ChapterI

GeneralProvisions

Article1ThisLawisenactedforthepurposeofensuringthatjuvenilesarephysicallyandmentallyhealthy,helpingjuvenilescultivategoodconductandeffectivelypreventingjuveniledelinquency.

Article2Thepreventionofjuveniledelinquencyshallbebasedoneducationandprotection,theworkshallbestartedwithschoolchildrenandeffortsshallbemadetoprevent,rectifyandtreatjuvenilemisbehaviorbeforeitistoolate.

Article3Juveniledelinquencyshallbepreventedinacomprehensivewayundertheorganizationandleadershipofthepeople'sgovernmentsatalllevels.

Thegovernmentdepartmentsconcerned,judicialorgans,people'sorganizations,relevantpublicorganizations,schools,families,neighborhoodcommitteesincitiesandvillagerscommitteesinthecountryside,etc.shalljoineffortsandtaketheirrespectiveresponsibilitiesinpreventingjuveniledelinquency,andcreatingagoodsocialenvironmentforthecultivationofphysicalandmentalhealthofjuveniles.

Article4People'sgovernmentsatalllevelsshallperformthefollowingfunctionsanddutiesinpreventingjuveniledelinquency:

（1）toformulateplansforpreventionofjuveniledelinquency;

（2）toorganizeandcoordinateeffortsoftherelevantgovernmentdepartmentsforpublicsecurity,education,culture,thepress,publishing,radio,filmandtelevision,industryandcommerce,civilaffairs,andjudicialadministration,andotherpublicorganizationsinpreventingjuveniledelinquency;

（3）toinspecttheimplementationofthisLawandworkplans;and

（4）toanalyzeanddisseminatetheexperiencegainedinpreventionofjuveniledelinquency,andsetupandcommendadvancedunitsandindividuals.

Article5Forpreventionofjuveniledelinquency,researchoneducationinpuberty,psychologicalcorrectionsandmeasuresforpreventionofcrimesshallbeimprovedinlightofthephysiologicalandpsychologicalcharacteristicsofjuvenilesatdifferentages.

ChapterII

EducationforPreventionofJuvenileDelinquency

Article6Juvenilesshallbeeducatedinideals,morality,thelegalsystemaswellasinpatriotism,collectivismandsocialism.Juvenileswhohavereachedtheageofreceivingcompulsoryeducationshall,whilereceivingtheeducationmentionedabove,beeducatedforpreventionofcrimes.

Educationforpreventionofjuveniledelinquencyisforthepurposeofenhancingjuveniles'legalconceptions,helpingthemheedtheharmdonetothemselves,theirfamiliesandthecommunitybytheirviolationsoflawandcriminalactionsandbecomeawareofthelegalresponsibilitiesincurredbysuchviolationsandactionsandoftheimportanceofobeyingrulesofdisciplineandlawsandpreventingthemselvesfrombreakinglawsandcommittingcrimes.

Article7Theadministrativedepartmentsforeducationandschoolsshallincorporatetheeducationforpreventionofcrimesintoschoolplansforeducationandteachingasthecontentoflegaleducation,andshall,incombinationwiththecommonandfrequently-occurringcasesofjuveniledelinquency,educatejuvenilesofdifferentagesinpreventionofdelinquencyrespectively.

Article8Judicialadministrationdepartments,administrativedepartmentsforeducationandtheCommunistYouthLeagueandYoungPioneersorganizationsshall,inlightofspecificconditions,arrangeandholdexhibitions,givereportsandlectures,andarrangeotherformsofactivitiestodisseminatethelegalsystemwithemphasisonpreventionofjuveniledelinquency.

Schoolsshall,inlightofspecificconditions,holdactivitieswitheducationforpreventionofjuveniledelinquencyasthemaincontent.Theadministrativedepartmentsforeducationshalltaketheresultsofeducationforpreventionofjuveniledelinquencyasanimportantpartofassessmentofschoolwork.

Article9Schoolsshallengagefull-timeorpart-timeteachersforlegaleducation.Schoolsmayengageafter-schoollegalcounselors,whereconditionspermit.

Article10Parentsandotherguardiansofjuvenilesshalltakedirectresponsibilityforgivinglegaleducationtojuveniles.Schoolsthatconducteducationamongstudentsinpreventionofcrimes,shallmaketheirplansforsucheducationknowntotheparentsandotherguardiansofthejuveniles,whoshallcarryouttheeducationincombinationwiththeschoolplansandaccordingtospecificconditions.

Article11AuthoritiesofChildren'sPalaces,recreationcentersforjuvenilesandotherplacesforout-of-schoolactivitiesshalltakeeducationforpreventionofjuveniledelinquencyasanimportantpartoftheirworkandcarryoutvariousformsofpublicityandeducationactivitiesinthisrespect.

