RuleofInterpretation

IntheadjustmentofgeneralaveragethefollowingRulesshallapplytotheexclusionofanyLawandPracticeinconsistenttherewith.

ExceptasprovidedbytheRuleParamountandthenumberedRules,generalaverageshallbeadjustedaccordingtotheletteredRules.

Innocaseshalltherebeanyallowanceforsacrificeorexpenditureunlessreasonablymadeorincurred.

Thereisageneralaverageactwhen,andonlywhen,anyextraordinarysacrificeorexpenditureisintentionallyandreasonablymadeorincurredforthecommonsafetyforthepurposeofpreservingfromperilthepropertyinvolvedinacommonmaritimeadventure.

Generalaveragesacrificesandexpendituresshallbebornebythedifferentcontributinginterestsonthebasishereinafterprovided.

Thereisacommonmaritimeadventurewhenoneormorevesselsaretowingorpushinganothervesselorvessels,providedthattheyareallinvolvedincommercialactivitiesandnotinasalvageoperation.

Whenmeasuresaretakentopreservethevesselsandtheircargoes,ifany,fromacommonperil,theseRulesshallapply.

Avesselisnotincommonperilwithanothervesselorvesselsifbysimplydisconnectingfromtheothervesselorvesselssheisinsafety;butifthedisconnectionisitselfageneralaverageactthecommonmaritimeadventurecontinues.

Onlysuchlosses,damagesorexpenseswhicharethedirectconsequenceofthegeneralaverageactshallbeallowedasgeneralaverage.

Innocaseshalltherebeanyallowanceingeneralaverageforlosses,damagesorexpensesincurredinrespectofdamagetotheenvironmentorinconsequenceoftheescapeorreleaseofpollutantsubstancesfromthepropertyinvolvedinthecommonmaritimeadventure.

Demurrage,lossofmarket,andanylossordamagesustainedorexpenseincurredbyreasonofdelay,whetheronthevoyageorsubsequently,andanyindirectlosswhatsoever,shallnotbeadmittedasgeneralaverage.

Rightstocontributioningeneralaverageshallnotbeaffected,thoughtheeventwhichgaverisetothesacrificeorexpendituremayhavebeenduetothefaultofoneofthepartiestotheadventure;butthisshallnotprejudiceanyremediesordefenceswhichmaybeopenagainstortothatpartyinrespectofsuchfault.

Theonusofproofisuponthepartyclaimingingeneralaveragetoshowthatthelossorexpenseclaimedisproperlyallowableasgeneralaverage.

Allpartiesclaimingingeneralaverageshallgivenoticeinwritingtotheaverageadjusterofthelossorexpenseinrespectofwhichtheyclaimcontributionwithin12monthsofthedateoftheterminationofthecommonmaritimeadventure.

Failingsuchnotification,orifwithin12monthsofarequestforthesameanyofthepartiesshallfailtosupplyevidenceinsupportofanotifiedclaim,orparticularsofvalueinrespectofacontributoryinterest,theaverageadjustershallbeatlibertytoestimatetheextentoftheallowanceorthecontributoryvalueonthebasisoftheinformationavailabletohim,whichestimatemaybechallengedonlyonthegroundthatitismanifestlyincorrect.

Anyadditionalexpenseincurredinplaceofanotherexpensewhichwouldhavebeenallowableasgeneralaverageshallbedeemedtobegeneralaverageandsoallowedwithoutregardtothesaving,ifany,tootherinterests,butonlyuptotheamountofthegeneralaverageexpenseavoided.

Generalaverageshallbeadjustedasregardsbothlossandcontributionuponthebasisofvaluesatthetimeandplacewhenandwheretheadventureends.

Thisruleshallnotaffectthedeterminationoftheplaceatwhichtheaveragestatementistobemadeup.

WhenashipisatanyportorplaceincircumstanceswhichwouldgiverisetoanallowanceingeneralaverageundertheprovisionsofRulesXandXI,andthecargoorpartthereofisforwardedtodestinationbyothermeans,rightsandliabilitiesingeneralaverageshall,subjecttocargointerestsbeingnotifiedifpracticable,remainasnearlyaspossiblethesameastheywouldhavebeenintheabsenceofsuchforwarding,asiftheadventurehadcontinuedintheoriginalshipforsolongasjustifiableunderthecontractofaffreightmentandtheapplicablelaw.

TheproportionattachingtocargooftheallowancesmadeingeneralaveragebyreasonofapplyingthethirdparagraphofthisRuleshallnotexceedthecostwhichwouldhavebeenbornebytheownersofcargoifthecargohadbeenforwardedattheirexpense.

RuleI-JettisonofCargo

Nojettisonofcargoshallbemadegoodasgeneralaverage,unlesssuchcargoiscarriedinaccordancewiththerecognisedcustomofthetrade.

