　　PARTONE　GENERALPROVISIONS

　　Article1　ThisLawisformulatedinordertostrengthenconstructionandadministrationofroads，topromoteroaddevelopmentandtosuittherequirementsofsocialistmodernizationandofpeople'slives.

　　Article2　ThisLawappliestoallplanning，construction，maintenance，management，useandadministrationofroadswithinthebordersofthePeople'sRepublicofChina.

　　Theterm“roads”asusedinthisLawincludesroadbridges，roadtunnelsandroadcrossings.

　　Article3　Roaddevelopmentshouldfollowtheprinciplesofcompleteplanning，rationaldistribution，assuredquality，guaranteedunimpededpassage，environmentalprotection，andequalemphasisonconstruction，improvementandmaintenance.

　　Article4　Alllevelsofpeople'sgovernmentsshouldadopteffectivemeasurestosupportandpromoteroadbuilding.Roadconstructionshouldbebroughtintothenationaleconomicandsocialdevelopmentplan.

　　TheStateshallencourageandguidedomesticandforeigneconomicorganizationstoinvestinroadconstructionandoperationinaccordancewiththelaw.

　　Article5　TheStateshallassistandsupportthedevelopmentofroadconstructioninminorityareas，distantborderareasandpoorareas.

　　Article6　Roadsshallbedividedintonationalroads，provincialroads，countyroadsandtownshiproadsaccordingtotheirplaceintheroadnetwork.Theyshallbedividedintoexpressways，firstgraderoads，secondgraderoads，thirdgraderoadsandfourthgraderoadsaccordingtotheleveloftheirtechnology.TheprecisestandardsforeachcategoryshallbeformulatedbytheStateCouncildepartmentinchargeofcommunications.

　　Newlyconstructedroadsshouldmeetthetechnicalstandards.Inthecaseofuncategorizedexistingroadswhichdonotmeetthelowesttechnicalrequirements，measuresshouldbetakengraduallytoimprovethemsothattheymeetthetechnicalrequirements.

　　Article7　RoadsshallbeprotectedbytheState.Noworkunitorindividualshalldestroyordamageroadsorillegallyoccupyroads，roadlandorfacilitiesbelongingtoroads.

　　Allworkunitsandindividualsareobligedtoprotectroads，roadlandandfacilitiesbelongingtoroads，andhavetherighttoreporttotheauthoritiesandlodgecomplaintsaboutactionswhichdestroyordamageroads，roadlandorfacilitiesbelongingtoroadsorwhichaffectthesafetyofroads.

　　Article8　TheStateCouncildepartmentinchargeofcommunicationsisinchargeofroadworknationwide.

　　Departmentsinchargeofcommunicationsoflocalpeople'sgovernmentsabovecountylevelareinchargeofroadworkwithintheiradministrativedistrict，buttheresponsibilitiesofdepartmentsinchargeofcommunicationsofpeople'sgovernmentsabovecountylevelforadministrationandmonitoringofnationalandprovincialroadsshallbedecidedbytheprovincial，autonomousregionorcentrallygovernedmunicipalitypeople'sgovernment.

　　Township，minoritynationalitytownshipandtownpeople'sgovernmentsareresponsibleforconstructionandmaintenanceoftownshiproadswithintheiradministrativearea.

　　Departmentsinchargeofcommunicationsofpeople'sgovernmentsabovecountylevelmaydecidethatroadadministrationorganizationsshallexerciseresponsibilityforroadadministrationinaccordancewiththeprovisionsofthisLaw.

　　Article9　Itisprohibitedforanyworkunitorindividualillegallytoerectroadblocks，collectfees，imposefinesorinterceptvehiclesonroads.

　　Article10　TheStateshallencouragescientificandtechnologicalresearchonroadworkandshallrewardworkunitsandindividualsforoutstandingachievementsinresearchonandutilizationofroadscienceandtechnology.

　　Article11　WherethisLawhasprovisionsonroadsforspecialusetheyshallapplytoroadsforspecialuse.

　　Theterm“roadsforspecialuse”referstoroadsconstructed，maintainedandadministeredbyenterprisesorotherworkunitsspecificallyorprincipallyfortransportservicesforthatenterpriseorworkunit.

　　PARTTWO　ROADPLANNING

　　Article12　Roadplansshouldbedrawnuponthebasisoftherequirementsofnationaleconomicandsocialdevelopmentandofnationaldefenceconstructionandshouldbeco-ordinatedwithurbanconstructiondevelopmentplansanddevelopmentplansforotherformsoftransportandcommunications.

　　Article13　Planningoflandforroadconstructionshouldbeinaccordwithoveralllanduseplansandtheannualuseoflandforroadconstructionshouldbebroughtwithintheannualconstructionlanduseplan.

