRMB-----ofthetransferpriceshallbefirstlyretainedasadepositfordeliveryofthehouse(notexceeding2%ofthetotalprice.ThedepositshallbepaidtotheSelleraftertherealestateisactuallydeliveredandtheownershipistransferred.Thedepositshallbekeptasfollowingfirstitem:

Article8[PaymentMethod]
Unlessotherwisespecificallyagreed,alltheBuyer’spayments(includingdepositandpaymentforpriceofhouse)arerecommendedtobekeptbythebankasathirdpartyforsupervisionofcapital.
TheBuyershallpaythehousepriceotherthantheearnestmoneyandthedepositforthedeliveryofhouseinthefollowingfirstways,thatis:
RMBThirtyoneThousand,FiveHundredandFortyFiveYuanOnly(RMB31545)totheSeller.
1.One-offpayment
TheBuyershallpaytheabovehousepricetothebankaccountmutuallyspecifiedbybothpartiesforsupervisionbeforeXXX.
2.Paymentwithmortgageloanfrombank
(1)TheBuyershall,before------,paythefirstinstallmentofpayment,RMB----otherthantheearnestmoneyandthedepositfordeliveryofhousetothebankaccountmutuallyspecifiedbybothpartiesheretoforsupervisionbythebankasathirdparty.
(2)TheBuyershallsubmitthedocumentsrelatingtotheapplicationformortgageloantotheBankandthencooperatewiththebanktohandletheloanexaminationandapprovalformalities.Theamountofthemortgageloanissubjecttothebank’sletterofcommitment.
(3)Wheretheloanissuedbythebankisinsufficienttopaytherestpriceofthehouseproperty,partiesheretoagreetohandlethecaseinthefollowing---ways.
a.TheBuyershallsupplementtheinsufficientamountwithin3daysafterthebankissuestheletterofcommitment.
b.ThecontractshallberescindedandtheSellershallrefundthecapitalpaidbytheBuyerwithin3days.

Article9[Buyer’sLiabilityforBreachofContractduetoLatePayment]

(1)AskingtheBuyertopayaliquidateddamageat0.04%oftheunpaidamountonadailybasisandthecontractshallremainval
