Article1

Forthepurposesofpunishingcrimesandprotectingthepeople,inaccordancewiththeConstitutionandinthelightoftheconcreteexperienceandactualconditionsofourcountryinfightingagainstcrimes,thisLawisformulated

Article2

ThetasksoftheCriminalLawofthePeople'sRepublicofChinaare:

toemploycriminalpunishmentstofightagainstallcriminalactsforthepurposesofdefendingthestate'ssecurity,politicalpowerofthepeople'sdictatorshipandsocialistsystem,safeguardingthepropertiesownedbytheStateandthepropertiesownedcollectivelybytheworkingpeople,protectingthepropertiesownedprivatelybycitizens,protectingtherightsoftheperson,democraticrightsandotherrightsofcitizens,maintainingthesocialorderandeconomicalorder,andensuringthesmoothadvanceofthecauseofsocialistconstruction

Article3

Anactwhichisexpresslydefinedbylawasacriminalactshallbeconvictedofacrimeandsentencedinaccordancewithlawand;ifitisnotexpresslydefinedbylawasacriminalact,itmaynotbeconvictedofacrimeandsentenced

Article4

AnypersonwhocommitsacrimeshallbeequalinapplyingthelawNopersonisprivilegedtobebeyondthelaw

Article5

Theseriousnessofpunishmentshallbedeterminedinaccordancewiththecrimecommittedbythecriminalandhiscriminalresponsibility

Article6

ThisLawapplieswhereapersoncommitsacrimeintheterritoryofthePeople'sRepublicofChina,exceptasspeciallyprovidedbylaw

ThisLawalsoapplieswhereapersoncommitsacrimeonboardashiporanaircraftofthePeople'sRepublicofChina
