公路建设项目代建管理办法

（征求意见稿）

第一章总则

第一条【目的依据】为推进现代工程管理，提高公路建设项目专业化管理水平，根据《公路法》、《公路建设市场管理办法》、《公路建设监督管理办法》等有关法律、法规及规章，制定本办法。

第二条【代建定义】本办法所称代建，是指专业化的项目管理企事业单位（以下简称“代建单位”）受公路建设项目的项目法人委托，承担项目建设管理及相关工作的一种建设管理模式。

第三条【代建要求】项目法人缺乏相应的建设管理能力时，应按有关规定，通过招标等方式选择代建单位组织建设项目的实施，依法承担项目质量、安全、投资及工期等管理责任。

第四条【阶段划分】公路建设项目代建工作可以从施工阶段开始，也可以从初步设计或施工图设计阶段开始。

第五条【基本原则】公路建设项目代建管理应当遵循“择优选择，责权一致，界面清晰，目标管理”的原则。

加强代建市场管理和信用管理，将代建单位和代建管理人员纳入公路建设市场信用体系，促进代建市场健康发展。

第二章代建单位选择

第七条【代建单位条件】代建单位应当具备以下条件:

（一）具有独立事业或企业法人资格，有完善的组织结构、健全的管理制度;

（二）承担过5个以上高速公路、一级公路或独立桥梁、隧道工程的建设管理相关工作，具有良好的履约评价和市场信誉;

（三）拥有专业齐全、结构合理的专业技术人才队伍，工程技术系列中级以上职称人员不少于50人，其中具有高级职称人员不少于15人;

（四）企业法人注册资金应不少于1000万元，近三年年平均营业额应不少于5000万元，资产负债率不高于40%。

省级交通运输主管部门可根据本地区具体情况细化代建单位条件。

鼓励符合代建条件的公路建设管理单位及公路工程监理企业、勘察设计企业进入代建市场，开展代建工作。

第八条【代建现场管理人员条件】代建单位派驻工程现场的建设管理机构、专职管理人员应当满足项目建设管理工作需要。

拟任代建项目负责人、技术负责人、工程管理部门负责人应当在代建单位工作3年以上，且具有10年以上的公路建设行业从业经验、高级以上专业技术职称，以及至少

第九条【代建单位名录】省级交通运输主管部门应当建立公路建设项目代建单位名录，对代建单位实行动态管理，建立准入和退出机制，并向社会公开。

全国拟从事公路建设项目代建的单位，应向拟代建项目所在省份的省级交通运输主管部门提交申请并附相关材料。

第十条【代建单位选择】项目法人选择代建单位时，应从项目所在地省级交通运输主管部门公布的代建单位名录中，选择业绩和信用良好、管理能力强的代建单位。

第十一条【人员履约】采取招标方式选择代建单位的，项目法人在招标文件中，应当明确对代建管理人员、技术人员的有关要求。

代建单位在递交投标文件时，应当按要求列明拟任现场管理人员、技术人员及备选人选。

代建单位派驻现场的管理人员和技术人员不得在其他项目兼职。

第十二条【评标方法】采取招标方式选择代建单位的，项目法人应当重点评价代建单位的建设管理能力，可以采用固定标价评分法、技术评分合理标价法、综合评标法以及法律、法规允许的其他评标方法。

第三章管理职责

第十三条【主管部门职责】国务院交通运输主管部门负责全国公路代建工作的指导和代建市场的监督管理，发布全国公路建设项目代建单位信用信息。

省级交通运输主管部门负责本行政区域内公路代建工作和代建市场的监督管理，发布代建单位名录，评估代建单位信用等级。

第十四条【项目法人职责】项目法人依据代建合同，对代建单位实行合同管理，对项目实施过程进行监管。

主要职责包括:

（一）严格执行国家基本建设程序和有关规定，组织办理各类行政审批手续，督促相关参建单位落实审批意见;

（二）依法选定代建单位，按照责权一致原则签订代建合同，审定代建单位工作方案、项目管理目标和主要工作计划，定期组织检查与考核;

（三）项目法人可授权代建单位依法选定勘察设计、施工、材料设备供应等单位并签订合同，同时在相关合同中明确代建单位管理职权，但不免除项目法人的责任;

（四）配合地方人民政府和有关部门完成征地拆迁工作;

（五）筹措建设资金，及时支付工程建设各项费用;

（六）检查项目强制性标准执行情况，审核代建单位报送的较大变更、重大变更方案，依法办理相关变更手续;

（七）组织项目交工验收、竣工决算并做好竣工验收准备工作;

（八）项目法人的其他法定职责。

第十五条【代建单位职责】代建单位依据合同开展代建工作，主要职责包括:

（一）严格执行国家基本建设程序和有关规定，协助项目法人办理各类行政审批手续并落实审批意见，配合国家有关部门依法组织各类检查并负责整改落实;

（二）协助项目法人或受项目法人委托，组织编制招标文件，完成勘察设计、施工、监理、材料设备等招标工作;

（三）对勘察设计、施工、监理、材料设备供应、技术咨询等单位进行管理，细化、分解项目管理目标，落实目标责任;

（四）依据相关法规和合同，对工程质量、安全、进度、计量、支付、环保等相关工作负管理责任，审核、签发有关管理文件;

（五）协助有关单位完成征地拆迁工作;

（六）拟定项目进度计划、资金使用计划、工程质量和安全保障措施等报项目法人批准;

（七）审批一般设计变更并报项目法人备案，协助项目法人办理较大设计变更、重大设计变更报批手续;

（八）组织中间验收，协助项目法人组织交工验收;

（九）承担项目档案及有关技术资料的收集、整理、归档等工作，组织有关单位编制竣工文件;

（十）负责质量缺陷责任期内的缺陷维修工作管理，配合项目法人准备竣工验收相关工作;
