Chapter1GeneralProvision
Article1ThisRegulationismadeinaccordancewiththerelatedregulationspublishedbyChina’sGovernmentandtheGuidelinesonEmploymentandManagementofForeignLaborServicepublishedbyPowerChinaandbasedontheactualsituationofpracticeundertakenbySINOHYDROinBangladesh.ThepurposeofthisRegulationistoensurethesuccessfulimplementationofthePadmaMultipurposeBridgeProjectRiverTrainingWork,improvethecapacityofSINOHYDROtofulfillitsobligationsspecifiedintheProjectContractandprotectthelegitimatedrightsandinterestsofBangladeshemployees.
Article2TheforeignemployeeinthisRegulationreferstotheemployeeprovidedbythelocallaborcompaniesofBangladeshandthelocalemployeehiredbySINOHYDROitself.
Chapter2BasicPrinciplesforEmploymentandManagementofForeignLaborService
Article3SINOHYDROwillfollowthebasicprinciplesofself-employment,classification management,peoplefirstandlawfuloperationofenterpriseintheprocessofrecruitmentandmanagementofforeignemployees.Inaddition,SINOHYDROwillemploythelaborsaccordingtothedemandsofproductionandself-developmentandbasedonrelatingregulationsandcarryouttheclassificationandmulti-layermanagementaccordingtoactualsituation.Inthespiritofresponsibilityandpeoplefirst,SINOHYDROwillalwaysconformtothelawandregulationsofbothChinaandBangladesh,tryitsbesttoimprovethemanagementworkoflocalemployees,safeguardtheimageofChinaandSINOHYDROandthelegitimaterightsandinterestsoflocalemployeesandachievetheharmoniousunitybetweenthenationalinterestsandeconomicalbenefitsofenterprise,legitimaterightsprotectionandthecareerdevelopmentoflocalemployees.
Chapter3ManagementofLocalEmployees
Article4SINOHYDROwillindependentlyorcooperatewithlocalqualifiedlaborcompaniestoadvertisetheemploymentinformationandhiresuitableemployees.Afterthat,thelaborcompanieswillberesponsibleforthemanagementofthoserecruitedemployeesandSINOHYDROwillonlyberesponsibleforarrangingworkfortheselaborsandpayingtheirsalariesaccordingtotheirattendanceperformanceandthesalarystandardstipulatedintheEmploymentContract,butSINOHYDROwillnotbeartheriskssuchasinjury,diseaseandotherunforeseeableriskswhichmayoccurintheprocessofrecruitmentanduseoflocalemployeesandtryitsbesttoavoidtheserisks.
Article5Establishaspecialmanagementagencyforthemanagementoflocalemployees.TheFinalandManpowerDepartmentofSINOHYDROwillbeinchargeoftheemploymentanddismissalofBangladeshemployees,checkingtheIDinformationandregisteringtheseinformationinrelateddocumentssoastoavoidre-employmentofthoseemployeeswhowerefiredbefore.AllconstructionteamsmustfillintheApprovalFormforEmploymentofLaboraccordingtotheirconstructionneeds.ThenumberofemployeerequiredforeachtypeofworkwillbedecidedbySINOHYDROsubjecttotheactualworkquantityandtechnicaldemandsanditcannotbeincreasedordecreasedwithoutanyreason.Iftheredoesexistaneedtoincreasethenumberoflabors,theconstructionteamshallreporttotheprojectleadersforapproval.AllconstructionteamsarenotallowedtoemploythelaborspersonallywithoutbeingcheckedbyFinancialandManpowerDepartment.TheDismissalofunsatisfactorylaborsorthoseinviolationofrelatedrulesandregulationswillfollowtheproceduresspecifiedinlaborlawofBangladesh.SINOHYDROwillfirstgivethewrittenwarningstothosewhobreaktherulesandthengetdowntothedismissalprocedureinordertoavoidtheunnecessarydisputesandlawsuitscausedbythedismissaloflabors.Afterthat,theFinancialandManpowerDepartmentwilldisclosetheIDinformationandpicturesofthesedismissedlaborsintheLaborManagementSystemofSINOHYDROandallconstructionteamsareneverallowedtore-employthesedismissedlaborsagain.
Article6Establishamanagementsystemforlocalemployees.Inconsiderationofnationalconditionsofthecountrywheretheengineeringprojectsis,aswellastheactualsituationoftheengineeringprojects,SINOHYDROestablishedtheManagementRegulationtoLocalEmployeesandLabortheoflocalemployees,whichmainlyincludes:
signingmanpowersupplyingcontractincompliancewiththerequirementofrelevantlawsandregulationsofthecountrywheretheengineeringprojectsis;givingtrainingandeducationinaspectofmanagementregulations,safetyoperationandtechnicaloperationtolocalemployeesandlocallaborsinlocallanguageandlocalcharacter,inthemeanwhile,makingrecordonthesetrainingandeducation;boththeeducatorwhogivingtherainingandeducationandthepersonwhoaretrainedandeducatedhavetoaffixtheirsignaturestoensurethattheyalreadygotacknowledgeofthetrainingandeducation.