Article12Forjuvenileswhohavereachedtheageof16butareundertheageof18andwhoarepreparingforemployment,vocationaleducationandtraininginstitutionsandemployersshallincludelegalknowledgeandeducationforpreventionofcrimesinvocationaltraining.

Article13Theneighborhoodcommitteesincitiesandvillagers'committeesinthecountrysideshallcarryoutactivitiesforthepublicityofthelegalsystemwithstressonpreventionofjuveniledelinquency.

ChapterIII

PreventionofJuvenileMisbehavior

Article14Theparentsandotherguardiansofjuvenilesandschoolsshalladvisejuvenilestokeepfromthefollowingkindsofmisbehavior:

（1））playingtruant,stayingoutatnight;

（2）carryingcontrolledknives;

（3）fighting,orabusingpeople;

（4）forciblydemandingmoneyorthingsofvaluefromothers;

（5）stealing,ordeliberatelydamagingproperty;

（6）takingpartingamblingorgamblingindisguisedform;

（7）watchingorlisteningintopornographicorobsceneaudio-videoproducts,orreadingsuchstuff;

（8）goingtocommercialsinginganddancinghallsandothersuchplacesthatarenotsuitableforjuvenilesasprescribedbylawsandregulations;and

（9）otherkindsofmisbehaviorthatseriouslyruncountertosocialmorality.

Article15Theparentsandotherguardiansofjuvenilesandschoolsshalladvisejuvenilestokeepfromsmokingandgettingdrunk.Nobusinessplacesmaysellcigarettesoralcoholicdrinkstojuveniles.

Article16wheremiddleorprimaryschoolstudentsplaytruant,theschoolshallgetintouchwiththeirparentsorotherguardianswithoutdelay.

Wherejuvenilesstayoutatnightwithoutpermission,theirparentsorotherguardians,ortheboardingschoolconcernedshalllookforthemwithoutdelay,orapproachapublicsecurityorganforhelp.Whoeverallowsajuveniletostayathisorherplaceatnightshallobtainpermissionofthejuvenile'sparentsorotherguardiansinadvance,orinformthemortheschoolconcernedofthematterwithin24hours,orreporttoapublicsecurityorganwithoutdelay.

Article17Whenparentsorotherguardiansofjuvenilesandschoolsfindthatjuvenilesorganizeorjoingangsthatperpetratemisbehavior,theyshallstopthejuvenilespromptly.Whentheyfindthatthegangshaveviolatedlawsorcommittedcriminaloffences,theyshallreportthemattertopublicsecurityorgans.

Article18Whenparentsorotherguardiansofjuvenilesandschoolsfindthatjuvenilesareinstigatedorcoercedtoperpetrateorluredintoillegalorcriminalactions,theyshallreportthemattertopublicsecurityorgans.Whenthepublicsecurityorgansreceivethereports,theyshallimmediatelyinvestigateanddealwiththecasesinaccordancewithlawand,wherethepersonalsafetyofjuvenilesisendangered,theyshallpromptlytakeeffectivemeasurestoprotectthem.

Article19Parentsorotherguardiansofjuvenilesmaynotallowjuvenilesundertheageof16tobefreefromtheirguardianshipandlivealone.

Article20Parentsorotherguardiansofjuvenilesmaynotgiveafreereinthejuveniles,compelthemtorunawayfromhome,ordiscardtheirdutyofguardianship.

Wherejuvenilesrunawayfromhome,theirparentsandotherguardiansshalllookforthemwithoutdelay,orapproachpublicsecurityorgansforhelp.

Article21Wheretheparentsofjuvenilesaredivorced,bothpartiesshallhavethedutytoeducatetheirchildren,andneitherpartymayfailtoperformsuchdutyonthepretextofdivorce.

Article22Thestepparentsandadoptiveparentsshallperformthesamedutyfortheadolescentchildrentheyaresupportingandeducatingasthedutyperformedbyparentstotheiradolescentchildreninpreventionofcrimes,asprescribedbythisLaw.

Article23Schoolsshallenforceeducationandadministrationamongjuvenileswhoareinvolvedinmisbehaviorandmaynotdiscriminateagainstthem.

Article24Theadministrativedepartmentsforeducationandschoolsshallholdvariousformsofactivitieslikelectures,informaldiscussionsandtrainingprogramstomakeknowntotheparticipantsgood,effectiveeducationalmethodsinlightofthephysiologicalandpsychologicalcharacteristicsofjuvenilesindifferentstagesofgrowthandtoshowtheteachers,thepar
