篇一:
新加坡政府劳动合同
ContractofService
WhatisaContractofService
Acontractofserviceisanyagreementwhetherinwritingorverbal,expressedorimplied,whereby:
Onepersonagreestoemployanotherasanemployee;andTheotherpersonagreestoservetheemployerasanemployee.
Anapprenticeshipcontractoragreementisalsoconsideredacontractofservice.
Acontractofservicecanbeintheformofaletterofappointment/employment.
Theemployercannotchangethetermsandconditionsofemploymentunlesstheemployeeagreestoit.
Anytermsandconditionsofemployment,inacontractofservice,thatislessfavourablethantherelevantprovisionundertheEmploymentActisillegal,nullandvoid.TheprovisionintheActwilltakeprecedenceoveraparticularcontractualtermthatislessfavourable.
DifferencebetweenaContractofServiceandaContractforService
Acontractforservicediffersfromacontractofservice.
Acontractofserviceisanagreementwherebyonepersonagreestoemployanotherasan
employeeandtheotheragreestoservehisemployerasanemployee.Underacontractofservice,theemployermustcontributeCPF,andproviderelevantstatutorybenefitssuchasannualleave,sickleaveetc.foritsemployeesengaged.
Acontractforservices,however,isanagreementwherebyapersonisengagedasanindependentcontractor,suchasaself-employedpersonorvendorengagedforafeetocarryoutanassignment
oraprojectforthecompany.Undersuchaworkarrangement,thereisnoemployer-employeerelationship,andtheemployeeisnotcoveredbytheEmploymentAct.
Thereisnosingleconclusivetesttodistinguishacontractofemploymentfromacontractforservices.Someofthefactorstobeconsideredinidentifyingacontractofemploymentinclude:
1.Control
2.WhodecidesontherecruitmentanddismissalofemployeesWhopaysfortheemployees'wagesandinwhatwaysWhodeterminestheproductionprocess,timingandmethodofproductionWhoisresponsiblefortheprovisionofworkOwnershipoffactorsofproduction
3.WhoprovidesthetoolsandequipmentWhoprovidestheworkingplaceandmaterialsEconomicconsiderations

DoesheinvolveinanyprospectofprofitorisheliabletoanyriskoflossHowarehisearningscalculatedandprofitsderived
EssentialclausesofContractofService
Acontractofservicemustincludethefollowingclauses:
Commencementofemployment;Appointment–jobtitleandjobscope;Hoursofwork;Probationperiod,ifany;Remuneration;Employee'sbenefits(sickleave,annualleave,maternityleave);Terminationofcontract–noticeperiod;andCodeofconduct(punctuality,nofightingatwork).
StartingaContractofService
Ifanewrecruitwhohassignedtheletterofemploymentfailstoturnupforwork
Ifanewrecruithassignedtheletterofemploymentbutsubsequentlyinformedtheemployerthathedoesnotintendtostartworkwiththecompanyandfailedtoturnuponhisfirstdayofwork,theEmploymentActdoesnotapplyastheemployer-employeerelationshiphasnotstarted.
Hencetheemployerwillnotbeabletoclaimnoticepayoranycompensationunderthe
EmploymentAct.
Iftheemployerwishestoclaimcompensationfromtherecruit,heshouldpursueacivilclaimthroughhisownlawyer.
Confirmationofemployees
ThereisnoprovisionintheEmploymentActontheconditionsfortheconfirmationofanemployeeinhisjob.Anemployee'sconfirmationwilldependonthetermsspeltoutintheemployment
contract.Thelengthofanemployee'sserviceiscalculatedfromthedateonwhichtheemployeestartsworkandnotthedateofconfirmation.TerminatingaContractofService
Bothanemployerandanemployeecanterminateacontractofservice.Aterminationmayarisefromtheexpiryofcontractualterms(completionofspecificproject,completionofspecificperiodoftime).
TerminationofContractwithNotice
Thepartywhointendstoterminatethecontractmustgivenoticetotheotherpartyinwriting.
Thenoticeperiodtobegivendependsonwhatisagreedinthewrittencontract.Ifthereisnowrittencontract,thenoticeperiodtobegivendependsonwhatthepartieshaveagreeduponverbally.