RuleII-LossorDamagebySacrificesfortheCommonSafety

Lossofordamagetothepropertyinvolvedinthecommonmaritimeadventurebyorinconsequenceofasacrificemadeforthecommonsafety,andbywaterwhichgoesdownaship'shatchesopenedorotheropeningmadeforthepurposeofmakingajettisonforthecommonsafety,shallbemadegoodasgeneralaverage.

RuleIII-ExtinguishingFireonShipboard

Damagedonetoashipandcargo,oreitherofthem,bywaterorotherwise,includingdamagebybeachingorscuttlingaburningship,inextinguishingafireonboardtheship,shallbemadegoodasgeneralaverage,exceptthatnocompensationshallbemadefordamagebysmokehowevercausedorbyheatofthefire.

Lossordamagesustainedbycuttingawaywreckorpartsoftheshipwhichhavepreviouslybeencarriedawayorareeffectivelylostbyaccidentshallnotbemadegoodasgeneralaverage.

Whenashipisintentionallyrunonshoreforthecommonsafety,whetherornotshemighthavebeendrivenonshore,theconsequentlossordamagetothepropertyinvolvedinthecommonmaritimeadventureshallbeallowedingeneralaverage.

RuleVI-SalvageRemuneration

(a)Expenditureincurredbythepartiestotheadventureinthenatureofsalvage,whetherundercontractorotherwise,shallbeallowedingeneralaverageprovidedthatthesalvageoperationswerecarriedoutforthepurposeofpreservingfromperilthepropertyinvolvedinthecommonmaritimeadventure.

ExpenditureallowedingeneralaverageshallincludeanysalvageremunerationinwhichtheskillandeffortsofthesalvorsinpreventingorminimisingdamagetotheenvironmentsuchasisreferredtoinArticle13paragraph1(b)oftheInternationalconventiononSalvage,1989havebeentakenintoaccount.

(b)SpecialcompensationpayabletoasalvorbytheshipownerunderArticle14ofthesaidConventiontotheextentspecifiedinparagraph4ofthatArticleorunderanyotherprovisionsimilarinsubstanceshallnotbeallowedingeneralaverage.

RuleVII-DamagetoMachineryandBoilers

Damagecausedtoanymachineryandboilersofashipwhichisashoreandinapositionofperil,inendeavouringtorefloat,shallbeallowedingeneralaveragewhenshowntohavearisenfromanactualintentiontofloattheshipforthecommonsafetyattheriskofsuchdamage;butwhereashipisafloatnolossordamagecausedbyworkingpropellingmachineryandboilersshallinanycircumstancesbemadegoodasgeneralaverage.

RuleVIII-ExpenseslighteningaShipwhenAshore,andConsequentDamage

Whenashipisashoreandcargoandship'sfuelandstoresoranyofthemaredischargedasageneralaverageact,theextracostoflightening,lighterhireandreshipping(ifincurred),andanylossordamagetothepropertyinvolvedinthecommonmaritimeadventureinconsequencethereof,shallbeadmittedasgeneralaverage.

RuleIX-Cargo,Ship'sMaterialsandStoresusedforFuel

Cargo,ship'smaterialsandstores,oranyofthem,necessarilyusedforfuelforthecommonsafetyatatimeofperilshallbeadmittedasgeneralaverage,butwhensuchanallowanceismadeforthecostofship'smaterialsandstoresthegeneralaverageshallbecreditedwiththeestimatedcostofthefuelwhichwouldotherwisehavebeenconsumedinprosecutingtheintendedvoyage.

(a)Whenashipshallhaveenteredaportorplaceofrefugeorshallhavereturnedtoherportorplaceofloadinginconsequenceofaccident,sacrificeorotherextraordinarycircumstanceswhichrenderthatnecessaryforthecommonsafety,theexpensesofenteringsuchportorplaceshallbeadmittedasgeneralaverage;andwhensheshallhavesailedthencewithheroriginalcargo,orapartofit,thecorrespondingexpensesofleavingsuchportorplaceofrefugeconsequentuponsuchentryorreturnshalllikewisebeadmittedasgeneralaverage.

Whenashipisatanyportorplaceofrefugeandisnecessarilyremovedtoanotherportorplacebecauserepairscannotbecarriedoutinthefirstportorplace,theprovisionsofthisRuleshallbeappliedtothesecondportorplaceasifitwereaportorplaceofrefugeandthecostofsuchremovalincludingtemporaryrepairsandtowageshallbeadmittedasgeneralaverage.TheprovisionsofRuleXIshallbeappliedtotheprolongationofthevoyageoccasionedbysuchremoval.

(b)Thecostofhandlingonboardordischargingcargo,fuelorstoreswhetherataportorplaceofloading,callorrefuge,shallbeadmittedasgeneralaverage,whenthehandlingordischargewasnecessaryforthecommonsafetyortoenabledamagetotheshipcausedbysacrificeoraccidenttoberepaired
