第六章海上保险条款

§6-1中保船舶险

PICCMarineInsurance（HullInsuranceClauses）

Thesubjectmatterofthisinsuranceisthevessel,includingitshull,lifeboats,machinery,equipments,instruments,tackles,bunkersandstores.

ThisinsuranceisclassifiedintoTotalLossCoveranAllRiskCover.

I.ScopeofCover

1.TotalLossCover

ThisinsurancecoverstotallossoftheInsuredvesselcausedby:

1）earthquake,volcaniceruption,lightningorothernaturalcalamities;

2）grounding,collision,contactwithanyobject,fixed,floatingorotherwise,orotherperilsofthesea;

3）fireorexplosions;

4）violenttheftbypersonsfromoutsidethevesselorpiracy;

5）jettison;

6）breakdownoforaccidenttonuclearinstallationsorreactors;

7）thisinsurancealsocoverstotallossoftheInsuredvesselcausedby:

（1）accidentsinloading,dischargingorshiftingcargoorfuel;

（2）anylatentdefectinamachineryorhullofthevessel;

（3）wrongfulactswillfullycommittedbythemasterorcrewtotheprejudiceoftheInsuredinterest;

（4）negligenceofthemastercreworpilotsrepairersorcharterers;

（5）actsofanygovernmentalauthoritytopreventorminimizeapollutionhazardresultingfromdamagetothevesselcausedbyrisksinsuredagainst,providedsuchlosshasnotresultedfromwantofduediligencebytheInsured,OwnersorManagers.

2.AllRisksCover

ThisinsurancecoverstotallossoforpartiallossofordamagetotheInsuredvesselarisingfromthecausesundertheTotalLossCoverandalsocoverstheunder-mentionedliabilityorexpense:

1）CollisionLiabilities

（1）ThisinsurancecoverslegalliabilitiesoftheInsuredasaconsequenceoftheInsuredvesselcomingintocollisionorcontactwithanyothervessel,oranyobject,fixed,floatingorotherwise.However,thisclausedoesnotcoveranyliabilitiesinrespectof:

lossoflife,personalinjuryorillness;cargoorotherpropertyonorengagementsoftheInsuredvessel;removalordisposalofobstructions,wrecks,cargoesoranyotherthingwhatsoever;pollutionorcontaminationofanypropertyorthingwhatsoever（includingcostofpreventivemeasuresandclean-upoperations）exceptpollutionorcontaminationoftheothervesselwithwhichtheInsuredvesselsisincollisionorpropertyonsuchothervessel;indirectexpensesarisingfromdelaytoorlossofuseofanyobject,fixed,floatingorotherwise.

（2）WheretheInsuredvesselisincollisionwithanothervesselandbothvesselsaretoblame,thenunlesstheliabilityofoneorbothvesselsbecomeslimitedbylaw,theindemnityunderthisclauseshallbecalculatedontheprincipleofcrossliabilities.ThisprinciplealsoapplieswhentheInsuredvesselcomesintocontactwithanobject.

（3）Theinsurer’sliability（includinglegalcosts）underthisclauseshallbeinadditiontohisliabilityundertheotherprovisionsofthisinsurancebutshallnotexceedtheInsuredamountofthevesselherebyinsuredinrespectofeachseparateoccurrence.

2）GeneralAverageandSalvage

（1）ThisinsurancecoverstheInsuredvessel’sproportionofgeneralaverage,salvageorsalvagecharges,butincaseofgeneralaveragesacrificeofthevessel,theInsuredmayrecoverfullyforsuchlosswithoutobtainingcontributionsfromotherparties.

（2）Generalaverageshallbeadjustedinaccordancewiththerelativecontractandofgoverninglawandpractice.However,wherethecontractofaffreightmentorcarriagedoesnotsoprovide,theadjustmentshallbeaccordingtotheBeijingAdjustmentRulesorsimilarprovisionsofotherrules.

（3）WhereallthecontributinginterestsareownedbytheInsured,orwhentheInsuredvesselsailsinballastandthereatenoothercontributingintereststheprovisionsoftheBeijingAdjustingRules（excludingArticle5）,orsimilarprovisionsofotherrulesifexpresslyagreed,shallapplyasiftheinterestswereownedbydifferentpersons.Thevoyageforthispurposeshallbedeemedtocontinuefromtheportorplaceofdepartureuntilthearrivalofthevesselatthefirstportorplaceofcallforbunkeringonly.Ifatanysuchintermediateportorplacethereisanabandonmentoftheadventureoriginallycontemplatedthevoyageshallthereuponbedeemedtobeterminated.

3）SueandLabour

（1）Wherethereislossordamagetothevesselfromaperilinsuredagainstorwherethevesselisinimmediatedangerfromsuchaperil,andasaresultreasonableexpenditureisincurredbytheInsuredinordertoavertorminimizealosswhichwouldberecoverableunderthisinsurance,theInsurerwillbeliablefortheexpensessoincurredbytheInsured.Thisclauseshallnotapplytogeneralaverage,salvageorsalvagechargesortoexpenditureotherwiseprovidedforinthisinsurance.

（2）Theinsurer’sliabilityunderthisclauseisinadditiontohisliabilityundertheotherprovisionsofthisinsurance,