　　Article14　NationalroadplansshallbedrawnupbytheStateCouncildepartmentinchargeofcommunicationsinconjunctionwiththerelevantStateCouncildepartmentsandinconsultationwiththepeople'sgovernmentsoftheprovinces，autonomousregionsandcentrally-governedmunicipalitiesborderingtheroad，andshallbereportedtotheStateCouncilforapproval.

　　Provincialroadplansshallbedrawnupbytheprovincial，autonomousregionorcentrallygovernedmunicipalitypeople'sgovernmentdepartmentsinchargeofcommunicationsinconjunctionwiththerelevantdepartmentsatthesamelevelandinconsultationwiththelowerlevelpeople'sgovernmentsborderingtheroad.Theyshallbereportedtothepeople'sgovernmentoftheprovince，autonomousregionorcentrally-governedmunicipalityforapprovalandputonfilewiththeStateCouncildepartmentinchargeofcommunications.

　　Countyroadplansshallbedrawnupbythecountylevelpeople'sgovernmentdepartmentsinchargeofcommunicationsinconjunctionwiththerelevantdepartmentsatthesamelevel.Theyshallbereportedtotheimmediatelysuperiorlevelpeople'sgovernmentforapprovaloncetheyhavebeenexaminedandapprovedbythesamelevelpeople'sgovernment.

　　Townshiproadplansshallbedrawnupbythecountylevelpeople'sgovernmentdepartmentsinchargeofcommunicationswiththeassistanceoftownship，minoritynationalitytownshipandtownpeople'sgovernmentsandreportedtothecountylevelpeople'sgovernmentforapproval.

　　CountyandtownshiproadplansapprovedinaccordancewithParagraphs3and4shouldbereportedtoandputonfileatthedepartmentinchargeofcommunicationsimmediatelysuperiortotheapprovingauthority.

　　Provincialroadplansshouldbeco-ordinatedwithnationalroadplans.Countyroadplansshouldbeco-ordinatedwithprovincialroadplans.Townshiproadplansshouldbeco-ordinatedwithcountyroadplans.

　　Article15　Roadforspecialuseplansshallbedrawnupbytheworkunitinchargeoftheroadforspecialuseand，afterexaminationandapprovalbythesuperiordepartmentincharge，shallbereportedtothedepartmentinchargeofcommunicationsofthepeople'sgovernmentabovecountylevelforverification.

　　Roadforspecialuseplansshouldbeco-ordinatedwithroadplans.Departmentsinchargeofcommunicationsofpeople'sgovernmentsabovecountylevelwhichdiscoveraspectsofroadforspecialuseplansnotinco-ordinationwithnational，provincial，countyortownshiproadplansshouldsuggestamendments.Thedepartmentsandworkunitinchargeoftheroadforspecialuseshouldmakecorrespondingamendments.

　　Article16　Localadjustmentstonationalroadplansshallbedecidedbytheauthoritywhichdrewuptheplans.IfnationalroadplansrequiremajoramendmentanamendedplanshallbeputforwardbytheauthoritywhichdrewuptheplansandreportedtotheStateCouncilforapproval.

　　Ifapprovedprovincial，countyortownshiproadplansrequireamendmentanamendedplanshallbeputforwardbytheauthoritywhichdrewuptheplansandreportedtotheoriginalapprovingauthorityforapproval.

　　Article17　ThenamesandsymbolsofnationalroadsshallbedecidedbytheStateCouncildepartmentinchargeofcommunications.Thenamesandsymbolsofprovincial，countyandtownshiproadsshallbedecidedbythedepartmentinchargeofcommunicationsoftheprovincial，autonomousregionorcentrallygovernedmunicipalitypeople'sgovernmentinaccordancewiththerelevantregulationsoftheStateCouncildepartmentinchargeofcommunications.

　　Article18　Planningandnewconstructionofvillages，smalltownsanddevelopmentzonesshallpreservethestipulateddistancefromroadsandshallavoidencroachingonroadsidesinordertopreventroadsfrombecomingstreetsandsoaffectingsafeandunimpededpassageonroads.

　　Article19　TheStateshallencourageuseofroadsforspecialuseforpublictransport.Whenroadsforspecialuseareusedprincipallyforpublictransporttheymay，ontheapplicationoftheworkunitinchargeoftheroadforspecialuseoroftherelevantpartywiththeagreementoftheworkunitinchargeoftheroadforspecialuse，andwiththeapprovaloftheprovincial，autonomousregionorcentrallygovernedmunicipalitypeople'sgovernmentdepartmentinchargeofcommunications，beredesignatedasprovincial，countyortownshiproads.

　　PARTTHREE　ROADCONSTRUCTION

　　Article20　Departmentsinchargeofcommunicationsofpeople'sgovernmentsabovecountylevelshouldsafeguardtheorderlyconstructionofroadsinaccordancewiththeirdutiesandshouldstrengthenmonitoringandadministrationofroadconstruction.

　　Article21　Aswellasfinancesallocatedbyalllevelsofpeople'sgovernments，includingthosetransf