Article7PayattentiontotheimportantholidaysofBangladeshandcomplywiththeregulationsregardinglocalholidays:
SINOHYDROwillattachimportancetothegrandlocalholidays(suchasEid-ul-Fitr,Eidal-Adha,etc.),andpaysalarytothelocalemployeesandlocallaborsasusualinaccordancewithlocallawsandregulationswhenitisgrandholidays.Forlocalemployeesandlocallaborswhohavetoandagreetoworkovertime,SINOHYDROwillmakefullpaymentofsalarytotheminadailybasisaccordingtotheprovisionsofpaidholiday.DuringRamadan,SINOHYDROwillrescheduletheroster/timetableofthelocallabors,re-plantheoperationintensityofthelocallabors,evenadjusttheworkingproceduresinashortterms,tryingtoavoidhighintensityandlongtimeoperationinRamadan.
Article8Attachgreatimportancetotheworkingandlivingconditionsofthelocalemployeesandgivehumanecaretothem.Thedifferentlevelsofemployeesandworkersshouldbetreateddifferently,andtherelationshipbetweenSINOHYDROandthelocallaborcannotbeseenasasimpleemploymentrelationship.Instead,SINOHYDROshouldestablishaharmoniousandtrustrelationshipwiththelocallaborsinaspectoftheirworkandlife,includingwelfare,distributionofPPE,holidayscare,andotheraspects,sotomobilizetheirenthusiasm.Inaresult,thelocallaborswillhaveasenseofbelonging,thenincorporatethemselvesintothegrandRTWproject.Whenthereisstaffappraisalandcitationactivities,SINOHYDROwillreserveacertainnumberofquotaforthelocalworkers,soastoencouragethemtoworkmoreactively.Oncetheinjuryoraccidentoccurs,SINOHYDROshouldimmediatelyorganizefirstaid,andpromptlysentthewoundedtoanearbyhospitalfortreatment,inthemeanwhile,SINOHYDROshouldarrangethemanagementpersonneltodealwiththerelatedmatters,andproceedthesettlementofclaimsworkoflaborinsurance.
Article9Haveadeepunderstandingofthelocalcultureandreligiousfaith.SINOHYDROwillexplainthelocalcustoms,religion,etc.,totheChinesestaffs,aswelladequatelycommunicateandcontactwiththelocalmanpowercompany,soastohaveabetterunderstandingonthedifferencebetweenthecustomsandculturesofBangladeshandthatofChina,thengivefullrespecttothelocallabors.Thevariousformsofget-togetheractivitywillbeorganizedregularlytoenhancethemutualunderstanding.
Article10AttendanceManagement
1)Sinceattendancerecordisthemainbasisforcalculatingsalary,overtimeworkhoursandotherbenefits,thepersonnelatalllevelsmustattachgreatimportancetoit.TheFinancialandManpowerDepartmentofSINOHYDROisinchargeoftheattendancemanagement,eachdepartment/officeandconstructionteamshouldsettimekeeperssystemtomakeattendancerecordfortheBangladeshlabors,whilethedirectorofeachdepartment/officeandleaderofconstructionteamwilldesignateaspecializedpersonasthepart-timetimekeper.
2)Thetimekeepersshouldseriouslyimplementtheattendancemanagementsystem,andthelabors’name,manpowercompanyandtypeofworksshouldbeclearlyrecordinthetimeSheet.Thetimekeepershouldrecordtheattendanceofeachlocallaborsasperthefactualsituation,falserecordandneglectedrecordarenotallowed,whilethetimekeeperhavemakemodificationbyusingChinesecharacterinsteadof Arabic numerals.TheTimeSheetshouldbehandedoutthebyChinesemanagingpersonneltotheFinancialandManpowerDepartmentbeforetheseconddayofthenextmonth.
3)Thetimekeeperswillbepunishedaccordingtotheactualsituationwhentheymakefalserecord,failtomakerecordormakeinaccuraterecordinthetimesheet.
Article11ResponsibilitiesoftheLaborCompany
ThelaborcompaniesshouldprovidetheemployeesandlocallaborswhichmeettherequirementsofSINOHYDRO,examinetheidentityinformationandvocationalqualificationcertificatesoftheemployeesandlocallabors,andstrengthenthedailyinspectionsandmanagementworks,soastopreventthestrike,fightsandotherseriousadverseeventsfromoccurring.Oncetheseeventsoccurs,themonthlymanagementfeewillbedeductedfrom10%to50%dependingontheinfluencedegreeofevent,untilthepartnershipisterminated.Thelaborcompaniesshouldprovideworkshoes,helmetsandotherprotectionequipmentwithinfivedaysaftertherecruitmentofnewemployees,whiletheChinesemanagingpersonnelwillsupervisetheconsistentuseofPPEoftheemployersandlocallabors,theemployeesandlocallaborsfailtousePPEaspertheprovisionswillgetverbalwarning,deductionofworkinghoursandotherpenalties.