Ifthereisnosuchperiodpreviouslyagreedupon,thefollowingshallapply:

Thedayonwhichthenoticeisgivenshallbeincludedinthenoticeperiod.
Thelengthofnoticetobegivenbyanemployee(inaresignation)andanemployer(inaterminationofemployment)arethesame.
Bymutualconsent,noticecanbewaived.
Takingofannualleaveduringnoticeperiod
Asthenoticeperiodismeanttobeserved,theemployercannotforcehisemployeetogoonleaveduringtheperiodofnotice,unlesstheemployeeconsentstoit.Anyunconsumedannualleavecanbeencashedbytheemployee.
Offsettingofannualleave
Anemployeecanusehisannualleavetooffsetthenoticeperiodforterminationofcontract.Ifanemployeeuseshisannualleavetooffsethisnoticeperiodandtobringforwardhislastdayofwork,
hewouldonlybepaidtillhislastdayofworkandtheannualleaveusedtooffsethisleavewillnotbepaid.Bybringingforwardhislastdayofemploymentwiththecompany,heisnolongerconsideredanemployeeofthecompanyandhencehemaystartworkimmediatelywithhisnewcompany.
Ifanemployeechoosestooffsethisleaveduringthenoticeperiod,itisdifferentfromsituationwhereheappliestogoonapprovedleaveduringthenoticeperiod.
Ifanemployeeappliesforannualleavetocoverallorpartofhisnoticeperiodandapprovalhasbeengrantedbytheemployer,hewillbepaidhissalaryforthefullnoticeperiod.Inthiscase,heisconsideredasanemployeeofthecompanyuntilthelastdayofhisnoticeperiod.Ifhewantstojoinanewcompany,hecandosoonlyafterthelastdayofhisnoticeperiod.
Takingsickleaveduringnoticeperiod
Iftheemployeewasonsickleave(whetherpaidorunpaid)duringthenoticeperiod,thesickleavetakenshouldbetreatedaspartofthenoticeperiod.Theemployercannotclaimforanyshortnoticefromtheemployee.
StartingworkwithnewemployerwhileservingnoticeofterminationwithcurrentemployerTheemployeeservingthenoticeofterminationisstillconsideredanemployeeofhiscurrentemployer.Unlesshiscurrentcontractofemploymentallowshimtoworkwithanotheremployerbeforethedateoftermination,hehastoseekwrittenpermissionfromhiscurrentemployertodoso.Usingreservistperiodasnoticeoftermination
Asthenoticeperiodismeanttobeserved,thereservisttrainingcannotbeusedtooffsetthenoticeperiod.However,bothpartiesmaymutuallyagreetowaivetherequirednotice.
Salary-in-lieuofnotice(NoticePay)
Salary-in-lieuofnoticedoesnotattractCPFcontribution.Howeverifanemployeehasfullyservedtherequirednoticeperiod,hissalaryforthenoticeperiodwillbesubjectedtoCPF.CPFcontributionsmustbemadebyboththeemployerandemployeeforthesalaryearnedifthe
employeewasworkingduringthenoticeperiod,orconsideredasanemployeeofthecompanyandhenceprohibitedtojoinanothercompanyduringthenoticeperiod.

