本合同由（以下简称甲方）同（以下简称乙方）本着互惠互利、平等自愿的原则，共同协商签署。
ThePartyAandPartyBherebymutuallyagree,PartyArentsthevanofBuickGL8（）whichisownedbyPartyB.Theleasetermcommencefromthe1stofMay9th2012toMay8th2013.ThemonthlyrentalofRMB13,000shallbepaidbyParty
AwiththeofficialtaxinvoiceofferedbyPartyB.
经甲乙双方同意，甲方租用乙方和其所有权的BuickGL8轿车（第二辆，车号0220）。
租用期自2012年5月9日起，至2013年5月8日止。
租用期间甲方将在收到乙方提供的正式税务发票之后按每月人民币壹万叁仟元的租金支付给乙方。

合同期内，甲乙双方认真履行此合同所规定只责任，如下：

乙方的司机在合同期内的工作时间为每周一至周五，早八点至晚五点中午午休一小时;周六、周日用车提前与司机联系。
甲方根据甲方人员确认的签字以月为单位支付给司机30元/小时的加班费，法定节假日加班费为40元/小时.乙方根据甲方确认好的加班明细向甲方开具正式发票，甲方在收到发票后30天内付款;

乙方要保持车辆内外干净、整洁，保持车辆的正常使用;
4.Allthemaintenancerelatedtothevanandtheinsurancefeeandother

乙方自行负担有关车辆的维修保养及所有的保险费、养路费、税等;5.ThegasolinecostsshallbebornebyPartyAuponproductionofreceipts;
甲方根据实际发生的燃油费用，依据发票向乙方付费;
6.ThetollfeeandparkingfeeshallbebornebyPartyA;
过路费及停车费由甲方承担;
7.Thevanwillbekeptattherenterhouseintheoffhours;
所租赁车辆可以在业余时间停放在租赁者家中;
8.PartyBshallberesponsibleforthepersonalmedicalinsurance;
乙方有关的个人医疗及人身伤害费用，甲方不予承担;
9.IncasePartyB'sdrivertakesickleaveorcouldnotensurethesafetyofdriving,
PartyBshallfindasubstitutetillPartyAsatisfiedandwillbearallrelatedcosts;乙方司机如遇身体不适或其他不能安全驾驶车辆时，乙方应负责找到甲方满意的司机代替，所发生的费用由乙方承担;
10.PartyAshallprovidetheconveniencetoPartyBifthevanisrequestedtobe
properlyfixed,maintainedandregularchecked;
乙方车辆如有必要修理、保养、年检，甲方应提供方便;
11.Ifanyearlyterminationoccurs,onemonthpriorwrittennoticeisrequested;
合同双方的任意一方提前解除此合同，必须提前一个月书面通知另一方;12.Thisagreementwillbeextendedupontheexpirydateandtheconfirmation
frombothparties;
本合同届满时，如双方无争议本合同自动顺延;
13.PartyBshallgetandkeeptheinsuranceofpersonalinjuryandpossessionto
ensurethatPartyAisnotresponsibleforanyissueswhicharecausedbythisvanandisnotresponsibleforanycompensationcausedbythevan;
乙方须取得和维持充分的人身伤害险，第三者责任险，财产保险，从而充分保证甲方免受与车辆及相关事务引起的损失或损害。
甲方不承担车辆造成的一切损害赔偿。
14.IfPartyBcouldnotobeythestatementandobligationinthisagreement,and
failtodotherectificationuponPartyA'snotification,PartyAshallbeentitledtoterminatetheagreementatonce.
乙方未履行，未遵守或未完成本协议规定的任何约定及义务，而且在收到甲方通知后，不立即纠正违约，甲方有权立即终止协议。

一、合作基本方式

三、乙方权利义务

以上如乙方仍无改进，甲方有权考虑终止合同。

2、以上收入是指乙
方每月接、送客人后，由甲方客人支付的全部用车费用。

不可向客人收取用车费用。

费用不包含在此，需另行结算。
3、本条所指收入，
双方按月予以结算。
即在每月1-5号内结算上月收入，并在结算后2日内予以分配。

4、甲方客人所需车
型超出乙方提供车型，由乙方负责协调外调。
外调车除去调车成本后，所余利润部分甲方获

七、经营相关责任

生损害结果，包括但不限于车辆损失、驾乘人员损伤、第三方损失均由乙方自行承担与解决。

2、若以上损害系第
三方原因造成的，需以甲方名义予以解决的，则甲方应予以解决。
届时，甲方可自行或委托

同时，甲方向第三方获得的各项赔偿应
返还给乙方。

八、特别约定

九、合同的解除，
终止

1、本合同存续期间，
任何一方非因法定或约定事由均不得解除本合同，否则，视为违约解除合同，应按本合同作
相应处理。

2、本合同方经协商
一致，可以解除本合同。

十、违约责任

任何一方非因法定事由均不得无故解除本合同。
否则，视为违约，违约方应向守约方支付违
约金贰拾万元整。
此款包括了因一方解除合同后给另一方造成的全部损失、赔偿金等。
任何
一方不得以本条约定的违约金过高为由向法院起诉要求降低。

十一、争议的解决
