ProvisionsonProhibitionofChildLabour

（Adoptedatthe63rdExecutiveMeetingoftheStateCouncilonSeptember18,2002,promulgatedbyDecreeNo.364oftheStateCouncilofthePeople'sRepublicofChinaonOctober1,2002,andeffectiveasofDecember1,2002）

Article1TheseProvisionsareformulatedinaccordancewiththeConstitution,theLabourLawandtheLawontheProtectionofMinorsforthepurposesofprotectingthephysicalandmentalhealthofminors,promotingtheimplementationofthesystemforcompulsoryeducationandsafeguardingthelawfulrightsandinterestsofminors.

Article2NoStateorgans,socialorganizations,enterprises,institutions,privatenon-enterpriseunits,orindividualindustrialandcommercialbusinesses（hereinafterreferredtoasemployingunits）mayrecruitandhireminorsundertheageof16（theterm"hiringminorsundertheageof16"ishereinafterreferreduniformlytoas"useofchildlabour"）.

Allunitsandindividualsareprohibitedfromprovidingjobplacementservicetominorsundertheageof16.

Minorsundertheageof16areprohibitedfromstartingbusinessandengaginginindividualbusinessoperationactivities.

Article3Theparentsorguardiansofminorsundertheageof16shallprotecttheirphysicalandmentalhealth,safeguardtheirrightstocompulsoryeducationandshallnotpermitthemtobeillegallyhiredbyemployingunits.

Wheretheparentsorguardiansofminorsundertheageof16permitthemtobeillegallyhiredbyemployingunits,thepeople'sgovernmentofthetownship（town）,theurbansubdistrictoffice,thevillagers'committeeortheresidents'committeewheretheyarelocatedshallcriticizeandeducatetheparentsorguardians.

Article4Employingunits,whenrecruitingemployees,shallverifytheidentificationcardoftherecruited;nominorsundertheageof16shallberecruited.Theemployingunitsshallproperlypreservethedocumentsforrecruitmentregistrationandverification.

Article5Labourandsocialsecurityadministrativedepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallberesponsibleforthesupervisionoverandinspectionoftheenforcementoftheseProvisions.

Administrativedepartmentsforpublicsecurity,industrialandcommercialadministration,educationandpublichealth,etc.ofthepeople'sgovernmentsatorabovethecountylevelshallsuperviseandinspecttheenforcementoftheseProvisionswithintheirjurisdictionandsupportthesupervisionandinspectionconductedbythelabourandsocialsecurityadministrativedepartments.

Tradeunions,YouthLeagues,Women'sFederationsandothersocialorganizationsshallprotectthelawfulrightsandinterestsofminorsinaccordancewithlaw.

Anyunitorindividualshall,wherediscoveringchildlabour,havetherighttoreportthecasetothelabourandsocialsecurityadministrativedepartmentofthepeople'sgovernmentatorabovethecountylevel.

Article6Inthecaseofuseofchildlabourbyanemployingunit,thelabourandsocialsecurityadministrativedepartmentshallpunishitbythestandardoffining5,000yuanforeachofchildrenemployedpermonth;Inthecaseofuseofchildlabourinworkplaceswheretoxicsubstancesareused,aheavierpunishmentshallbeimposedinconsistencewiththefinerangestipulatedintheRegulationsonLabourProtectioninWorkplacesWhereToxicSubstancesAreUsed,orbythestandardoffining5,000yuanforeachofchildrenemployedpermonth.Thelabourandsocialsecurityadministrativedepartmentshallordertheemployingunittosendthechildrenbacktotheiroriginalplacesofresidenceandhandthemtotheirparentsorotherguardianswithinaprescribedperiod,andallthecostsoftransportationandaccommodationssoentailedshallbebornebytheemployingunit.

Wheretheemployingunit,whenorderedtomakecorrectionsbythelabourandsocialsecurityadministrativedepartmentinaccordancewiththeprecedingparagraph,failstosendthechildlabourersbacktotheirparentsorotherguardianswithintheprescribedperiod,thelabourandsocialsecurityadministrativedepartmentshallpunishitbythestandardoffining10,000yuanforeachofchildrenemployedpermonthfromthedateoforderingcorrectionstobemadewithintheprescribedperiod,andthedepartmentforindustrialandcommercialadministrationshallrevoketheirbusinesslicensesor,thecivilaffairsdepartmentshallcancelthenon-enterpriseunitregistration;iftheemployingunitisaStateorganorpublicinstitution,therelevantunitsshallimposeadministrativeordisciplinarysanctionsofdemotionordischargingfromthepostonthepersonsinchargedirectlyresponsibleandotherpersonsdirectlyresponsible.

Article7Whereaunitoranindividualprovidesjobplacementservicetominorsundertheageof16,thelabourandsocialsecurityadministrativedepartmentshallpuni