一总则
甲、乙双方依据《中华人民共和国公民出入境管理法》及相关法律法规,本着自愿平等、公平有偿、诚实守信的原则,就外派乙方赴新加坡工作达成如下协议。
甲方外派乙方赴从事工作,合同期及待遇以乙方与雇主签订的雇佣合同为准。
二甲方责任和义务
1、甲方在其经营场所明示营业执照和中华人民共和国商务部颁发的《对外劳务合作(外派劳务)经营资格证书》;
2、甲方如实向乙方介绍赴新加坡工作的工种、薪水、津贴等;
3、根据新加坡雇主或中介的招聘要求,组织安排乙方参加外方的技能考试及面试(特殊情况下不需要考试),并将录取结果及时告之乙方;
4、协助乙方办理护照、签证、公证材料、体检、防疫注射等手续和证件;
5、甲方负责办理乙方赴新加坡工作准证(批文);
6、安排乙方在外方规定的时间内出境,甲方负责通知外方安排接机等事宜;
7、乙方在本协议有效期内,甲方协助乙方解决与雇主发生的纠纷;
8、乙方在本协议有效期内,因患病无法继续工作时,甲方负责与新加坡雇主协商,为其办理回国手续,乙方回国费用及治疗费用自理;
9、乙方在本协议有效期内,因工伤经当地医院诊断证明不能继续工作时,则甲方协调雇主将乙方送回国,甲方不对乙方因工伤所造成的损害承担赔偿责任;
10、乙方本协议有效期内,发生死亡事故的,原则上不允许乙方亲属赴新加坡处理善后事宜。
如果乙方亲属强烈要求,则甲方协助乙方亲属(仅限两名,其中已婚的必须为配偶)赴新加坡处理善后事宜,一切费用由乙方亲属承担,甲方不承担乙方家属处理善后事宜的一切费用,并不对乙方的死亡事故承担赔偿责任;
11、乙方在本协议有效期内,甲方有权对其进行指导、监督。
若乙方违反本协议及其附件的相关规定,则甲方有权对其进行处罚,并要求乙方承担经济赔偿责任;
12、甲乙双方约定甲方可以在乙方出国前、在外工作期间以及归国后拍摄其照片,照片的著作权归甲方所有,甲方可无偿用于项目宣传。
三乙方责任和义务
1、按照甲方的要求,乙方应及时提交个人简历、身份证、户口簿、毕业证书、技能等级证书、近三个月内县级以上医院体检证明或健康证等材料,并保证所提交的材料真实有效(甲方建议女性在离境前应做妊娠检查,否则因怀孕不能出境或回国责任自负);
2、乙方不得隐瞒申请新加坡及其他国家签证经历,不得伪造身份证件再次申请新加坡工作准证,并保证无新加坡及其他国家的签证不良纪录;
3、乙方在申请办理赴新加坡工作过程中,不得隐瞒犯罪经历且不得发生新的犯罪行为;
4、乙方在办理赴新加坡工作过程中,不得单方面终止办理;
5、乙方按照甲方安排,应准时参加新加坡雇主或中介的考试及面试,不得有作弊或替考等行为,技能考试费用由乙方自行承担;
6、乙方必须保证按时赴新加坡工作;
7、乙方出入境时应严格遵守我国及新加坡海关规定,严禁携带违禁物品;
8、乙方赴新加坡后,必须接受新加坡政府及雇主安排的健康复查。
如果乙方未能通过新加坡政府及雇主安排的健康复查,则由此产生的后果由乙方自行承担,且所交纳的服务费不予退还;
9、乙方必须遵守新加坡的法律,尊重新加坡的宗教信仰、风俗习惯,不参加一切政治活动、集会、游行、罢工等;
10、在本协议有效期内,未得到甲方及雇主的允许,不得终止雇佣合同或者回国;若乙方擅自终止雇佣合同或者回国,造成的一切后果本人承担,与甲方无关。
乙方自己辞职的,一切后果由其本人承担,所交纳的一切费用不予退还;
11、在本协议有效期内,不得跳槽或接受除雇主以外的其他企业或个人任何形式的聘用,如有违反造成的一切后果由乙方本人承担,甲方有权追究乙方的违约责任;
12、在本协议有效期内,乙方应遵守雇主的规定,严格服从雇主的工作安排,不得向雇主提出不合理要求,如要求加班、提高待遇等;
13、在本协议有效期内,乙方如与雇主发生纠纷,应先与雇主协商解决,同时必须及时向甲方如实报告,无论何种情况均不得采取罢工、怠工或其他过激行为;
14、乙方应积极适应新加坡的工作和生活,无论何种原因,均不得采取自残、自杀或加害他人等过激行为;
15、乙方应主动维护国家尊严,不做有损国格、人格、危害国家安全的事,并高度警惕,防止被他人利用;
16、乙方不得向无关人员泄露本协议,不得泄露雇主企业的商业机密及薪水、加班等情况;
17、乙方在本协议有效期内,如发生以下特殊情况,乙方应及时向甲方报告,如果因为乙方不及时报告,所造成的一切后果由乙方自己承担:
(1)与雇主发生纠纷;
(2)工资待遇不相符和发生变化;
(3)因病不能继续在新加坡工作;
(4)发生生产安全事故或工伤;
(5)雇主发出工作警告时;
